N6235 State Road 65 Ellsworth, WI 54011 Re: Mark Carlson Land Use Permit,Permit#04LU24,Parcel#35.30.20.609D,Town of St.Joseph Dear Mr. Hines: This letter confirms zoning approval according to the plans you have submitted to construct a home in the Lower St. Croix River Valley District in the Town of St. Joseph. Staff finds that the proposed home meets the spirit and intent of the St. Croix County Zoning Ordinance (Lower St. Croix Riverway Ordinance)with the following findings: 1. The proposed home, with proper coloration and vegetative screening, will not be visually conspicuous from the river; 2. The proposed home, with implementation and maintenance of erosion control and stormwater plans as approved by the Land and Water Conservation Department,will not degrade sensitive natural resources; 3. The height of the home does not exceed 35 feet as measured from the base ground elevation to the highest point of the roof; 4. The home meets the required setbacks from the OHWM,road,and property lines; 5. The size and footprint of the proposed home is consistent with the house plans approved through a Special Exception permit for Thomas Solberg, previous owner of the property, on June 23, 1981. Therefore, the house can encroach up to 20 feet within the required 100' bluffline setback. 6. The approval of this project will not affect the public health,safety and welfare of County residents. Approval of the land use permit is subject to the following conditions: 1. The home and all trim must be painted or finished in natural or earth tones pursuant to Section 17.35(5)(m) of the Ordinance. 2. The applicant shall implement the erosion control plan and stormwater management plans approved by the Land and Water Conservation Department. 3. The applicant must contact the Planning and Zoning Department prior to commencing site preparation and when all construction is completed. 4. Upon completion of the construction,the applicant shall submit to the Planning and Zoning Department photos of the completed home as viewed from the middle of the channel of the St. Croix River or 250 feet from the shoreline, whichever is less,to be kept on file. 5. Upon completion of the construction,the applicant shall submit to the Planning and Zoning Department a landscaping plan showing the replacement of all trees and shrubs that are being removed as part of the construction pursuant to Section 17.36(5)(k) of the Ordinance. The plan should include the species, size, and location of all trees, shrubs, and groundcover. The applicant shall plant additional trees and shrubs as needed to fully screen the home from the river as viewed from any direction during summer leaf-on conditions. 6. Upon completion of the construction,the applicant shall submit to the Planning and Zoning Department an as-built drawing of the lot to be kept with the property file. 7. Upon completion of the construction and installation of the stormwater management measures,the applicant shall submit to the Planning and Zoning Department a maintenance and monitoring agreement. The applicants must record the stormwater management plan and maintenance agreement against the deed for the property and provide a recorded copy to the Planning and Zoning Department. The intent is to make future owners aware of the responsibilities associated with the plans as well as the limitations incurred as a result of the plans. This approval does not allow for any grading, filling, or clearing of vegetation beyond the limits of this request. Your information will remain on file in the St. Croix County Planning and Zoning Department. Please contact the Town of St. Joseph to obtain the necessary building permits for the proposed construction.
