HomeMy WebLinkAbout038-1036-95-003 (2) February 24, 2017 File#: LUP-2017-002 John & Kathleen Fercello th 2198 100 Street Somerset, WI 54025 Re: Conditional Approval Land Use Permit Project Location: 08.31.18.158L-03, Town of Star Prairie Dear Mr. and Mrs. Fercello, Community Development Department staff have reviewed the Land Use Permit application for the construction of a new accessory structure (pole shed) within the Shoreland Overlay District, Chapter 17.30. The request has been conditionally approved based on the application submission and the following findings. Please see the enclosed site plan to reference the general erosion control and grading notes.  All setbacks have been met and the structure meets the 20-foot maximum height requirement for an accessory structure.  There is an existing retention pond onsite designed to treat 560 cubic feet of stormwater. The total Impervious Surface calculation is less than 15% due to ‘treated impervious surface’ per NR 115.05(1)(e)(3m), therefore mitigation is not required.  There will be less than 10,000 square feet of land disturbance on slopes 12-19.9% and within the Shoreland Overlay District.  Cabin Lane is a private road, therefore a road setback does not apply.  Erosion and sediment control plans have been provided that meet or exceed WDNR Technical Standards. Based on these findings, approval of LUP-2017-002 is subject to the following conditions: 1. A pre-construction inspection is required to verify erosion control installation and that the retention pond area retains runoff. It is the applicant’s responsibility to schedule this with Community Development Department staff. 2. Erosion control and seeding shall be installed according to the General Erosion Control Notes on the site plan prior to any land disturbance activities. St. Croix County reserves the right to require additional erosion control measures to be installed during construction if found necessary due to site-specific conditions. 3. If the retention pond has been removed or is not retaining runoff, this will be grounds for immediate permit revocation. 4. Phosphorus fertilizer shall not be used to establish and/or maintain vegetation, unless a soil test confirms phosphorous is needed. A post-construction inspection will be required prior to removing erosion control measures to determine the entire project site has reached a point of 70% permanent vegetative cover. It is the applicant/agent’s responsibility to schedule this with Community Development Department staff. 6. The applicant shall be responsible to secure any other required local, state or federal permit(s) and approval(s) prior to land disturbance activity. 7. Failure to comply with the terms or conditions above may result in the revocation of this permit by the Zoning Administrator according to Chapter 17.30 (13). This approval is subject to the conditions listed above; it does not allow for any additional construction, structures, grading, paving, filling or clearing of vegetation beyond the limits of this request. Your information will remain on file at the St. Croix County Community Development Department suite. It is your responsibility to ensure compliance with any other local, state, or federal permitting or regulations, including contacting the Town of Star Prairie and the Wisconsin Department of Natural Resources to inquire if additional permissions are required. This permit is valid for one year, with the possibility of up to two (2) six month extensions if the applicant submits the appropriate permit extension fee and documentation to the Zoning Administrator.
