The amendments to the permit have been conditionally approved as explained below, and the cease work order can be considered removed, so long as the conditions are followed. FACTS & BACKGROUND: 1. The property (± 1 ac.) is located in the Town of Troy, within the Lower St. Croix Riverway Overlay District. 2. There is no proposed filling/grading within 40’ of a slope preservation zone. [SCC 17.36 (H)(5)(a)(2)] 3. Any new structure (garage) requires the stormwater to be infiltrated per the SCC 17.36 (H)(7)(a)(2), with an affidavit stipulating the operation and maintenance to be recorded at the St. Croix County Register of Deeds. 4. The original plans indicated that only a new roof was going to be installed on the non-conforming principal structure, which was determined not to require mitigation.  However, when passing the site staff observed the scope of the project had expanded to include the substantial replacement of the structural members (constituting “reconstruction” of the non- conforming structure), which does require mitigation meeting the standards of SCC 17.36 (I)(5). 5. To meet the mitigation requirements, the plans include constructing of 2 rain gardens to serve part of the principal structure and the new accessory structure. The remainder of the principal structure will be served by a 1000 gallon holding tank that is connected to an irrigation system in the front yard. 6. The requirement to screen the structure per SCC 17.36 (I)(5)(c)(1), must be proven within 6 months of the structure being completed. This means the entire structure must be made visually inconspicuous. 7. The footprint of the principal structure will not change, the structure is going to be no taller than the existing, and the structures foundation is not being altered in any way. 8. The POWTS system is code compliant, but may require a reconnect permit if the forcemain is going to be moved for the accessory structure to be constructed. 9. The structure is located in the Town of Troy, so the County general zoning provision requiring 10’ between structures is not applicable. BASED ON THE FINDINGS, THE LAND USE PERMIT IS SUBJECT TO THE FOLLOWING CONDITIONS: 1. All conditions from the previous permit approval must be followed, unless there is a requirement in this approval that contradicts the previous approval. In that situation, the most restrictive shall apply. 2. The accessory structure must be at least 40’ from any slope preservation zone and meet all requirements of SCC Ordinance and as mentioned above. 3. The proposed accessory structure and reconstructed non-conforming principal structure must be visually inconspicuous or made so within 1 year of project completion, per St. Croix County Ordinance, by maintaining or planting vegetation as is necessary. All stormwater from structures must be conveyed to an infiltration area; via gutters, grassed swales, rock trenches, etc. This does not include the portion of the principal structure that was attached garage, which will be conveyed to the holding tank. This is emptied by a pump connected to an irrigation system in the front yard. 5. All stormwater management devices must be constructed and maintained as outlined in the plans submitted. An affidavit must be recorded at the St. Croix County Register of Deeds within 14 days of this approval, which stipulates this maintenance be carried out in perpetuity. 6. There must be native vegetation maintained in the infiltration device at all times, and any debris or litter must be removed to perpetuate the proper infiltration of stormwater. 7. Contact this department for inspection of the holding tank after it is installed & BEFORE it is backfilled. 8. All erosion control and grading must follow the “Notes” on the plot plan drawing and SCC Ordinan ce requirements. 9. Before any construction begins, the applicant or agent shall contact this department for an onsite verification of proper erosion control measures. These erosion control measures shall not be removed until sufficient vegetative cover has been established on the site, and this department gives permission for its removal. 10. Immediately following final grading, vegetative cover shall be planted or seeded in all disturbed areas. Any vegetation planted/seeded must be native to the St. Croix River area. 11. No removal of erosion control measures shall be done unless it is authorized by the Community Development Department. Contact this department for onsite verification after disturbed areas are revegetated. 12. After construction is completed, you must provide St. Croix County with an after-the-fact survey grade drawing, depicting the location the accessory structure is located, to ensure it is properly sited per the plans that it was approved contingently upon. Photo documentation of the principal structure from the midline of the St. Croix River must also be provided, to ensure that it is visually conspicuous or at that time it may be ordered to be rendered so, as the approval of this permit is dependent upon it. This permit is valid for one year from the date of original issuance, with the possibility of up to two (2) six month extensions if the applicant submits a permit extension fee and documentation if required. IT IS THE APPLICANTS/AGENTS RESPONSIBILITY TO ARRANGE INSPECTIONS. In this situation, there must be at minimum 3 inspections, at the times mentioned above. This approval does not allow for any additional construction, structures or structural changes, grading, filling, clearing of vegetation, or uses beyond the limits of this request. Your information will remain on file in the St. Croix County Community Development Department. It is your responsibility to ensure compliance with any other local, state, or federal rules or regulations, including contacting the Town, to inquire if they require any permits.
