RE: Land Use Permit in Shoreland Overlay District §17.30
Site Address: 2252 County Road CC, Parcel # 038-1038-50-000 & 038-1038-60-000, Town of Star Prairie
Community Development Department (CDD) staff have reviewed your application for the construction
of a new principal structure and land disturbance activity, after-the-fact, within the Shoreland Overlay
District, and have conditionally approved the request as explained below. Staff determined that the
proposed project meets the St. Croix County Shoreland Overlay District based on the following findings
and background information:
Background Information and Fact
On December 4, 2015 a cease and desist order was sent certified regarding the land disturbance
activities observed within the Shoreland area without appropriate permit submittal. This Land
Use Permit is issued after-the-fact to abate this violation.

The principal structure is greater than 75-feet from the ordinary high water mark
(OHWM) of the unnamed navigable water body listed as WBIC 5528148 on the
Wisconsin DNR Surface Water Data Viewer. More specifically at approximately 426-
feet from the pond as indicated on the site plan.
17.30 I The total amount of disturbance will be greater than 10,000 sq. ft. within 1,000-feet
landward of the OHWM, which slopes toward and drains to the water body.
17.30 J The total of amount of impervious surface located within 300’ of the navigable water
body is less than 15%.

As shown in the site plan, disturbed soils will be seeded and mulched to prevent
sedimentation down steep slopes and into the adjacent water body and wetlands. The
smallest amount of bare ground shall be exposed for as short a time as feasible. The
agent shall maintain all erosion and sediment control measures until permanent, self-
sustaining vegetation is successfully established on all disturbed areas of the site.

A Land Use Permit application was submitted on January 8, 2016 with the $350 permit
fee. Supplemental information to consider the application complete was submitted on
January 29, 2016.
The project shall be completed within one year from issuance of the Land Use Permit;
however up to two (2) six month extensions may be granted by the Zoning
Administrator prior to the expiration of the Land Use Permit.
It is the applicant/agent’s responsibility to schedule pre-construction, mid-
construction, and post-construction inspections with CDD staff.

General zoning provisions apply in which the underlying zoning is mapped as the
Rural Residential District. The proposed structure meets the minimum side, rear and
road setbacks listed in the ordinance. As noted in the application, if the barn is
converted into a Single Family Dwelling all appropriate permits will need to be pulled,
including UDC and sanitary permits.
Based on these findings, approval of the land use permit is subject to the following conditions:
Compliance Conditions for land use permit approval
Due to the fact that ground disturbance has already occurred prior to permit approval
erosion control (seed and mulch) must be applied as soon as possible, weather
permitting. An inspection will be required after installation to verify erosion control
installation. The application of additional erosion control, such as erosion control
blankets, straw bales, choir logs or silt fencing, may be required at time of inspection
around soil storage piles or areas with steep slopes if uncontrolled erosion is noted by
the inspector.
The applicant or agent is responsible for inspecting all erosion control measures
immediately following a heavy rainfall event to insure that said devises are functioning
as designed. Runoff should be maintained in sheet flow (not channels) to the greatest
extent possible.
This approval is subject to the January 29, 2016 application and the exhibits submitted
with it. It does not allow for any additional construction, structures or structural
changes, grading, filling or clearing of vegetation beyond the limits of this request. Any
change, modification of or addition to the property, building, or facilities shall require
review by CDD staff. If additional land disturbance is proposed, it is advised to contact
this Department first.
If violations are identified, enforcement procedures shall be commenced by CDD staff.
Your information will remain on file at the St. Croix County Community Development Department suite.
It is your responsibility to ensure compliance with any other local, state, or federal permitting or
regulations, including contacting the Town of Star Prairie to inquire if additional requirements are needed.
