Croix County Board of Adjustment conducted a public hearing on July 29 , 1981, to Consider the request of Dennis Schulstad for a Special Exception Use to Article 3 . 12 D 7 a 2 , Setback, Riverway District, ST . CROIX COUNTY. ZONING ORDINANCE . The St . Croix County Board of Adjustment conducted an on-site inspec- tion of the site in question. After inspection, the St. Croix County Board of Adjustment entered an Ext,cutive Session to discuss the request . Meeting called to order by Chairman Pierson at 10 :00 a.m. in Room B9 of the Courthouse, Hudson, Wisconsin. Present were Supervisors Meinke and Pierson. Supervisor Handlos was absent. Minutes of the May meeting accepted as read. Hearing called to order by Chairman Pierson at 10 : 20 a.m. Zoning Administrator read notice of hearings as published in the county and local newspapers . 1 . Article 3. 12 D 7 a 2, 3 . 12 D 7 b 2 and 3 . 12 D 7 c 5 (a) St. Croix Riverway District . Bluffline setback and height . APPELLANT: Thomas Solberg LOCATION: Government Lot 4, Section 35 , T30N-R20W. St . Joseph Township (Riverview Acres , Lot 3) 3 . Article 8. 4 F 1 c Driveway Separation APPELLANT: Gary Breault LOCATION: NEk of NEk, Section 27 , T30N-R19W. St . Joseph Township. Mr. Thomas Solberg presented his request to construct a house on a parcel of land he has an option to buy that would be approximately 60 feet from the bluffline of the St . Croix Riverway District . The height of the structure would be 35 feet from the basement floor to the peak of the roof and would have a side yard setback of 25 feet on each side of the house. The house would au.L Lt visible trom the river due to the trees . Mr. Solberg informed the Board that he has an access problem that would need to be resolved prior to construction. Zoning Administrator read letter from Minnesota-Wisconsin Boundary Area Commission having no objections on the setback but had some concern on the building being visible from the river. Questions by members of the Board. Chairman Pierson informed all present that the Board would view the sites before a decision would be made. He also informed those present that the Zoning Administrator will notify them of their decision after inspection of the property. Mr. Terry Janssen testified that his home can be seen from the river. Mr.. Janssen is concerned about the side yard setbacks . Mr. Al Santala of D.N.R. informed the Board that he did not want to comment until he views the site . Mr. Dennis Schulstad presented his request to construct a home on a parcel he owns that would be 40 feet from the bluffline of the St . Croix River. Mr. Schulstad explained that he would like to be in line with the houses on either side of his property, of which one is only 25 feet from the bluff. The house would be 25 feet high from the basement floor to the peak of the roof. Zoning Administrator read letter from Minnesota-Wisconsin Boundary Area Commission on the setback. They have no objection on the setback, , but are concerned about the visibility from the river. Mr . Al Santala, D.N.R. , is concerned about the visibility . He does not wish to comment until he has viewed the property. Mr. Gary Breault presented his request to have a driveway that does not meet the 200 foot separation. He has a permit to put the driveway entrance at 200 feet, but had it installed at 166 feet . QLestions .by members of the Board. Hearings closed in order to inspect all properties in question. Board,_went into executive session and returned to open session to render decisions . 1 . Tom Solberg: Motion by Supervisor Meinke to deny the request of 60. foot setback but to grant a setback of 80 feet from the bluffline and 35 foot building height on condition that he can meet all side yard setbacks along with meeting all requirements of D.N.R. -The driveway question shall also be resolved. Seconded by Supervisor Pierson. . Motion carried. Vote to approve the 80 foot setback and height restrictions : Meinke , yes ; Pierson, yes . D.N.R. concurs with Board of Adjustment decision. 2 . Dennis Schulstad: Motion by Supervisor Meinke to deny the 40 foot setback request and grant a setback of 80 feet from the bluffline . Seconded by Supervisor Pierson. Motion carried. Vote to approve the 80 foot setback from the bluffline . Meinke , yes ; Pierson, yes . D.N .R. concurs with, the Board of Adjustment decision. 3 . Gary Breault : Motion by Supervisor Meinke to deny the request of Gary Breault to have a driveway 166 feet from the driveway to the south-. - There is adequate area without a safety factor to have the driveway 200 foot separation. Zoning Administrator to issue a violation notice giving him 10 days to move the driveway to the north property line. Seconded by Supervisor Pierson. Motion carried. Vote to deny: Minke, yes ; Pierson, yes . A special meeting will be held on July 7 , 1981 at 10 :00 a.m. Agenda will be airstrip policies . Next regular scheduled meeting and hearing is July 28 , 1981 at 10 : 00 a.m. Being no further business , a motion by Supervisor Meinke to adjourn. Meeting and hearings adjourned at 3 : 00 p .m.
