ST RO .,, RESOLUTION TO PURCHASE REAL PROPERTY,ADJACENT
' ' TO THE ST. CROIX RIVER CROSSING LOOP TRAIL FOR A
COUNTY PARK AND APPROVE BUDGET AMENDMENT FOR
THE PURCHASE
1 WHEREAS, the Wisconsin Department of Transportation (WisDOT) as part of the St.
2 Croix River Crossing Project will build the St. Croix River Crossing Loop Trail for bicycles and
3 pedestrians and will pay 100% of the Loop Trial design and construction costs including a trail
4 head and limited amenities; and
5
6 WHEREAS, the St. Croix County Board of Supervisors adopted Resolution No. 28
7 (2014)in August, 2014 approving the Operation and Maintenance Agreement between WisDOT
8 and St. Croix County to maintain Loop Trail Facilities; and
9
10 WHEREAS, WisDOT will design and construct the agreed upon trail head amenities on
11 the existing land owned by WisDOT, however due to steep slopes and stormwater runoff
12 WisDOT has indicated additional land would help improve layout, design and provide space for
13 additional amenities; and
14
15 WHEREAS, WisDOT is willing to locate trail head facilities on additional land acquired
16 by St. Croix County; and
17
18 WHEREAS, 6.798 acres of flat, undeveloped land is available adjacent to the loop trail;
19 and
20
21 WHEREAS, the land has been evaluated and would provide the opportunity to improve
22 pedestrian safety by moving the on-road trail across from the Houlton Elementary School to an
23 off-road path, creates an open space buffer for low-impact land use,protects groundwater and
24 improves stormwater design; and
25
26 WHEREAS, the 6.798 acres would provide space for additional amenities including a
27 sanitary system allowing for upgraded restroom facilities, a maintenance building, expansion of
28 parking and offers space for other expansion options; and
29
30 WHEREAS, a contract to purchase real property of the 6.798 acres for $163,152 plus
31 closing costs, from James E Joyce Sr. Revocable Intervivos Trust and Gloria A Joyce Revocable
32 Intervivos Trust was entered into on June 16, 2015 (see attached); and
33
34 WHEREAS, St. Croix County entered into a Cooperative Agreement for Riverway
35 Mitigation as part of the St. Croix River Crossing Project with the Minnesota Department of
36 Transportation, MN/DOT Agreement No. 95705 on April 19, 2012,per the agreement, St. Croix
37 County received $2 million for mitigation to blufflands to provide replacement lands that offset
38 the impacts of a new crossing on the Wisconsin bluff and provide land and water conservation,
39 scenic protection and low-impact public recreation; and
40
41 WHEREAS, St. Croix County has consulted with the Wisconsin State Historic
42 Preservation Officer(WisSHPO), the Minnesota State Historic Preservation Officer(MnSHPO)
43 and other consulting parties, including Indian tribes, as appropriate in accordance with 36 CFR
44 §§ 800.3 - 800.5 to determine if historic properties will be affected.

46 WHEREAS, St. Croix County has consulted with and received concurrence from
47 Wisconsin Department of Natural Resources to purchase the 6.798 acres; and

49 THEREFORE, be it resolved that the St. Croix County Board of Supervisors approves
50 the purchase of 6.798 acres (see attached legal description) from the James E Joyce Sr.
51 Revocable Intervivos Trust and Gloria A Joyce Revocable Intervivos Trust for one hundred
52 sixty-three thousand one hundred fifty-two dollars ($163,152); and
53
54 FURTHER be it resolved that the St. Croix County Board of Supervisors approves
55 paying for title insurance,preparation of filing documents, filing fees and transfer fees; and
56
57 FURTHER be it resolved that St. Croix River Crossing Project funds (SCRCP),provided
58 through the MN/DOT Agreement No: 95705 which are non-levy funds, will be utilized for
59 acquisition and expenses; and
60
61 FURTHER be it resolved by the St. Croix County Board of Supervisors that the 6.798
62 acres is acquired under MN/DOT Agreement No: 95705 Cooperative Agreement for Riverway
63 Mitigation Items are part of the St. Croix River Crossing Project between The Minnesota
64 Department of Transportation and St. Croix County, Wisconsin and per that agreement are
65 considered protected lands which will be perpetually maintained for land and water conservation
66 purposes, scenic protection and other compatible uses, including low-impact public recreation;
67 and

69 FURTHER be it resolved the St. Croix County Board of Supervisors approves that
70 effective with the publication of the notices required by law, the budget of the County of St.
71 Croix, for the year beginning January 1, 2015, is amended by the following amounts to the line
72 item account numbers shown:
