Re: Erosion Control Plan, Lot #9 of Salishan Subdivision

I have reviewed the revised erosion control plan for Lot # 9 of the Salishan Subdivision. I
was also onsite with Bruce Lenzen on May 13, 1999 to get better acquainted with the
entire layout. The erosion control plan submitted to me is satisfactory for this site . The
only comment I would make is that the rock fill basin shall be constructed on the south
side of the setback line and proposed silt fence and that all exposed areas shall be seeded
and mulched immediately after construction.
I would recommend that a sanitation permit could be issued for Lot # 9.

continues for a period of 30 days following written notice thereof by Vendor (dehvered personally or mailed by certified mail); then the entire
outstanding balance under this contract shall become immediately due and payah'_ in Fill, at Vendor's option an, without notice (which Purchaser

Property if Purchaser fails to redeem); or (ii) VenJur may sue for specific performance of this Contract to compel immediate and full payment on
the entire outstanding balance, with Interest thereon at the rate in effect on the date of default and other amounts due hereunder, in which event
the Property shall be auctioned at judicial sale and Purchaser shall be liable for any eficiency; or (iii) Vendor may sue at law for the entire unpaid z
purchase price or any portion thereof, or (iv) Vendor may declare this Contract at an end and remove this Contract as a cloud on title in a quiet -
title action if the equitable interest of Purchaser is insignificant; and (v) Vendor may have Purchaser ejected from possession of the Property and
have a receiver appointed to collect any rents, issues or profi during the per -deny of any action under (t), (u) or (n•) above Not\%iths ending
any oral or written statements or actions of Vendor, an election of any of the foregoing remedies shall only be binding upon Vendor if and when
pursued in litigation and all costs and expenses including reasonable attorneys fees of Vendor incurred to enforce any remedy hereunder (whether
abated or not) to the extent not prohibited by law and expenses of title evidence shall be added to pr icipal and paid by Purchaser, as incurred,
and shall be included in any judgment.
Upon the commencement or during the pendency of any action of foreclosure of this Contract, Purchaser consents to the appointment to
a receiver of the Property, including homestead interest, to collect the rents, issues, and prof - s of the Property during the pendency of such action fandsuchrents, issues, and profits when so collected shall he held and applied as the court shall direct.
Purchaser shall not transfer, sell or convey any legal or equitable interest ;n the Property (by assignment of any of Purchaser's rights under
this Contract or by option, long -teen lease or to any other way) without the pnor wrttten consent of Vendor unless either the outstanding balance
payable under this Contract is first paid in full or the interest conveyed is a pledge or assignment of Purchaser's interest under this Contract solely
as security for an indebtedness of Purchaser. In the event of any such transfer, sale or conveyance without Vendor's written consent, the entire
outstanding balance payable under this Contract shall become immediately due And payable in full, at Vendors option without notice.
Vendor shall make a!1 payments when due under any mortgage ouistandir.y, aZ311 the Property on the date of this Contract (except for any
mortgage granted by Purchaser) or under any note secured thereby, provided Purchaser makes tamely payment of the amoura then due under this

considered payments made on this Contract
Vendor may waive any default without waiving other subsequent or prior default of Purchase

AITACHMENT A

Additional Prw to Land Contract between Bruce G. I_enzen Homes, Inc., Vendor, and
Robb Neuenschwander and Laura Neuenschwander, Purchasers, are as follows:
1. The only contractor allowed to construct any improvement on the property is Bruce
Lenzen Homes, Inc., Hudson, Wisconsin.
2.If the Carpenter Nature Center, or it's representative, is able to purchase the pond
property adjacent to the Plat of Salishan, in the Town of Troy, St. Croix County,
Wisconsin, Purchasers herein shall make a $4,000.00 donation within thirty (30) days
of the closing of the purchase of the pond property by the Carpenter Nature Center.
3. If Purchasers herein have not signed a design and construction contract with Vendor,
for the construction of improvements on the property described here by May I, 1999,
Vendor can then purchase the property back from the Purchasers by paying the
Purchasers all principal paid, plus the $4,000.00 donation if made by the Purchasers.
This shall be done within sixty (60) days of May 1, 1999. Vendor will not have to pay
to Purchasers any interest paid by Purchasers from date hereof to date of repurchasing
the property. Provided, however, the conveyance by Purchasers under the terns of
this paragraph shall be free and clear of any liens or encumbrances created by acts cr
defaults of Purchasers, and Purchasers shall be responsible for removing such liens or
encumbrances.sue ins
4.If Vendor herein has other land available for sale than the

purchase price herein, Purchasers may notify Vender herein of their desire to purchase
the other land and can then deed their interest in the property described herein back to
Vendor and will receive a credit towards the purchase of the new land for the amount
of principal paid hereunder. Provided, however, the conveyance by Purchasers under
the terms of this paragraph shall be free and clear of any liens or encumbrances created
by acts or defaults of Purchasers, and Purchasers shall be responsible for removing
such liens or encumbrances.
5.If Purchasers have not entered into a design and construction contract with the Vendor
herein by May 1, 1999, Purchasers may elect to cancel this contract within thirty (30)
days of May 1, 1999. The cancellation shall be made in writing and deli%ered to
Vendor at Vendor's place of business. Vendor shall then have six (6) months from
date of receipt of the notice to pay back to Purchasers the amount of principal
Purchasers have paid from date hereof until date of such notice, 1 c I zr 7
