HomeMy WebLinkAboutResolution 2016 (23) Resolution No. 23 (2016) ST R O .,, RESOLUTION APPROVING ALTERATION OF SUPERVISORY ' ' DISTRICT BOUNDARY-VILLAGE OF BALDWIN 1 WHEREAS,in 2011 the St. Croix County Board of Supervisors adopted a 10-year supervisory 2 district plan creating county supervisory districts,municipal aldermanic districts and election wards 3 following the 2010 Census; and 4 5 WHEREAS, Wisconsin Statutes § 59.10(3)(c) allows a county board,in its discretion, to alter the 6 boundaries of supervisory districts based on annexations which occur after the adoption of the 10-year 7 supervisory district plan, as long as the number of supervisory districts is not changed; and 8 9 WHEREAS, the Village of Baldwin completed an annexation in October 2015 of a parcel 10 described as: A parcel of land located in the northwest quarter of the southeast quarter of Section 6, 11 T28N, R16W, Town of Eau Galle, St. Croix County,Wisconsin, further described as follows: Lots 6 and 12 7 of Certified Survey Map filed August 30, 2002,in Volume 16,Page 4360, as Document No. 688844. 13 (6.745 acres) 14 15 WHEREAS, a map of the annexed parcel, along with a copy of the annexation ordinance has 16 been filed with the St. Croix County Clerk and are attached; and 17 18 WHEREAS, the parcel annexed by the Village of Baldwin is part of County Supervisor District 19 19, consisting of Ward 1, Town of Eau Galle; and 20 21 WHEREAS, it is appropriate to move the annexed parcel into County Supervisor District 18 in 22 Ward 6,Village of Baldwin; and 23 24 WHEREAS, the population of the annexed parcel is zero; and 25 26 WHEREAS, this resolution does not change the number of supervisory districts. 27 28 THEREFORE be it resolved by the St. Croix County Board of Supervisors that the supervisory 29 district boundaries are hereby altered by moving the annexed parcel of land from County Supervisor 30 District 19 to County Supervisor District 18 consisting of Ward 6 in the Village of Baldwin as shown on 31 the attached; 32 33 FURTHER be it resolved that the St. Croix County Clerk is hereby directed to forward all notices 34 required under Wisconsin Statutes, Chapter 59, to the Secretary of State for the purpose of advising that 35 office of said supervisory district boundary changes. 36 Legal—Fiscal—Administrative Approvals: Legal Note: None Fiscal Impact: None JA AWME- Cox Copvrao ouusel 21 12016 c Bert M' Fi ace irsactnr 1t'61 Pa ck Thompson,Connty Admini 2J1 M2016 02/17/16 Administration Committee APPROVED ......... ......... ......... ......... ......... ......... ......... ......... ......... ......... ......... ......... ......... ......... ......... .......... RESULT: ADOPTED [UNANIMOUS] MOVER: Jill Ann Berke, Supervisor SECONDER: Shaela Leibfried, Supervisor AYES: Ring, Babbitt, Novotny, Sjoberg, Koch, Kilber, Nelson, Berke, Ostness, Larson, Hansen, Kiesler, Brinkman, Peterson, Anderson, Achterhof, Leibfried, Peavey ABSENT: Travis Schachtner This Resolution was Adopted by the St. Croix County Board of Supervisors on March 1, 2016 Cindy Campbell, County Clerk ANNEXATION ORDINANCE NO. 2015-02 AN ORDINANCE ANNEXING TERRITORY TO THE VILLAGE OF BALDWIN , WISCONSIN WHEREAS petitioners LeRoy and Renee Storley have petitioned pursuant to §66.0217 of the Wisconsin Statutes for annexation of a certain land, more particularly described below, ("Property") into the Village of Baldwin; and WHERAS the Property is currently zoned agricultural and has a population of zero; and WHEREAS the procedure specified in §66.0217 for such annexation has been duly followed; and WHEREAS the State of Wisconsin, Department of Administration has issued its opinion as to the proposed annexation by letter to the Village of Baldwin dated September 9, 2015; and WHEREAS the Village Board of the Village of Baldwin has considered the opinion of the Department of Administration in its deliberations on this petition; NOW, THEREFORE, the Village Board of the Village of Baldwin, Wisconsin, does ordain as follows: SECTION 1. TERRITORY ANNEXED. In accordance with Sec. 66.0217 of the Wisconsin Statutes and the petition for direct annexation filed with the village clerk on or about June 26, 2015, and upon certifying that there are zero electors living in the Territory, the following described territory in the Town of Eau Galle, St. Croix County, Wisconsin, is annexed to the Village of Baldwin, Wisconsin: The Property is described as— A parcel of land located in the northwest quarter of the southeast quarter of Section 6, T28N, R16W, Town of Eau Galle, St. Croix County, Wisconsin, further described as follows: Lots 6 and 7 of Certified Survey Map filed August 30, 2002, In Volume 16, Page 4360, as Document No. 688844. (6.745 acres). SECTION 2. EFFECT OF ANNEXATION. From and after the date of this ordinance, the territory described in Section 1 shall be part of the Village of Baldwin for any and all purposes provided by law and all persons coming to or residing within such territory shall be subject to all ordinances, rules and regulations governing the Village of Baldwin. Page 1 of 2 I SECTION 3. WARD The territory annexed to the Village of Baldwin by this ordinance is made a part of existing Ward 6. SECTION 4. ZONING CLASSIFICATION. The territory annexed to the Village of Baldwin by this ordinance is zoned C-1-H - Highway Commercial SECTION 5. SEVERABILITY. If any provision of this ordinance is invalid or.unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application. SECTION 6. EFFECTIVE DATE. The annexation is effective upon enactment of this ordinance. Dated: /D / , 2015.
