ST 109, �wT ORDINANCE RENAMING AND AMENDING CHAPTER 76-
' ' VEHICLE IMPOUNDMENT ORDINANCE
1 WHEREAS, the St. Croix County Board of Supervisors enacted Vehicle Impoundment
2 Ordinance No. 345(94) on March 15, 1994 (now Chapter 76 of the St. Croix County Code of
3 Ordinances); and

5 WHEREAS, 2015 Senate Bill 153 authorized the disposition of abandoned vehicles to
6 include donation of the vehicle to a nonprofit organization; and
7
8 WHEREAS, the Public Protection and Judiciary Committee has reviewed Chapter 76 and
9 recommends the inclusion of language in said ordinance to allow for the donation of an
10 abandoned vehicle.

12 THEREFORE, the St. Croix County Board of Supervisors does ordain as follows:

14 Chapter 76 - Vehicle Impoundment Ordinance - of the St. Croix County Code of Ordinances is
15 hereby renamed and amended as Vehicle Impoundment and Abandonment Ordinance - as
16 attached hereto.

VEHICLE IMPOUNDMENT A. N D A B.,.A N D 0 N M E N T ORDINANCE
76.015 fion 4;- Release of Impounded Vehicle; Sale of Vehicle.
Release of Vehicle. Whenever the Sheriff determines that any motor vehicle, trailer,
semitrailer or mobile home (collectively hereinafter "vehicle") which had been impounded by
the County for purposes of evidence or other law enforcement purpose can be reclaimed o i.°is.,

be given written notice by certified mail containing the following information:
(,lJ The make, model and serial number of the vehicle, and the place where the vehicle is
being held.
The amount of the towing charge, if any, and that it must be paid before the vehicle is
released.
(,3a.). The vehicle must be reclaimed within to E (10 days of receipt of notice.
(+) Failure of the owner or lienholders to reclaim the vehicle within tefi (

deemed a waiver of all right, title and interest in the vehicle and a consent to the sale of
the vehicle and the vehicle shall be deemed abandoned.
(,5, The vehicle may be disposed of by sealed bid or auction sale. Notice of sale shall be
given as a Class I notice in the official County newspaper and posted in the Government
Center. If deemed inadequate by the Sheriff or his/her designee, all bids may be rejected.
If all bids are rejected or no bids are received, the County may either readvertise the sale,

costs of disposing of the vehicle would exceed the value of the vehicle, the vehicle can

(B-,J Sale of Vehicle.
(J,) Upon sale of the vehicle, the County shall supply the purchaser with a completed form
designed by the Wisconsin Department of Transportation enabling the purchaser to
obtain a regular certificate of title for the vehicle.

storage fee after the 2nd business day subsequent to the sale.
(,3a.). If the purchaser fails to remove the vehicle ten days after the sale, the purchaser shall
forfeit all interest in the vehicle and the vehicle shall be deemed abandoned and may be

(G. Notice to State. Within flyg (5) days after the sale or disposal of vehicle, the County shall

supplied by the department.
7 �0 S 4 I-. Enforcement.
The costs of disposal not recovered by sale of the vehicle may be recovered in a civil action by the
County against the owner.

This ordinance shall be effective upon adoption by the Board of Supervisors.
