Please note the following facts/findings, and how they relate to the conditions listed: FACTS & BACKGROUND INFORMATION: 1. Property was vacant until the driveway and illegally placed structure were constructed, starting in 2015. 2. The site plans show the grading work that has already been done at the site, as well as the erosion control that was installed per County directive. 3. The disturbed areas were not within a wetland boundary, nor were there sedimentation of any soils into the adjacent wetlands or navigable waterways at the time staff did site inspections (January 2016). 4. The filling and grading activities were visited by staff onsite several times (pictures on file), and there was the directive to maintain the following BMP’s for stormwater/erosion control: Creation of berms in several places, installation of silt fence around all disturbed areas and double rows in all of the drainage ways, and the placement of straw or mulch on all the disturbed areas following the application of grass seed. 5. Erosion control and stormwater measures per SCC 17.30(K)(2) are required to followed until all soils are stabilized. 6. This permit approval does not authorize the placement of the illegally constructed structure, estimated to be 57’ from the OHWM of the Apple River. This structure must conform to the applicable sections of St. Croix County Ordinance, which will be permitted in the future with a new land use permit when deemed compliant, or preferably as an addendum of this application (LUP-2016-007). Based on these findings, approval of the land use permit is subject to the following conditions: 1. The erosion control measures that were put in place by staff directive and/or per the plans submitted, must remain in place until the County has provided you with written approval that states their removal is warranted. This will not occur until all the disturbed soils (which are not used as a driving surface) have reached a point of 70% vegetative cover. 2. All disturbed areas on the site must be immediately planted with native vegetation as soon as permissible in the spring, and/or the soils must be covered with some type of erosion control blanket/mulch such as excelsior blanket or hydro-mulching. 3. There shall be no further disturbance or building activity at the site, until there has been an approved land use permit or addendum to this application. In essence, no land disturbing activity can take place until a future land use permit is approved for a compliant building location that the illegally placed principle structure will be moved to. This must be accompanied by a sanitary permit at the time of application, which will be required for a land use permit to be issued. Staff will stop at the property in the near future (possibly multiple times), to ensure there are no violations of these permit conditions, as well as ensuring that the erosion control measures that were put in place are effectively preventing sedimentation issues from occurring. 5. The owner must routinely inspect the erosion control measures (at minimum every 7 days or within 24 hours following a rainfall event), and keep a written record of every inspection that is conducted. County staff may ask to see the written record, and the owner must presen t this within 7 days. For information required to be contained within the written report, please refer to the WPDES permit you were issued by the WI DNR. This permit is valid for one year, with the possibility of up to two (2) six month extensions if the applicant submits a permit extension fee and documentation. IT IS THE APPLICANTS/AGENTS RESPONSIBILITY TO ARRANGE INSPECTIONS. This shall be done at the following times:  Before any erosion control measures are removed and all disturbed areas on the site have had vegetation established to the satisfaction of this department (approximately 70% cover).  Within 48 hours of a malfunction with an erosion control measure, which has caused sediment to be carried off the property or toward a wetland/navigable water body. This approval does not allow for any additional construction, structures or structural changes, grading, filling, or clearing of vegetation beyond the limits of this request. Your information will remain on file in the St. Croix County Community Development Department. It is your responsibility to ensure compliance with any other local, state, or federal rules or regulations, including contacting the Town of Star Prairie to ask if they require any permits.
