The request has been conditionally approved as explained below. The proposed structure meets all setbacks including side, rear and the 75-foot setback from the road Right- Of-Way. The structure is greater than the required setback from the mapped Shoreland area of 75-feet. The proposed structure will not exceed 2.5 stories or 35-feet in height, whichever is greater, with the height measurements commencing at the level of the lowest usable floor according to the plans submitted by the agent on August 12, 2016. Impervious surface has been calculated and it has been determined that stormwater management is not required for this request. There are no vegetation removal activities proposed in this request within 75-feet of the mapped water body. Based on these findings, approval of the Land Use Permit is subject to the following conditions: 1. No filling or grading is allowed within 75 ft. of the mapped water body 2. Currently the site is covered in tall grasses and the site slopes away from the mapped water body. The grass buffers will act as erosion control. St. Croix County reserves the right to require additional erosion control measures to be installed during construction if warranted. 3. All viable topsoil that is removed and stockpiled shall have a grass buffer downslope to prevent erosion and sedimentation as shown in the plan. a. If the seeding does not occur prior to September 15, 2016 due to project constraints, then a cover crop (winter wheat or cereal rye) should be applied to all disturbed areas according to WDNR Technical Standard 1059 or disturbed areas shall be mulched. b. Phosphorous fertilizer shall not be used to establish and/or maintain vegetation, unless a soil test confirms phosphorous is needed. 4. The applicant shall comply with long-term POWTS maintenance and inspection requirements pursuant to SPS 383.52 (1) and Section 12.7 (B) of the county ordinance. The applicant shall secure any other required local, state, or federal permit(s) and approval(s) prior to land disturbance activity. 6. A post-construction inspection will be required prior to removing temporary erosion control measures to determine the entire project site has reached a point of 70% permanent vegetative cover. It is the applicant/agent’s responsibility to schedule this with Community Development Department staff. 7. Failure to comply with the terms or conditions above may result in the revocation of this permit by the Zoning Administrator according to Chapter 17.30 (13). This permit is valid for one year, with the possibility of up to two (2) six month extensions if the applicant submits the appropriate permit extension fee and documentation to the Zoning Administrator. It is the applicant’s responsibility to scheduled inspections with Community Development Department staff. This approval is subject to the conditions listed above; it does not allow for any additional construction, structures, grading, paving, filling or clearing of vegetation beyond the limits of this request. Your information will remain on file at the St. Croix County Community Development Department suite. It is your responsibility to ensure compliance with any other local, state, or federal permitting or regulations, including contacting the Town of Emerald and Wisconsin Department of Natural Resources to inquire if additional permissions are required.
