4. No phosphorous fertilizers shall be used on the disturbed areas of the site,unless a soil test confirms that
phosphorous is needed for establishing permanent vegetative cover.
5. Mike Rogney,the Water Regulations and Zoning Engineer from the WI DNR has verified this property is
out of the hydraulic shadow of the dam failure analysis.
6. Within 30 days of completing the project,the applicant shall submit to the Zoning Administrator photos of
the re-vegetated areas and the rain garden for documentation of compliance with conditions. Photos may be
sent electronically via e-mail attachment.
7. This permit is valid for one year and the rain garden must be constructed within this time frame
This approval does not allow for any additional construction,structures or structural changes,grading,
filling,or clearing of vegetation beyond the limits of this request. Your information will remain on file in
the St.Croix County Community Development Department. It is your responsibility to ensure
compliance with any other local,state,or federal rules or regulations,including obtaining a building
permit from the Town of Hudson.

Re: Land Use Permit to remove an existing garage and construct a new 30 foot by 30 foot garage. Parcel
number 17.29.19.146F,Town of Hudson.
Dear Mr. Swenka;
This letter confirms zoning approval according to the plans you have submitted to remove a 442.5 square foot
garage and construct a 30 foot by 30 foot garage within 300 feet of a navigable waterway and to have up to 16%
impervious on the property referenced above in the Town of Hudson. The Community Development
Department(CDD) staff have reviewed the submittal and determined that the proposed project meets the spirit
and intent of the St. Croix County Zoning Ordinance and Shoreland overlay District with the following findings:
1. Constructing a garage and tearing down the old garage within 300 feet of a navigable waterway and to have
up to 16%impervious is allowed with a land use permit in the Shoreland�Overlay zoning district pursuant to
Section 17.30.K.1. of the St. Croix County Shoreland Zoning Ordinance.
2. The new garage will be 900 square feet and the increase in the impervious surface area will be accounted for
with a 225 square foot,6 inch deep rain garden. The building site will be greater than 75' from the Willow
River OHWM. Any other required setbacks or dimensional standards would be under the authority of the
Town of Hudson. The downspouts on the garage will be directed toward the newly constructed rain garden.
3. The applicant will place silt fence between the construction site and the river as indicated in the application
site plans. The applicant will also check the erosion control practices for stability and operation after there
is storm water run-off.
4. The existing vegetation within the 75 foot buffer will not be disturbed.
5. Mitigation-The 442 square foot garage removal awards the required 2 mitigation points to have 16%
impermeable surface area.
Based on these findings,approval of the land use permit is subject to the following conditions:
1. A pre-construction on-site meeting must be scheduled with the CDD staff to verify placement of erosion and
sediment control measures.
2. The rain garden must be constructed and vegetated. The area labeled rain garden on the site plan is a fish
pond and would not provide the necessary infiltration. The $350 dollar deposit will be refunded when the
rain garden is constructed and vegetated.
3. The applicant shall maintain all erosion and sediment control measures until permanent, self-sustaining
vegetation is successfully established on all disturbed areas of the site.

Hi Dan,
Yes, please send a copy of the FEMA map amendment for 970 Priester Lane,Town of Hudson,which indicates the house
has been removed from the floodplain. That information may be exactly what is needed for the proposed garage
project. I copied CDD staff who reviewed the information last Wednesday to determine whether or not county land use
permits were required.
