Jenny and I went out and measured the elevations of the small structure and the house on the
Haase property on May 27, 2005. We determined that both of the structures are located below
the OHWM. In light of this information, we will not be pursuing this matter at this time. I will be
contacting Mr. Haase later this week to let him know that you will be working with him to resolve
this matter. Please let me know if I can be of any assistance. Thanks Eunice!

Jenny,
Has Mr. Haase received approval and a building permit to do work on his property? Apparently,
he had about a half dozen carpenters working on the smaller cabin structure on Saturday. There
was a message on my machine from a lake resident wondering what was going on. Siding was
replaced and all new windows and doors were installed. I took a couple of photos but it wasn't
until the work was completed. We certainly need to be consistent in our application of the rules.
It wouldn't be fair to tell the Hirsch family that they need a building permit and must move their
spa structure and then allow Haase to do whatever he wishes. If he has acted without
permission something should be done about it. Please let me know what you know and what will
be done. Thank you.

Thanks for the update. Would you mind sending me a copy of your survey? Also, would you
please send copies of any complaints you have received about this property?
I sent an email to DNR legal staff and to Dan Bauman advising that the Haase house has now
been documented as being below the ohwm. I also explained that this house is not Haase's
principal residence and has been condemned.As far as I know, there is no language in the
statutes that provides for a residential structure to be located on lakebed---but there have been
several changes to the statutes and legal will advise me about that. I need the survey and your
field notes to document the structure's location. As soon as I learn anything about how dnr
intends to proceed, I will let you know.

Thank you very much for your voicemail message telling me you received my letter and providing
your email address to respond. I wholly agree with you that coordination is much easier with
email.
I am sending this response to my supervisor, Dan Helsel, as well as Rod Eslinger and Dwight
Farnham so that you will have their email addresses as well as you suggested.
To answer your question asking if the ordinary high water mark (ohwm) of Bass Lake is changed.
Not yet, the findings of the Department and the public comments received at the December
1 meeting are still be reviewed. When the final decision is made, I will be sure to provide you with
a copy of the decision document.
You also asked if shoreland and floodplain zoning are handled by the Department.
Administration of both shoreland and floodplain zoning are handled by St Croix County. If
you have questions about the provisions of the county's ordinances, you will need to contact Rod
Eslinger. Rod's phone number is 715-386-4680.
If you have other questions that I might be able to help you with, just let me know.

The DNR has declared a new Ordinary High Water Mark (OHWM) for Bass Lake. In a
Declaratory Ruling dated April 10, 2004, the DNR declared the OWHM of Bass Lake at 886.90
MSL. The previous OHWM of Bass Lake was 888.3 MSL. I have a copy of the official ruling if
anyone would like a copy for their records please let me know.
