CROIX COUNTY, WISCONSIN File: SE 88527 Applicant: Tom Rickard Agent: Josh Miller Location: Section 23, T31N, R1 8W in the Town of Star Prairie Hearing Notice Publication: February 9 and 16, 2015 Hearing Date: February 26, 2015 FINDINGS OF FACT AND CONCLUSIONS OF LAW Having heard all the testimony, considered the entire record herein, and reviewed the site the Board of Adjustment makes the following Findings of Fact and Conclusion of Law for the Conditional Use; 1) The applicant is Josh Miller, property owner is Tom Rickard. 2 The site is located in the NE 1/4 of the SW 1/4 of Section 23, T3IN RI 8W, Town of Star Prairie, St. Croix County. 3) The applicants filed an application with the Board of Adjustment for a Conditional Use Permit for a Commercial Kennel pursuant to Section 17.15(6)(f) of Chapter 17, Zoning of the St. Croix County Land Use and Development Code of Ordinances. 4) This operation is in compliance with Section 17.12 (15) Standards Applicable to Commercial Kennels in that it meets or exceeds the standards including: • It is not in a major subdivision • The structure will be more than 500 feet to the nearest property line (300 feet is required) • The kennel structure will be sound proofed in the walls and ceiling so that animal noise cannot be heard beyond the property's lot lines. • The kennel structure will be located at least 50 feet from a potable well • All animals will be housed indoors from 9:00 pm to 6:00 am • There will be no more than two adult dogs in any single enclosure unit • Parking area, exercise area and structure will be screened from adjoining properties with existing vegetation • Dog waste will be collected in dumpsters and removed from the site every two weeks by Waste Management, so that no odors will be perceptible at property lines. • Bark suppression devices will be used on all dogs while outside • No more than two dogs will be outside at any one time 5) The kennel insulation and distance to the property line will result in the sound at the property line being approximately 23 decibels which is equivalent to a ticking watch or leaves blowing in the wind. 6) The kennel building will have a bathroom so a sanitary system will be required. Approval of this special exception permit does not include any additional grading and filling, tree removal, structures, uses, or other development activities. 2) Prior to commencing any construction activities, the applicants shall secure a building permit from the Town of Star Prairie, a sanitary permit from the Community Development Department and any other required local, state, or federal permits and approvals. 3) The structure shall be more than 500 feet to the nearest property line (300 feet is required). 4) The kennel structure shall be sound proofed in the walls and ceiling so that animal noise cannot be heard beyond the property's lot lines. 5) The kennel structure shall be located at least 50 feet from a potable water supply well. 6) All animals shall be housed indoors from 9:00 pm to 6:00 am. 7) There shall be no more than two adult dogs in a single enclosure unit. 8) Parking area, exercise area and structure shall be screened from adjoining properties. If the existing vegetation on adjoining properties is removed the applicant shall provide screening as referenced above, using a row of 6 foot high coniferous trees to obtain 80 % opacity at maturity. 9) Dog waste shall be collected in dumpsters and removed from the site every two weeks, so that no odors will be perceptible at property lines. 10) Bark suppression devices shall be used on all adult dogs, six months of age or older, while outside. 11) No more than two adult dogs, six months of age or older, shall be allowed outside at any one time. 12) A sanitary system shall be installed to collect and treat all domestic wastewater. 13) Outdoor lighting shall be downward directed to avoid glare leaving the property. 14) These conditions may be amended or additional conditions may be added if unanticipated conditions arise that would affect the health and/or safety of citizens or degrade the natural resources of St. Croix County. Conditions will not be amended or added without notice to the applicant and an opportunity for a public hearing. Noncompliance with conditions imposed by the Board shall be grounds for revocation per Section 17.71(6)(a). 15) Accepting this decision means that the applicant has read, understands, and agrees to all conditions of this decision and has no objections if Community Development staff conducts unannounced onsite inspections to check for compliance with the conditions of this permit. The following vote was taken to deny: Chairperson Malick, yes; Nelson, yes; Sonnentag, yes; Niccum, yes; All vote yes, motion carries. APPEAL RIGHTS Any person aggrieved by this decision may file an appeal in St. Croix County circuit court within 30 days after the filing date shown below, pursuant to Sec. 59.694(10), Wisconsin Statutes. St. Croix County assumes no responsibility for action taken in reliance on this decision prior to the expiration of the appeal period. St. Croix County does not certify that the identity of all persons legally entitled to notice of the Board of Adjustment proceedings, which resulted in this decision, was provided to the County. The Planning and Zoning Department can be contacted for information on how to obtain a transcript.
