RESOLUTION REGARDING THE TRANSFER OF
JURISDICTION OVER 17-YEAR-OLD OFFENDERS OR A
PORTION OF 17-YEAR-OLD OFFENDERS BACK TO
JUVENILE COURT
1 WHEREAS, Wisconsin state statutes require county governments to operate and fund
2 the juvenile justice system; and
3
4 WHEREAS,prior to January 1, 1996, 17-year-old offenders were treated as juveniles;
5 and
6
7 WHEREAS, Under 1995 Wisconsin Act 27, 17-year-old offenders were to be treated as
8 adults; and
9
10 WHEREAS, discussion over transferring all 17-year-old offenders, or a portion of 17-
11 year-old offenders, such as first time non-violent offenders, back to juvenile court has occurred
12 and legislation has been proposed, but no action has taken place, be it for public policy
13 differences of opinion or due to no resolution on how this transfer would be funded; and

15 WHEREAS, St. Croix County representatives from the District Attorney's Office,
16 Probation and Parole, Health and Human Services, and the Community Justice Collaborating
17 Council recently met and will be conducting a review of current practice along with fiscal
18 impacts related to 17-year-old offenders; and
19
20 WHEREAS, the Legislative Audit Bureau, State of Wisconsin conducted a review of 17-
21 year-old offenders in the adult criminal justice system in February of 2008; and
22
23 WHEREAS, the Legislative Audit Bureau report highlights concluded with several
24 options for the legislature to consider:
25 • Retaining criminal court jurisdiction over 17-year-old.
26 • Changing the age of criminal court jurisdiction to 18, and thus return jurisdiction of 17-
27 year-old to the juvenile court.
28 • Consider incremental changes, such as retaining criminal court jurisdiction for 17-year-
29 old felony offenders or expanding programs that allow juvenile offenders to remain under
30 supervision for a longer period of time.
31 • Delay implementation of any change, to allow the Department of Corrections, the courts
32 and the counties time to prepare for programmatic and fiscal effects.

34 THEREFORE BE IT RESOLVED, that the St. Croix County Board of Supervisors
35 urges the state legislature to develop a coordinated effort to address the programmatic and fiscal
36 effects regarding the transfer of jurisdiction over 17-year-old offenders, or a portion of 17-year-
37 old offenders, such as first time non-violent offenders, back to juvenile court that involves
38 stakeholders identified in the 2008 Legislative Audit Bureau report, along with other necessary
39 stakeholders, such as the Wisconsin Department of Children and Families, or others stakeholders
40 as determined by the state legislature.

42 FURTHER, BE IT RESOLVED, that the St. Croix County Board of Supervisors directs
43 the County Clerk to forward this resolution to the Office of the Governor, St. Croix County
44 Legislators, Wisconsin Counties Association, and Wisconsin Department of Children and
45 Families.
