RE: Land Use Permit - Replacement of Principal Structure in Lower St. Croix Riverway District

Jeff & Kris,
Community Development Staff have reviewed your Land Use Permit application for the replacement of principal
structure and demolition of existing structures, in the Lower St. Croix Riverway Overlay District, and
conditionally approved the request as explained below. Please note the following facts/findings, and how they
relate to the conditions listed:
FACTS & BACKGROUND INFORMATION:
1. The conditionally permitted structure is proposed in the Town of Somerset, in the Lower St. Croix Riverway
Overlay District.
2. The site plans provided show the proposed structures beyond the 200' required building setback from the
OHWM.
3. The proposed structures and corresponding land disturbance will be outside the 40' setback from the slope
preservation zone. Several structures within the slope preservation zone or 40' setback will be removed, to
make the entire property much more conforming to the Lower St. Croix Riverway Overlay District.
4. The proposed structure meets or exceeds the 25' sideyard setback from the property lines on both sides (25'
on East side & over 150' on West side).
5. Erosion control and stormwater measures per SCC 17.36(H)(7) are required because of the land disturbance
for the structures to be removed as well as new structures, and installation of a POWTS.
Based on these findings, approval of the land use permit is subject to the following conditions:
1. Due to the ground disturbance that will occur, erosion control measures must be put in place prior to any
land disturbance, in a manner that is suitable to capture any sediment or run-off before it leaves the site to
f~eigbboring properties or to the waterbody. Before any construction begins, the applicant or agent shall

measures shall not be removed until sufficient cover has been established on the site (approximately 70%
vegetative cover), and this department gives permission for its removal.
2. All disturbed areas on the site must be immediately planted with native vegetation as soon as permissible in
the building sequence, and/or the soils must be covered with some type of erosion control blanket/mulch such
as excelsior blanket or hydro-mulching.
3. There shall be no disturbance within 200' of the OHWM, except for removal of existing structures and for
rain garden construction, which will be immediately be revegetated with native species.
4. There shall be no land disturbance within the 40' setback of the slope preservation zone, except for the
removal of existing structures. All disturbances must be immediately stabilized and native vegetation must be
established. All machinery and spoil piles must be kept out of these areas as well.
' S. All stormwater (an estimated 500 ft3) must be infiltrated at the site. the proposed rock trench (5' wide by 6"
deep - 380 ft) along the NE & SE sides of the structure and the rain garden proposed off the NE corner of

the house (~z 620 ft2 and 6" deep) must be designed and maintained in a manner that allows the perpetual
infiltration of water. Soil compaction in all infiltration areas must be avoided at all costs.
6. If the existing driveway is to be altered (location or surface type), the stormwater must be accounted for
that will be shed by the impervious surface. A swale is the most appropriate type of treatment device, with the
property line being very near to the driveway location. A plan must also be submitted to this department for
tertiary review.
A document must be recorded within 14 days from the date of this letter, wherein the owner agrees maintain the stormwater infiltration devices in perpetuity so long as the structures
permitted by this land use

St. Croix County must inspect the construction of the rain garden after it is completed, to ensures it meets
the requirements specified in the plans, which shall take place no more than 60 days after the completion of
the finish grading.
All trees removed for construction must be replaced (according to the replacement schedule found in SCC
Chapter 17.36 H), by the end of 2016. The trees verified during the onsite inspection on 12-18-16 with staff
should not impact the view from the river by making the structures more visually conspicuous, so long as they
are replaced with the appropriate number of 2" diameter saplings. Quite a few shall be placed between the
structure and the OHWM, with several being placed where the existing dwelling now sits to ensure slope
stabilization.
10. A list of the trees (number and species) shall be provided to St. Croix County CDD before they are planted,
along with a general map that shows the placement of the saplings. At least a few different species must be
planted, as there are a few different types being removed.
This permit is valid for one year, with the possibility of up to two (2) six month extensions if the applicant submits
a permit extension fee and documentation.
IT IS THE APPLICANTS/AGENTS RESPONSIBILITY TO ARRANGE INSPECTIONS. This shall be
done at t following times:
After erosion control measures are in place at the site of the new construction area, as no site work can
/begin until this department approves the erosion control measures.
O After erosion control measures are in place, but before land disturbance is started in conjunction with the
POWTS.
• Before any erosion control measures are removed and all disturbed areas on the site have had vegetation
established to the satisfaction of this department (approximately 70% cover).
• After the construction of the rain garden and rock trenches are finished.
• Before the erosion control is removed around the rain garden and/or rock trenches.
1" After tree saplings have been planted, for staff to ensure the proper number have been installed.
This approval does not allow for any additional construction, structures or structural changes, grading,
filling, or clearing of vegetation beyond the limits of this request. Your information will remain on file in
the St. Croix County Community Development Department. It is your responsibility to ensure compliance
with any other local, state, or federal rules or regulations, including contacting the Town of Somerset to
ask if they require any permits.

