The St. Croix County Board of Adjustment conducted a public hearing on
March 26, 1985 to consider the request of T. E. Janssen for a special exception
use, Article 3.12 E(c)(13),Bluffline Setback, ST. CROIX COUNTY ZONING ORDINANCE.

The St. Croix County Board of Adjustment conducted an on site inspection
of the site in question.
After inspection, the St. Croix County Board of Adjustment entered.an
Executive Session to discuss the request.
After returning to open session, the following decision was rendered:
Motion by Supervisor Kelly to approve the request of Mr. Janssen upon
receipt of a certified bluffline map and approval of DNR. Seocnded by Super-
visor Meinke. Regarding the former variance that was denied, the fence shall
be removed prior to approval of this request. Motion carried.
Vote to approve:
Stephens, yes;
Meinke, yes;
Kelly, yes.
All variances approved must be acted on or constructed within one (1) year
from date of approval or they shall be null and void.

BOARD OF ADJUSTMENT MEETING AND HEARING
March 26, 1985
9:00 a.m. - 3:00 p.m.

Meeting called to order by Chairman Stephens at 9:00 a.m. in the County Board
Room, Courthouse, Hudson, Wisconsin. All members present.
Minutes of the January meeting and hearings approved as written.
Mr. Arnold Beihoffer talked to the board about getting pre-hearing approval
of a setback from the water and highway on a parcel of land he has purchased.
Chairman Stephens informed him that the board cannot grant approval without
a hearing.
Discussion of rehearing the Steven Breault request for a holding tank as
required by the courts. Motion by Supervisor Meinke that a special hearing
be set for April 19, 1.985 at 6:30 p.m. for Arnold Beihoffer and 7:00 p.m.
for Steven Breault. Seconded by Supervisor Kelly. Motion carried. Zoning
Administrator to notify all parties by certified mail.
Zoning Administrator read letter from Robert Muller requesting abandonment of
his air strip. Motion by Supervisor Kelly to revoke the Board of Adjustment
approval for an air strip for Robert Muller. Seconded by Supervisor Meinke.
Motion carried.
Ronald Brettingen did not appear before the board.
Hearing called to order by Chairman Stephens. He set the guidelines for the
hearings. Zoning Administrator read notice of the hearings as published in
the county and local newspapers.

1. Arthur Partridge request postponed until April 30, 1985, as information
was incomplete.
2. William Mac Donald presented his request to have a junkyard in the
Township of Hammond. He will have parts and salvage late model cars and light
trucks. Zoning Administrator read letters from the Town Board, Village Board,
and neighbors against the request. There were eight persons speaking
against the request. There was no rebuttal.
3. Mr. T. E. Janssen and Mr. Robert Mudge presented the request of Mr.
Janssen to construct an addition to his present home on the river. Mr.
Janssen showed the Board plans for the structure. Zoning Administrator read
letter from MN-WI Boundary Area Commission requesting the request be tabled
until Mr. Janssen has a certified copy of the bluffline as required by the
ordinance. Jake Vander Voort, DNR, objected to the addition as it would be
visually conspicuous from the river. He would like to see the house from
the river and requested that the decision be postponed until the April 30 hearing.
Mr. Janssen said he has records showing the exact location of the bluffline, and
will give them to the board at the site.
4. Ralph Weggel: Motion by Supervisor Meinke to hold this case over until
April 30. Zoning Administrator to write him, requesting that he or his agent
appear at the April 30 hearing. Seconded by Supervisor Kelly. Motion carried.
Hearing recessed for inspection of all parcels in question.
After returning to session the following decisions were rendered;
I. Motion by Supervisor Meinke to deny the request of William Mac Donald
due to the town and village and local residents opposition. Seconded by Super-
visor Kelly. Motion carried. Vote to deny: Stephens, yes; Meinke, yes; Kelly,
yes.
2. T. E. Janssen: Motion by Supervisor Kelly to approve the request of
Mr. Janssen upon receipt of a certified bluffline map and approval of DNR.
Seconded by Supervisor Meinke. Regarding the former variance that was denied,
the fence shall be removed prior to approval of this request. Motion carried.
Vote to approve: Stephens, yes; Meinke, yes; Kelly, yea.

We are requesting a garage addition to our home for reasons
as follows:
i
1 . To enable us to provide for lawn equipment and tool
storage. We were turned down by the Board of Adjustment to
locate a fenced in area and Garden Shed within the
100' set back from the River bluff line. We can't
locate such a facility in our yard beyond the 100'
set back because of restrictions in the neiborhood res-
trictive covenants.
2. Our present garage is to small to accomodate the needed
storage.
3. Our home does not have a formal dining room and the
only practical place to locate a formal dining room with-
out requesting additional variances is in part of the
space now utilized as our existing, garage.
4. The laundry room in our home is located in the base-
ment. Because of health reason's on the part of some
of the family members we need to locate the laundry
room on the main floor of our home. The only practical
place to relocate the laundry room is in part of the space
taken by the existing garage.
We are also requesting the addition of a screened in
sun room and deck extension to allow us to reroute walk
in traffic from the yard and river to enter into the new
proposed laundry room. Currently such traffic enters
through a patio door into the living room. Sand and
soil from the yard and beach are continually tracked into
the living room area. It is our intention to close off
the existing patio door into the living room.

small exterior area that will keep q

We feel that the reviousl mentioned circumstances

creates a hardship given our unique situation of owning a
home built prior to the existing regulations which
needs to be upgraded
to maintain the needs of our family.y.
