Community Development Staff have reviewed your Land Use Permit application for the construction of a new
principal structure (dwelling) in the Shoreland Overlay District, and conditionally approved the request as
explained below. Please note the following background information, as well as how it relates to the conditions
this permit was issued upon, as the owner is responsible for ensuring all conditions are met. Failure to meet
BACKGROUND INFORMATION:
1. The proposed dwelling will be located in the Town of Star Prairie.
2. The structure is proposed: beyond any applicable shoreline OHWM setbacks, greater than 50’ from a
wetland, more than 15’ from the nearest side property line, and no filling/grading or structures are proposed
within any mapped floodplain.
3. The proposal will disturb >2,000 feet2 within 1000’ of OHWM of an unnamed water body. All filling and
grading activities will be conducted on slopes less than 25%.
4. Some silt fences are already in place due to the filling and grading permitted by the after-the-fact permit
(LUP-2016-007) prior to the addendum submission, to correct the previously unpermitted filling/grading.
5. There was an accessory structure illegally constructed, within the OHWM setback & within the Shoreland
Overlay District without a land use permit. This proposal includes relocating it to a compliant area beyond
the required setbacks.
6. The proposed impervious surface located within the shoreland area will be less than 15% and therefore does
not require mitigation, per NR 115 requirements.
7. The driveway will be finished (final graded and gravel laid down), only in the areas shown per the plans.
FINDINGS AND CONDITIONS:
1. The new principal structure to be constructed must meet the following setbacks:
≥ 75’ from the OWHM of a navigable water body/feature
≥ 10’ side/rear yard lot line
≥ 5’ from any septic/dose tanks
≥ 10’ from a distribution cell of a POWTS
≥ 20’ from any bluffline (where adjoining slopes exceed 25%)
The principal structure may not exceed 35’ in height, and no accessory may exceed 20’ tall.
2. The currently illegal accessory structure, even after being moved, may not contain living quarters. If any
habitable area exists within the structure, it must be removed or it will cause a violation (having two
habitable dwellings on a single parcel). This permit will be revoked if such instance occurs.
3. Erosion control must be implemented according to the standards outlined in SCC 17.30(K)(2) for all filling
and grading activities.
a. No slopes in excess of 25% may be disturbed, per SCC 17.12(10).

b. All disturbed areas on the site must be immediately planted with native vegetation, as soon as
permissible in the building sequence. If planting immediately is not feasible and soils will remain
bare for more than one week, they shall be covered with erosion control blankets or a suitable means
of erosion control per accepted standards.
c. There must be additional erosion control measures installed on the 20-25% slopes approximately
150’ straight south of the proposed garage, from the existing silt fence west of the driveway to the
west property line. Also, it must be added along the driveway on the east side, for approximately the
first 300’ after it splits from the other shared driveway.
4. Before any ground disturbance takes place, the applicant or designated agent shall contact this department
for an onsite verification of proper erosion control measures (described in the plans provided). The erosion
control measures must be in place at the time this department is contacted for an onsite. All erosion control
shall be maintained to prevent sediment from leaving the property, and must be inspected/maintaine d per
the plans provided. If deviations are going to occur from the plans, it must be approved by this department.
5. Erosion control measures shall not be removed until sufficient vegetative cover has been established on the
site (approx. 70% re-vegetated), and this department gives permission for its removal.
6. Impervious surfaces proposed are well under 15%, and no mitigation is required per WI Admin. Code NR
115 unless it exceeds 15%.
7. If the location of any proposed structures are altered or revised from the plans included in this approval,
this department shall be given written documentation accompanied by plans which show the desired location
of the structure. Written approval must be obtained before any deviation from this approval occurs.
This permit is valid for one year, with the possibility of up to two (2) six month extensions. If extensions are
required, contact this department for details.
IT IS THE APPLICANTS/AGENTS RESPONSIBILITY TO ARRANGE INSPECTIONS. FAILURE TO DO
SO MAY RESULT IN A CITATION. At the time an inspection is desired, the Community Development
Department shall be given at minimum 2 full business days’ notice to ensure the a meeting time can be arranged
with a staff member.
This approval does not allow for any additional construction, structures or structural changes, grading,
filling, or clearing of vegetation beyond the limits of this request. Your information will remain on file in
the St. Croix County Community Development Department. It is your responsibility to ensure compliance
with any other local, state, or federal rules or regulations, including contacting the local Town to see if they
require any additional permits.
