An inspection of the private sewage system serving the above indicated
building conducted on May 25, 1983, revealed the following discrepancies.
You are hereby directed to have the installation corrected to conform to the
provisions of the Wisconsin Administrative Code and Wisconsin Statutes.
1. Untreated domestic wastes (laundry, lavatory, and bath water) are being
discharged to the ground surface creating a health hazard and nuisance.
This is a violation of section 146.14 (2), Stats.,
f 2. All domestic wastes are not entering the approved holding tank system
which is a violation of s. H 63.04 (1), Wis. Adm. Code.
The interior plumbing shall !)e changed so that all domestic wastes enter the
approved holding tank system. The corrections must be completed within
30 days of the date of this letter. Notify this office upon completion of
corrections for the purpose of final disposal of this matter.

COMES NOW the Plaintiff, State of Wisconsin through the Department of
Industry, Labor and Human Relations, by its attorney, Harley F. Stark Jr.,
Assistant District Attorney for St. Croix County, complaining against the
defendant, Marshall Schillinger, and alleges as follows:
1. That plaintiff is an agency of the State of Wisconsin empowered
under Chapter 145, Wis. Stats., with the authority to administer
the State Plumbing Code and to regulate the practice of plumbing
in the state of Wisconsin;
2. That defendant owns real estate in part of the SE4 of the SW4 of
Section 28-29-15, in the Town of Springfield, St. Croix County,
Wisconsin, and that this property is currently being rented as a
single family residence;
3. That the plaintiff inspected the above installation on May 25,
August 17, and October 6, 1983, and found it to be not in com-
pliance with the State Plumbing Code;
4. That on June 15, and August 25, 1983, the plaintiff issued orders to
the defendant ordering him to correct the plumbing installation and
bring it into compliance with the applicable provisions of the
plumbing code and state statutes;
5. That the defendant has failed to correct the installation as ordered;
6. That the defective installation constitutes a health hazard in that:

b. All domestic wastes are not entering the approved holding tank
system in violation of Section ILHR 83.04(1) of the Wis. Admin-
istrative Code.
7. That Section 145.02(3)(f) of the Wis. Stats. places in the Circuit
Court of the County where the violation occurred the jurisdiction to
enforce departmental orders by injunction or other appropriate relief.
WHEREFORE PLAINTIFF DEMANDS JUDGMENT AGAINST THE DEFENDANT.
1. That the defendant be ordered to make all corrections necessary to
bring the installation described in paragraph 2 into compliance with
the plumbing code and applicable statutes, or to pay to have said
corrections performed by a licensed master plumber;
2. Further that the defendant pay all costs and disbursements of this
action, together with the $100 per day forfeiture for such time as
said nuisance continues;
3. Further that plaintiff be granted such other, or further relief as
may be agreeable to equity.

1. That he has read the complaint of the State of Wisconsin, Department
of Industry, Labor and Human Relations, plaintiff in this action.
2. That he is the district plumbing inspector for the Department of
Industry, Labor and Human Relations, with an address of 13 Spring
Street, Chippewa Falls, WI.
3. Of his own knowledge the following stated in the complaint are true:
That untreated domestic wastes (laundry, lavatory and bath water)are
being discharged to the ground surface creating a health hazard and
nuisance in violation of Section 146.14(2) of the Wis. Stats. and
further that all domestic wastes are not entering the approved
holding tank system which is a violation of Section of ILHR 83.04(1)
of the Wis. Administrative Code.
4. With respect to all matters stated in the complaint; on information
and belief he believes them to be true.
5. That your affiant makes this affidavit in support of an action
enjoining the defendant to take corrective action on a plumbing
installation for which he is responsible.

The Department of Industry, Labor and Human Relations, based upon the attached
affidavit, has determined that the private sewage system located at
Marshall Schillinger rental property, in part of the SE 1/4, SW 1/4,
Section 28, T29N, R15W, Town of Springfield, St. Croix County, Wiscons
violates the following provisions of the Wisconsin Administrative Code and
Wisconsin Statutes.
1. Untreated domestic wastes (laundry, lavatory, and bath water) are being
discharged to the ground surface creating a health hazard and nuisance.
Tnis is a violation of section 146.14 (2), Stats.
2. All domestic wastes are not entering the approved holding tank system
which is a violation of s. ILHR 83.04 (1), Wis. Adm. Code.
The Department hereby orders you to correct the interior plumbing so that all
domestic wastes discharge to the approved holding tank system. A licensed
plumber must make the required corrections. Corrections must be completed
within thirty (30) days of receipt of this order, and you must notify
Mr. Leroy G. Jansky, On-Site Waste Specialist, 13 East Spruce Street,
Chippewa Falls, Wisconsin 54729, telephone (715) 723-8786, at the completion
of said corrections so that an inspection can be conducted.

Leroy G. Jansky, being duly sworn on oath, says that he is employed by the
Department of Industry, Labor and Human Relations located at 13 East Spruce
Street, Chippewa Falls, Wisconsin 54729, and that in the course of his duties
he inspected a plumbing installation at the following location:
Marshall Schillinger rental property, in part of the SE 1/4, SW 1/4,
Section 28, T29N, R15W, Town of Springfield, St. Croix County, Wisconsin. His
inspection revealed the following violations of the Wisconsin Administrative
Code and Wisconsin Statutes.
1. Untreated domestic wastes (laundry, lavatory, and bath water) are being
discharged to the ground surface creating a health hazard and nuisance.

A reinspection Conducted on August 17, 1983, indicated the plumbing to the
rt(;lding talk system serving the above building has not been corrected as per
our directive of June 15, 1985.
Y You are hereby directed to have the installation carrecteo to conform to the
provisions of the Wisconsin Administrative Code and Wisconsin Statutes.
1. Untreated d stic wastes (laundry, lavatory, and bath water) are tieing
l discharged to the ground surface creating a health hazard and nuisance.
This is a violation of section 14i.14 (2), Stats.
2. All domestic wastes are riot entering the approved holding tank system
which is a violation of s. KiiR 830.04 1), Wig,. Adin, Code.
Significant progress must be made toward completing the above corrections within
thirty days of toe date of this letter. Please notify Mir. Leroy G. Jansky,

54729, telephon (715) 723-8736, for purposes of reinspection.
