HomeMy WebLinkAboutResolution 2014 (47) Resolution No. 47 (2014) RESOLUTION AUTHORIZING HIGHWAY DEPARTMENT ST. 0 Y'NTY GRAVEL PIT LAND EXCHANGE WITH THE VILLAGE OF SOMERSET 1 WHEREAS,a growing company,Big Bad Toy Store(BBTS),in the Village of Somerset Industrial Park is 2 looking for land adjacent to their current location for expansion; and 3 4 WHEREAS,the St. Croix County Highway Department Somerset Shop and gravel pit is located adjacent to 5 the BBTS location;and 6 7 WHEREAS,the Highway Department has worked with the Village of Somerset in the past with various 8 joint efforts including the gravel pit and Somerset Industrial Park area to promote,maintain,and invite industry in 9 St. Croix County; and 10 11 WHEREAS,the Highway Department desires to obtain additional sand and gravel resources on land that 12 adjoins the gravel pit owned by the Village of Somerset; and 13 14 WHEREAS,the Highway Department has worked with the Village of Somerset to determine the needs of 15 each of the three parties,clean up various encroachments,drainage issues,easements,and the recording of streets; 16 and 17 18 WHEREAS,the Village of Somerset desires to acquire approximately 9.7 acres of land from the County 19 that is less desirable for sand and gravel to the Highway Department in exchange for approximately 5 acres from the 20 Village of Somerset that has higher quality and easier access of sand and gravel than the 9.7 acres(see attached legal 21 descriptions); and 22 23 WHEREAS,if the Village of Somerset acquires the 9.7 acres,the Village intends to work with BBTS on 24 future expansions,address the storm water and drainage issues as part of their industrial park,and address the local 25 encroachments within their Village; and 26 27 WHEREAS,the Village of Somerset has agreed to grant the Highway Department a reduction in the 28 setback from 100 feet to 40 feet along the adjacent properties that are not street right-of-way resulting in additional 29 resources to the County; and 30 31 WHEREAS,the additional sand and gravel resources contained in the 5 acres and the reduced setback will 32 benefit the Highway Department and other units of government that utilize sand and gravel resources for their 33 highway infrastructure improvements; and 34 35 WHEREAS,the Transportation Committee and the Village of Somerset assign approximate equal values to 36 the parcels proposed to be exchanged; and 37 38 WHEREAS,Wisconsin Statutes § 83.08 provides that the County Board is empowered to sell property that 39 is no longer necessary for highway purposes. 40 41 THEREFORE,be it resolved that the St. Croix County Board of Supervisors hereby authorizes the St. 42 Croix County Transportation Committee Chair and the Highway Commissioner to sign all necessary documents to 43 sell to the Village of Somerset the 9.7 acres of County land in exchange for the approximately 5 acres of land owned 44 by the Village of Somerset as shown on Exhibit 1,with no additional consideration to either party.
