The project to remove an invasive species (Buckthorn) is an allowed use, however any alteration or disturbance that results in soil erosion and sedimentation on steep slopes requires a permit. The navigable water body is mapped on the Wisconsin Department of Natural Resources, Surface Water Data Viewer an unnamed waterbody. The request is conditionally approved as explained below. 1. The removal of trees and shrubs in the vegetative buffer zone is permissible if found necessary to manage exotic or invasive species. According to Wis. Stat. 59.692 (1f) and NR 115.05 (1) (c) a viewing and access corridor is allowed and has been identified in the application to be at least 35-feet wide for every 100-feet of shoreline frontage; the viewing corridor may run contiguously for the entire maximum width. 2. Erosion control was installed on disturbed areas immediately adjacent to the waterbody. Any area that is left open must be covered with seed/mulch or an erosion control blanket within ten days of this approval. 3. The erosion control blanket installed must remain in place until the disturbed area has reached a point of at least 70% permanent vegetative cover. a. Erosion control must be repaired, replaced, or supplemented if it becomes nonfunctional. b. If permanent seeding does not establish by September 15, 2016 then a cover crop, such as winter wheat, annual outs or annual ryegrass, should be applied to disturbed areas according to WDNR Technical Standard 1059. This standard can be found on the DNR website: http://dnr.wi.gov/topic/stormwater/standards/. Permanent seeding will need to be reapplied in the spring. c. Phosphorous fertilizer shall not be used to establish and/or maintain vegetation, unless a soil test confirms phosphorous is needed. 4. Failure to comply with the terms or conditions above may result in the revocation of this permit by the Zoning Administrator according to Chapter 17.30 (13). Your information will remain on file at the St. Croix County Community Development Department suite. It is your responsibility to ensure compliance with any other local, state, or federal permitting or regulations, including contacting the Town of St. Joseph and Wisconsin Department of Natural Resources to inquire if additional permissions are required.