1. Infiltrate 500 cubic feet of water or 1000 sqft at 6" of depth per calculations attached
a. Equipment compaction will be kept to a minimum by creating "no travel" areas
2. Maintenance of 5' wide 6" deep rock trench (380 sqft)
a. Rock trench will be kept weed free and clean with annual maintenance and
constructed per plan attached. Pipes to rain garden to be maintained free from
blockage.
b. Any plantings in rock trench or other areas to be native plantings
3. Construction and maintenance of 620 sqft rain garden
a. The rain garden will be approximately 35 from the home and located in an area
as flat as possible per attached site plan. Storm water from the rock trench and
south / west side of home will be piped to the rain garden via 6" perforated
drain tile pipe.
b. The rain garden will have a raised berm on the downhill side to create a level
raingarden that is effectively 6" deep throughout
c. The rain garden will contain wood mulch with plantings consisting of Blackeyed
Susan and Cone Flower
d. The rain garden will be maintained weed free and clean of any soil deposits on
an as needed basis. The rain garden mulch will be replaced as needed or on a bi-
annual basis.
Erosion and sediment control plan and timeline:
1. Total area excavated is approximately 11,250 sqft per attached calculations
2. Timeline
a. Jan 5th 2016: Install silt fencing per site plan attached. The silt fence closest to
the new home will be placed at 190' from the high water mark to give workers a
10' buffer zone for walking / work. All other areas outside this buffer will be
preserved from compaction.
b. Jan 10th: Demo old house, old garage, kennel, shed. Approximately 2400 sqft.
c. Feb 1: Excavate home. Approximately 4600 sqft total.
d. April 151h: All demolition areas shall be finish graded with tracked skid steer and
seeded with nodding fescue (no fertilizer) and covered with erosion control
blankets (100% coverage of disturbed areas). This will happen April 15th or as
soon as possible as weather allows.
e. June 1th: County zoning inspector to inspect vegetation in areas listed in 2.d
above.

f. July 151h: Excavate septic and mound area. Approximately 4250 sqft total. Seed
immediately with nodding fescue. No fertilizer.
g. August 15th: Counting zoning inspector to inspect vegetation in septic and
mound area.
h. August 15th. Begin excavation of rock trench / final grade / rain garden. Pipe
water from south side of home to rain garden. Pipe water from rock trench to
rain garden. Owner to plant 67 trees to replace trees removed in demolition
process per worksheet attached.
i. August 25th: County zoning inspector to inspect construction of 2.h above
j. September 151h: Owner to take on ownership and maintenance schedules for
storm water management features

GENERAL APPLICATION REQUIiMENTS
APPLICATION:
Applications will not be accepted until the applicant has:
• Met with the Zoning Administrator to review the application;
• Submitted Oriainal plus 2 conies of the entire packet including all supporting information, maps & diagrams;
• Resolved any land use violations and paid any outstanding fees owed to the Community Development Department;
• Signed the application form (the signatures of the property owners and agents acting on their behalf are required); and
• Submitted the appropriate application fee (nonrefundable) payable to: St. Croix County.
REVIEW:
The Zoning Administrator will review the application for completeness and assign a file number to the application. The Zoning
Administrator may require additional information and will notify the applicant of this within 10 days. Upon receiving a complete
application and supporting documents, the Zoning Administrator will:
• send copies of the applications to the appropriate reviewing agencies for comment. Applicants are encouraged to contact
their town to discuss their application and inquire about necessary building permits and approvals at the town level;
• schedule a site visit to the applicant's property, at which time the applicant shall flag all applicable property/project corners
and label the flags accordingly; and
• review the file and prepare findings for approval or denial of the permit within 60 days. Upon approval, the permit will be
mailed to the applicant or to the applicant's agent.
If approved, the land use permit will be valid for one year from the date of the permit issuance. The applicant may also be required
to apply through the Town for a local building permit. All site plans, pictures, and other materials submitted with the application
become the property of the Community Development Department and will remain in the file.

CHECKLIST FOR COMPLETE APPLICATION

• project location in the town;
• lot/parcel dimensions with total lot area, property lines, and all applicable setbacks;
• location of existing access roads, right-of-way, road setbacks, and recorded easements;
• location of all existing and proposed structures with their square footage and distance from setbacks;
• location of existing and proposed POWTS, wells, driveways, parking areas, access, signs, and other features;
• location of slopes 12% and greater (minimum contours to be determined by the Zoning Administrator);
• all blufflines and slope preservation zones (Riverway) and setbacks from blufflines;
• location of the OHWM of any abutting navigable waterways and all setbacks from the OHWM;
• location and landward limit of all wetlands, specifications and dimensions for areas of proposed wetland alteration;
• existing and proposed topographic and drainage features and vegetative cover;
• location of floodplain and floodway limits on the property; and
• any other unique limiting conditions of the property or information deemed necessary by the Zoning Administrator.
For projects that involve land disturbance requests, the following additional information may be required:
❑ Detailed drawings (scale should not be greater than 1 inch to 200 feet).
❑ Grading plan showing grading limits and pre and post contours.
❑ Project schedule and contractor list.
❑ Erosion control plan (Best Management Practices).
❑ Storm water management plan stamped by an engineer and including all runoff calculations.
❑ Vegetation plan including schedule, seeding rates, and species size, type and location.
❑ Other documents:
NOTE: All maps, plans, and engineering data shall be no larger than 11x17. No covers, binders, or
envelopes. Staple or paperclip your application in the upper left-hand corner.
