HomeMy WebLinkAboutResolution 2015 (04) Resolution No. 4 (2015) ST R01 'm,uUr, Ty RESOLUTION APPROVING ALTERATION OF SUPERVISORY DISTRICT BOUNDARY-VILLAGE OF BALDWIN 1 WHEREAS,in 2011 the St. Croix County Board of Supervisors adopted a 10-year supervisory 2 district plan creating county supervisory districts,municipal aldermanic districts and election wards 3 following the 2010 Census; and 4 5 WHEREAS, Wisconsin Statutes § 59.10(3)(c) allows a county board,in its discretion, to alter the 6 boundaries of supervisory districts based on annexations which occur after the adoption of the 10-year 7 supervisory district plan, as long as the number of supervisory districts is not changed; and 8 9 WHEREAS, the Village of Baldwin completed an annexation in January 2015 of a parcel 10 described as follows: 11 12 Village of Baldwin Ordinance 92015-01 consisting of approximately 10.65 acres annexed by the 13 Village of Baldwin is part of County Supervisor District 15 consisting of Ward 1 of the Town of Rush 14 River. It is appropriate to move the annexed parcel into the Village of Baldwin, Ward 6, County 15 Supervisor District 18. The population of the annexed parcel is zero (0)residents. The property will 16 be part of the Baldwin Area Medical Center and is zoned M-1 Mixed-Use Medical. 17 18 WHEREAS, a map of the annexed parcel, along with a copy of the annexation ordinance,has 19 been filed with the St. Croix County Clerk and are attached; and 20 21 WHEREAS, this resolution does not change the number of supervisory districts. 22 23 THEREFORE,be it resolved by the St. Croix County Board of Supervisors that the supervisory 24 district boundaries are hereby altered as described above; 25 26 FURTHER be it resolved that the St. Croix County Clerk is hereby directed to forward all notices 27 required under Wisconsin Statutes, Chapter 59, to the Secretary of State for the purpose of advising that 28 office of said supervisory district boundary changes. RESULT: ADOPTED [UNANIMOUS] MOVER: Travis Schachtner, Supervisor SECONDER: Christopher Babbitt, Supervisor AYES: Schachtner, Ring, Babbitt, Novotny, Nielsen, Kilber, Nelson, Berke, Ostness, Larson, Hansen, Brinkman, Peterson, Anderson, Achterhof, Leibfried, Peavey ABSENT: Roy Sjoberg, Ron Kiesler This Resolution was Adopted by the St. Croix County Board of Supervisors on March 3, 2015 Cindy Campbell, County Clerk ANNEXATION ORDINANCE NO. 2015-01 AN ORDINANCE ANNEXING TERRITORY TO THE VILLAGE OF BALDWIN , WISCONSIN WHEREAS petitioners Charles and Roselind Christenson have petitioned pursuant to §66.0217 of the Wisconsin Statutes for annexation of a certain land, more particularly described below, ("Property") into the Village of Baldwin; and WHERAS the Property is currently zoned agricultural and has a population of zero; and WHEREAS the procedure specified in §66.0217 for such annexation has been duly followed; and WHEREAS the State of Wisconsin, Department of Administration has issued its opinion as to the proposed annexation by letter to the Village of Baldwin dated December 19, 2014; and WHEREAS the Village Board of the Village of Baldwin has considered the opinion of the Department of Administration in its deliberations on this petition; NOW, THEREFORE, the Village Board of the Village of Baldwin, Wisconsin, does ordain as follows: SECTION 1. TERRITORY ANNEXED. In accordance with Sec. 66.0217 of the Wisconsin Statutes and the petition for direct annexation filed with the village clerk on or about December 3, 2014, and upon certifying that there are zero electors living in the Territory, the following described territory in the Town of Rush River, St. Croix County, Wisconsin, is annexed to the Village of Baldwin, Wisconsin: The Property is described as- A parcel of land located in the northwest quarter of the southeast quarter of Section 1, T28N, R17W, Town of Rush River, St. Croix County, Wisconsin, further described as follows: Commencing at the E '/a Corner of said Section 1; thence S89° 51'30"W 1317.48' along the east - west quarter section line of said Section 1 to the northeast corner of the northwest quarter of the southeast quarter of said Section 1, this being the point of beginning (bearings referenced to the east - west quarter section line of Section 1, line bears S89'5 1'30"W, St. Croix County Coordinate System ); thence continuing along said east - west quarter section line S89°51'30"W 459.78'; thence S00°49'58"E 931.05' to the northerly right-of-way line of Interstate Highway "94"; thence S70°28'15"E 344.91' along said northerly right-of-way line; thence, on a non-tangent curve 140.00' along the are of a 5509.58' radius curve concave to the northeast whose chord bears S72°33'34"E 139.99' to the east line of said northwest quarter Page 1 of 3 i of the southeast quarter; thence N00°39'03"W 1089.41' along said east line to the point of beginning, containing 463,773 square feet ( 10.65 acres ) more or less and being subject to any easements, restrictions or covenants of record. SECTION 2. EFFECT OF ANNEXATION. From and after the date of this ordinance, the territory described in Section 1 shall be part of the Village of Baldwin for any and all purposes provided by law and all persons coming to or residing within such territory shall be subject to all ordinances, rules and regulations governing the Village of Baldwin. SECTION 3. WARD The territory annexed to the Village of Baldwin by this ordinance is made a part of existing Ward 6. SECTION 4. ZONING CLASSIFICATION. The territory annexed to the Village of Baldwin by this ordinance is zoned M-1 Mixed- Use Medical. SECTION 5. SEVERABILITY. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.
