PROPERTY-OF THE ST. CROIX COUNTY CODE OF
ORDINANCES
1 WHEREAS, on April 19, 1994, the St. Croix County Board of Supervisors enacted
2 Ordinance No. 346(94), "Abandoned Personal Property Ordinance;" and
3
4 WHEREAS, Ordinance No. 346(94) authorized the County to dispose of abandoned
5 personal property; and
6
7 WHEREAS, on May 20, 2003 the St. Croix County Board of Supervisors approved
8 codification of all County ordinances into a chaptered code; and
9
10 WHEREAS, Ordinance No. 346(94) was inadvertently not included in the codification;
11 and
12
13 WHEREAS, the Public Protection and Judiciary Committee has determined that the
14 ordinance should also include donation of abandoned personal property to nonprofit
15 organizations.

17 THEREFORE, the St. Croix County Board of Supervisors does ordain as follows:

19 Ordinance No. 346(94)is hereby repealed and recreated as Chapter 31-Abandoned Personal
20 Property of the St. Croix County Code of Ordinances, attached hereto.
Legal-Fiscal-Administrative Approvals:
Legal Note: None
Fiscal Impact: There is no financial impact except to the extent that property may be donated
rather than other means of disposition.

CHAPTER 31
ABANDONED PERSONAL PROPERTY ORDINANCE
31.01 Disposal of Abandoned Personal Property.
(A) The County may dispose of any personal property, except vehicles (motor vehicle, trailer,
semitrailer or mobile home), which has been abandoned or remained unclaimed for a period
of 30 days after the taking of possession of the property. If known, the owner shall be sent
written notice that the property can be reclaimed and if it is not reclaimed within 30 days it
will be deemed abandoned and disposed of by the County. The County can dispose of the
property by any means determined to be in the County's best interest, including donating the
abandoned personal property to a nonprofit organization.
(B) If the property is not disposed of in a sale open to the public, the County shall:
(1) Maintain an inventory of such property.
(2) Maintain a record of the date and method of disposal, the consideration received for the
property, if any, and the name and address of the person taking possession of the
property.
(3) Keep this record as a public record for a period of 2 years from the date of disposal of the
property.
(C) If disposal is in the form of a sale, all receipts from the sale, after deducting the necessary
expenses of keeping the property and conducting the sale, shall be paid into the County
treasury.
(D) Disposal of abandoned personal property, except vehicles, includes retention of the property
for County use. Records of such retention shall be maintained as required in subsec. 2, above.
31.02 Effective Date.
This ordinance shall be effective upon adoption by the Board of Supervisors.
