C R O I s‘ LINTY Land Use Planning&Land Information Resource Management Community Development Department February, 17,2015 File#: LU88459 Mike&Patricia Burke 1548 A Gunston Drive New Richmond,WI 54017 Land Use Permit for Parcel#026-1126-30-000,lot 3 Waters Edge Subd.,Town of Richmond Site Address: 1665 Waters Edge Drive Community Development Department(CDD) staff reviewed your application submitted on October 15th for construction of a legal conforming principal structure in the Shoreland area of a navigable pond within Waters Edge subdivision. Staff determined that the proposed project meets the spirit and intent of the St. Croix County Shoreland Overlay District ordinance based on the following fmdings: Code Proposed Project Standards&Requirements References 17.30 F.4, G.1 The proposed house will be a legal conforming single family principal structure that is>75' &G.2,H.1.d. from the pond's OHWM. The house will meet all required structural setbacks. 17.30 I.1 &2 There will be>2000 sq.ft. of land disturbance required for construction of the house,driveway and Private On-site Wastewater Treatment System(POWTS)within 300' of the pond's OHWM, so a land use permit is required. 17.30.J.1 -4 The combined impervious surface area for the new house and driveway will be 7617 sq. ft. or 7.8% of the 2.24 Acres or 97,563 sq. ft. within 300' of the pond's OHWM. Up to 10% impervious is allowed without a requirement for mitigation. 17.30.K.1 Stormwater management is required to infiltrate 1.5"(0.125')of runoff from impervious surfaces, specifically roof runoff. The roof impervious surface(4017 sq. ft.)will require 18.6 cu. Yards or 3,756 gallons of runoff volume,which will be collected by house eves and directed to landscaping rock 200ft. x 5ft.x 0.5ft. along the outside of the house. It is recommended that the infiltration trench be sloped away from the house foundation. Driveway runoff will be directed to lawn areas away from the water resource. 17.30.K.2 Develop an erosion control plan. Erosion and sediment control measures are required to control sediment runoff during construction. As shown on the site plan, disturbed soils will be >75' from pond, silt fence will be installed along contour at the 100' setback extending out North and South beyond the disturbed areas where excavation for house and septic system will occur. Permanent vegetation establishment shall be as yard. 17.30 L.1 There is existing vegetative buffer within a 35' shoreline buffer zone from the OHWM that may not be mowed to the shoreline and must be maintained with an allowable access corridor (if desired by owner)that meets the 30%of frontage or 30' width requirement. 17.30 P.4. A complete Land Use Permit application was submitted on 10/15/14 with the$350 permit fee. 17.40.D.2 The new house will be outside the floodplain boundaries based on the floodplain analysis Floodplain approved January 12t 2015 by the WDNR. The floodplain elevation was determined to be Ordinance 977.3' mean sea level(msl). The lowest building opening(lbo)must be 2 feet above or at least 979.3 msl. The builder has determined the lbo will be 979.8. Erosion control measures(silt fence)will be installed between areas of construction activity and outside of the 75' structural setback to the pond's OHWM. This will provide a visual limit for contractors working on the house and maintain an adequate buffer zone. The sanitary permit issued for installation of the POWTS requires compliance with all conditions of the land use permit and contractors must be made aware of the conditions re•ardin• erosion and sediment control. The applicant or their agent will be responsible for implementation of approved storm water management plan by installing infiltration devices. No vegetation removal is approved outside the construction area shown in the approved plans or within 35' of the OHWM. The applicant shall obtain all applicable permits and approvals required for construction of the house and POWTS(see sanitary permit#572871). The contractor will need to provide the erosion control plan to the town's building inspector for compliance with Uniform Dwelling Code requirements. No phosphorous fertilizers shall be used on the disturbed areas of the site, unless a soil test confirms that phosphorous is needed for establishing permanent vegetative cover. During construction photos are required of the infiltration bed along the sides of the house to document rock depth and width. Within 30 days of completing the project,the applicant shall submit to the CDD photos of the infiltration bed construction,new gutters/downspouts,the existing shoreline vegetative buffer, and stabilization of disturbed areas(seeding)for documentation of compliance with permit conditions. Photos may be sent electronically via e-mail attachment. This approval does not allow for any additional construction,structures or structural changes,grading, filling,or clearing of vegetation beyond the limits of this request.
