Based on these fmdin s, approval of the land use permit is subject to the following conditions:

Date
A pre-construction on-site meeting must be scheduled with the CDD staff to document pre-
construction site conditions and verify house/driveway location. Erosion control measures
(sediment logs)will be installed between areas of construction activity. This will provide a visual
limit for contractors working on the house and maintain an adequate buffer zone. The sanitary
permit issued for installation of the POWTS requires compliance with all conditions of the land
use permit and contractors must be made aware of the conditions regarding erosion and sediment
control.
The applicant or their agent will be responsible for implementation of approved storm water
management plan by installing infiltration devices. No vegetation removal is a pp roved outside the
construction area shown in the approved plans or within 50'of the wetland.
The applicant shall obtain all applicable permits and approvals required for construction of the
house and POWTS(see sanitary permit#578969). The contractor will need to provide the erosion
control plan to the town's building inspector for compliance with Uniform Dwelling Code
requirements.
No phosphorous fertilizers shall be used on the disturbed areas of the site,unless a soil test
confirms that phosphorous is needed for establishing permanent vegetative cover.
During construction,photos are required of the bioinfiltration/rain garden along the South side of
the house to document depth and width. Within 30 days of completing the project,the applicant
shall submit to the CDD photos of the bioinfiltration/rain garden installation,new
gutters/downspouts,wetland buffers and stabilization of disturbed areas(seeding)for
documentation of compliance with permit conditions. Photos may be sent electronically via e-mail
attachment.
This approval does not allow for any additional construction,structures or structural changes,grading,
filling,or clearing of vegetation beyond the limits of this request. Your information will remain on file in
the St. Croix County Community Development Department. It is your responsibility to ensure compliance
with any other local,state,or ederal rules or regulations,including obtaining a building permit from the
Town.

Community Development Department(CDD) staff reviewed your application submitted on May 29h,2015 for
construction of a legal conforming principal structure in the Shoreland area of a navigable pond within the future
Orchards of St. Croix subdivision. This is the first and only home allowed until the plat is completed. Staff
determined that the proposed project meets the spirit and intent of the St. Croix County Shoreland Overlay
District ordinance based on the following findings:

17.30 F.4, G.1 The proposed house will be a legal conforming single family principal structure that is>75'
&G.2,H.Ld. from the any OHWM. The house will meet all required structural setbacks.
17.30 L 1 &2 There will be>2000 sq. ft. of land disturbance required for construction of the house, driveway
and Private On-site Wastewater Treatment System(POWTS)within 300' of the pond's
OHWM, so a land use permit is required.
17.30.J.1 -4 The combined impervious surface area for the new house and driveway will be---6,355 sg. ft. or
4.8% of the 3.03 Acres or 131,972 sq. ft.within 300' of the pond's OHWM. Up to 10%
impervious is allowed without a requirement for mitigation.
17.30.K.1 Stormwater management is required to infiltrate 1.5"(0.125')of runoff from impervious
surfaces, specifically roof runoff. The roof and driveway impervious surface(6355 sq. ft.)will
require 29.4 cu.Yards or 5,942 gallons of runoff volume,which will be collected by house
eves and final grading directed to a bioinfiltration/rain garden located on the south side of the
house. The proposed biofiltration/rain garden will be 23 ft.by 23 ft.by 1.5 ft. deep.
17.30.K.2 Develop an erosion control plan. Erosion and sediment control measures are required to
control sediment runoff during construction. As shown on the site plan, disturbed soils will be
>50' from the wetland perimeter, sediment logs will be installed along the drainage easement
setback extending out East and West along the South beyond the disturbed areas where
excavation for house and septic system will occur. Permanent vegetation establishment shall
be as yard.
17.30 L.l There is existing vegetative buffer within a 35' shoreline buffer zone from the OHWM on
adjacent lots that may not be mowed to the shoreline and must be maintained with an allowable
access corridor if desired by owner that meets the 30% of frontage or 30' width requirement.
17.30 P.4. A complete Land Use Permit application was submitted on 5/29/15 with the $350 permit fee.
17.40.D.2 The new house will be outside the floodplain boundaries Zone X.
