HomeMy WebLinkAboutResolution 2016 (11) Resolution No. 11 (2016) ST RO .,, RESOLUTION AUTHORIZING THE SALE OF EXCESS ' �' COUNTY LAND 1 WHEREAS, St. Croix County owns 109 acres which the Highway Department plans to 2 use as a gravel pit, which is located in Sections 10 & 11, T3 IN, R17W, Town of Stanton; and 3 4 WHEREAS, included in said 109 acres is a 2.65 acre parcel of former Chicago and North 5 Western Railroad right of way described as follows: 6 7 The former Chicago and North Western Railroad lying within the SE1/4 8 of the SEl/4 of Sectionl0, T31N, R17W, Town of Stanton, St. Croix County, 9 Wisconsin; except that part of the SE1/4 of the SE1/4 of said Section 10 10 as described on that Quit Claim Deed recorded in Volume 976, Page 128, 11 Document Number 490274 at the St. Croix County Register of Deeds Office. 12 13 ;and 14 15 WHEREAS, adjacent land owner, David L. Maxon, utilizes a portion of said parcel for 16 his driveway; and 17 18 WHEREAS, in 2010, at the direction of the Transportation Committee by 19 recommendation of Corporation Counsel, Highway Department staff contacted David L. Maxon 20 to see if he had interest in purchasing said parcel; and 21 22 WHEREAS, at the time, David L. Maxon stated he was interested but not in a position 23 to make an offer; and 24 25 WHEREAS, St. Croix County has recently received from David L.Maxon, an offer of 26 $2000 to purchase said 2.65 acre parcel; and 27 28 WHEREAS, due to the geometry and conditions placed on said parcel, it was deemed to 29 have little practical value to the future operations of said highway department; and 30 31 WHEREAS, Wisconsin Statutes § 83.08 provides that the St. Croix County Board is 32 empowered to sell property that is no longer necessary for highway purposes. 33 34 THEREFORE, be it resolved, the St. Croix County Board of Supervisors approves the 35 sale of the above described 2.65 acres of excess County owned land to David L. Maxon for 36 $2000. 37 38 FURTHER, be it resolved, the proceeds will be credited back into the Highway 39 Department Pits and Quarries Fund.
