SPECIAL EXCEPTION - The application for a special exception use
permit does qualify under the criteria of Section 17.65(3) of the
ordinance because signs are permitted by special exception.
ORDER AND DETERMINATION
The basis of the above finding of fact, conclusions of law and
the record in this matter the board orders:
VARIANCE/SPECIAL EXCEPTION - The requested special exception is
granted.
Motion to by Stephens, seconded by Bradley. Motion carried.
Vote: Stephens, yes; Menter, yes; Sinclear, yes; Kinney, yes and
Bradley, yes.
The Zoning Administrator is directed to issue a zoning permit
incorporating these conditions.
Any privilege granted by this decision must be exercised within
12 months of the date of this decision by obtaining the necessary
building, zoning and other permits for the proposed construction.
This period will be extended if this decision is stayed by the
order of any court or operation of law.
This order may be revoked by the Board after notice and
opportunity to be heard for violation of any of the conditions
imposed.
This decision may be appealed by filing an action in certiori in
the circuit court for this county within 30 days after the date
of filing of the decision. The municipality assumes no liability
for and make no warranty as to the reliance on this decision if
construction is commenced prior to expiration of this 30 day
period.

RE: `Sunrise Park'campground located in Section 3,T30N-R19W,Town of Somerset

You have requested this department to verify if a permit has been issued to a campground
_ r
known as Sunrise Park',located in Section 3,T30N R19W,Town of Somerset. According
to our records `Sunrise Park'has never been granted a special exception permit to operate a
campground along the Apple River by the St.Croix County Board of Adjustment.
In the case of`Sunrise Park Campground',it's our understanding that this use existed prior
to the adoption of the ordinance. If a nonconforming use existed prior to the adoption of
the ordinance,the use is allowed to remain, but could not expand unless the use was brought
into compliance with the provisions of the St.Croix County Zoning Ordinance.
According to Article 17.09 a nonconforming use is defined as a building or premises
lawfully used or occupied at the time of the passage o f this chapter ter or amendments thereto
which use or occupancy does not conform to the regulations of this chapter or any
amendments thereto.
Presently,this parcel is zoned Agricultural-Residential. In the Agricultural-Residential
District,campgrounds are not listed as permitted use or a use,which may be allowed by a
special exception.Campgrounds are only allowed as a special exception in the Shoreland's
Recreational-Residential District.
