RE: Land Use Permit – Construction of Principal Structure in Riverway District
Site Address: 192 Starr Wood, Parcel # 020-1374-03-000, Sec. 12 T29N R20W, Town of Hudson
Mr. & Mrs. Sturtevant,
Your Land Use Permit application has been conditionally approved for the construction of a principle structure
(dwelling) in the Lower St. Croix Riverway Zoning District. Be sure to review the conditions of the permit, as
they must be followed implicitly. Failure to follow the conditions will resu lt in enforcement action and possible
revocation of the permit. It is your responsibility to contact the Town of Hudson about any permits that may be
required by the Town.
Facts & Background Information:
1. The property is Lot 3 of Starr Wood, approximately 1.68 ac in size, and partially located in the Lower St.
Croix Riverway Overlay Zoning District.
2. The lot is currently undeveloped and was purchased by the owner in July, 2015.
3. The proposal is to build a principle structure with an attached garage. No detached accessory structures
are proposed.
4. The majority of the proposed structure will be located within the Lower St. Croix Riverway District, with
a small portion that is located in the Town of Hudson jurisdiction (underlying zoning district).
5. The proposal within the Riverway District includes ≈ 9,736 ft2 of total land disturbance (POWTS,
dwelling, driveway)
6. The proposed structure is approximately 25’ in height, well under the 35’ maximum allowable.
7. The structure is greater than 25’ from the east property line, and the west portion of the property is located
outside the Riverway boundary, in the Town of Hudson jurisdiction.
8. The structure meets the required setback of 40’ from the bluffline/slope preservation zone (≈47’), and will
meet all the required performance standards for the reduced setback.
9. The structure will be located will beyond 200’ from the OHWM of the St. Croix River.
10. All impervious surfaces have been identified in the plan and have infiltration devices/measures that will
accommodate the runoff from a 1.5” rainfall event before any surface flow leaves the property.
Based on these findings, approval of the land use permit is subject to the following conditions:
1. There shall be no land disturbance in excess of 10,000 ft2 in the Riverway District. Any limits imposed
by the Town of Hudson are beyond the jurisdiction of St. Croix County.
2. The proposed principle structure shall be no taller than 35’, as measured according to the standards in
SCC Section 17.09.
3. The structure shall meet the 25’ sideyard setback on the eastern property line.

4. The structure must meet the performance standards detailed in Section 17.36(G)(5)(c)(2)(a); by not
protruding above the bluffline when viewed from the midline of the St. Croix River, not being located in
a slope preservation zone, being earth-toned in color, and remaining visually inconspicuous.
5. The structure shall be greater than 40’ from the bluffline setback, and no ground disturbance shall be done
within 40’ bluffline setback. (Per phone conversation with Bruce L. on 10/21/15 @ 4:30p.m.)
6. All impervious surfaces shall be drained to designed retention/infiltration areas that will accommodate a
1.5” rainfall event. All design & maintenance requirements per the stormwater design plan shall be
followed, and an affidavit must be recorded that stipulates the plan and this approval be followed in
perpetuity, to insure their proper operation.
7. All vegetation proposed in the stormwater design plan shall be maintained in a manner that promotes the
proper operation of the rain gardens, and all debris must be removed on a regular basis to prevent
stormwater from leaving the intended detention/infiltration areas.
8. The construction of the stormwater retention/infiltration devices must be completed within 60 days of the
final grading at the site, or as soon as weather permits. Contact this department if 60 days is not enough
time to finish constructing them after final grading is finished.
The owner or owner’s agent must contact this department for an onsite verification at the following times
in the construction sequence:
I. After erosion control has been put in place and before any land disturbance occurs.
II. Before any erosion control measures are removed, as there must be at least 70% vegetative cover
established.
III. After the construction of the stormwater retention devices have been completed.
This permit is valid for one year, with the possibility of up to two (2) extensions if the applicant submits a permit
extension fee and documentation.
This approval does not allow for any additional construction, structures or structural changes, grading,
filling, or clearing of vegetation beyond the limits of this request. Your information will remain on file in
the St. Croix County Community Development Department. It is your responsibility to ensure compliance
with any other local, State, or Federal rules or regulations, including contacting the Town to inquire if they
require a permit.
