The following policy was adopted at this meeting. POLICY: SUBDIVISIONS/CSM'S AND DISTURBANCE OF SLOPES 20%OR GREATER. 1. Developer to design the plat and staff to review the plat to ensure that disturbance of slopes of 20%or greater are avoided. 2. If slopes of 20%or greater are proposed to be disturbed the committee will consider that request. Staff cannot consider disturbances of slopes 20%or greater. Developer must provide offsetting mitigation for the disturbance. 3. Staff and committee to ensure ample erosion control structures are implemented in the steep slope areas;this may include the use of multiple erosion control structures and use of erosion control structures for driveways and buried utilities. 4. The County will require escrow money(letter of credit or bond)to ensure all land disturbances identified in the construction of the plat are managed,constructed and stabilized as designed. 5. Any proposed disturbance of slopes 20%or greater not identified on the approved plat or CSM and not covered by the escrow money are required to apply for and receive a separate special exception permit. This permit is applied for through the zoning office and is reviewed through a public hearing process by the St.Croix County Board of Adjustment. PROCESS In those exceptional cases where developer/surveyor proposes to disturb 20%slopes or greater the developer/surveyor must present conceptual plat to committee for discussion before preliminary plat is accepted by staff and deemed complete. St. Croix County Ordinance References: Subdivision Ordinance 18.03 (1) (1) Net buildable project area. The area of a lot exclusive of wetlands, floodplains,ponds, lakes,drainageways,road rights-of-way or easements, slopes of 20%or greater, or other regulated slopes, and other sensitive areas. 18.16(H) (2) Each lot shall have a net buildable project area of one acre or more. The one-acre or greater area need not be contiguous. However, there must be at least one single contiguous buildable area capable of accommodating the building site, the entire on-site waste disposal system, and driveway connection to the road or driveway that will serve the lot. The Committee may require that the plat or certified survey map contain notice to prospective purchasers that wetlands, floodplains, or steep slopes within lots may limit building or driveway locations. They are made available to validate uses which,while not approved within the zoning district in question, are deemed to be compatible with approved uses and/or not found to be hazardous,harmful,offensive or otherwise adverse to other uses. Special exceptions are subject to conditions,compatibility with surrounding land uses and compliance with the St. Croix Zoning Ordinance. At the public hearing,the applicant may appear in person or through an agent or an attorney of his/her choice. The applicant/agent/attorney may present testimony,evidence and arguments in support of his/her application. The fact that an application for a permit has been filed does not automatically mean that a permit is granted. The fee assessed for this application is non-refundable. All site plans,pictures,etc.become the property of the Zoning Department and will remain in the file. The project consists of creating building pads and driveways for two single family lots and grading a driveway for a third single family lot. Plans are included,which detail the grading and erosion control associated with the construction. Construction Construction will be concurrent with the construction of the subdivision which creates the associated lots. Construction is anticipated to begin the end of September and be completed in October of 2005. ARGUMENT The subject property is currently zoned for single-family homes and their associated facilities and structures. The use of this property will not change. Granting of this special exception request will allow us to maximize the use of this property by maximizing the allowable density while utilizing the most desirable and aesthetically pleasing building sites. This request is compatible with home and driveway construction that is found on property of similar topography and ensures that the construction is overseen by the project engineer, as it will be done concurrent with the other required construction activities on the proposed subdivision. This request also recognizes that road setbacks are an important consideration in selection of suitable building sites and complies with the current requirements when land of lesser degree of slope is available nearer the public road.
