CROIX ) A-57-84 COUNTY ZONING ORDINANCE. Location: ) October 23, 1984 Gov't Lot #4, Section 35, T30N-R2OW, ) Town of St. Joseph. ) The St. Croix County Board of Adjustment conducted a public hearing on October 23, 1984 to consider the request of T. E. Janssen for a special excep- tion use, Article 3.12, Bluffline Setback, Riverway District, ST. CROIX COUNTY ZONING ORDINANCE. The St. Croix County Board of Adjustment conducted an on-site inspection of the site in question. After inspection, the St. Croix County Board of Adjustment entered an Executive Session to discuss the request. After returning to open session, the following decision was rendered: Motion by Supervisor Stephens to deny this request as other sites are available on the property. Present structure shall be removed by November 15, 1984. Seconded by Supervisor Kelly. Motion carried. Vote to deny: Kelly, yes; Stephens, yes; Meinke, yes. All variances approved must be acted on or constructed within one (1) year from date of approval or they shall be null and void. E. Janssen bluff line setback variance request for my review and comment. The plan submitted, as well as my familiarity with the area, indicates that there are no physical hardships on the lot which would make a setback variance necessary. There is sufficient space on the lot so that the full 100' setback could be met. This also applies to the 25' side yard setback requirement. Therefore, we would object to the granting of any variances to either the bluff line or the side yard setbacks. If you have any questions about this matter, please contact me at (715) 836-2941. Janssen for construction of a fence and garden shed less than 100 feet from the bluffline on property in St. Joseph Township in the Lower St. Croix National Scenic Riverway. From the materials submitted, it is impossible for either our offie or the Board. of Adjustment to evaluate the application with respect to the distance from the bluffline to the structure. It is essential, according to the St. Croix County Riverway Ordinance, that a professional establish the location of the bluffline on the plan, as well as the location of the proposed building. In this case, a line drawn by Stevens Engineers Inc. identifies an "approximate bluffline" on part of the property, and. persons unknown have shown a "bluffline" on the remainder of the property in pencil. There is no certification of the bluffline location as required by the county ordinance and by NR 118. We recommend the county table this application until the proper materials have been submitted so that it can be factually evaluated. We suggest this also will give the applicant time to prepare an explanation for the county as to why the structure cannot physically be placed in compliance with the 100-foot setback. It would appear from the drawing (and we have not yet inspected the property to evaluate it fully) that Mr. Janssen has ample space on his property in which to locate a garden shed in compliance with the setback.
