Staff finds that the proposed activities meet the applicable St. Croix County Zoning Ordinance for the Lower St. Croix Riverway District,based on the following findings: 1. The parcel consists of approximately 3 acres, located within the Lower St. Croix Riverway Overlay District 2. The proposed structure meets all applicable setbacks located within this district, as it is proposed more than 25' from the side lot line. The Town of Troy may require a greater setback from the right-of-way of Woodview Trail,but St.Croix County is considering the west property line as a side lot line and has no jurisdiction requiring more than 25' setback 3. The height of the structure will be less than the 35' maximum allowed in this district 4. The ground disturbance must not cause runoff or erosion issues, so at minimum there must be a properly installed silt fence and any other required erosion control measures necessary 5. The proposed site has 0-2%slopes,and is located greater than 40' from any slope preservation zones Based on these findings, approval of the land use permit is subject to the following conditions: 1. The owner must sign and record an affidavit describing the maintenance required to keep the rain garden properly functioning,which is also binding upon any future owners to follow the same protocol 2. A preconstruction meeting must be arranged by the owner,at least one week before the start of construction on the pole barn/accessory structure 3. The stormwater retention device(rain garden)must be installed within 30 days following completion of the pole barn,and the County notified for post-construction inspection 4.
