WHEREAS_; Wisconsin: Statutes Section 60.74 et seq. provides a
procedure for a Town Board to recommend that zoning districts be
changed within its. Township with the final approval being by the
county 'Board' in counties having a Zoning Ordinance, and
WHEREAS, the Town Board of the Township of Troy held various
public, meetings concerning a' proposed changefrom agricultural__
residential zoning to agricultural zoning for the entire Township,,
with certain exceptions;, and.
WHEREAS, the Town Board for the Township of Troy met during
December of 1982 and approved by a vote of Ito for, that the
Township be rezoned from agricultural-residential to agricultural,, )
with certain< exceptions' as are more particularly set forth on the
official Township of Troy Zoning Map, and
WHEREAS, the St. Croix County Comprehensive Zoning, Parks and;
Planning Committee received an official letter from the Township of
Troy indicating such recommendation for rezoning, and met on l
,December 21,; 1982, and approved of such recommendation by a to
vote.
NOW THEREFORE, BE IT ORDAINED by the St. Croix County Board of
Supervisors, meeting in regular session', that the action taken by the
Town Board of the Township of Troy and the recommendation by the
St. Croix County Comprehensive Zonings' Parlcs and )Manning Committee
are hereby approved as follows:
1} The Town of Troy is: hereby rezoned from agricultural-
residential district to agricultural district as more particularly
set forth in the-St. ',Croix County-Zoning Ordinance Section 2.41 i,XCEPT"
those areas 'excluded from the agricultural district on ,the official
Township of Troy Zoning Map, which is incorporated by reference as'
more particularly set forth in said Zoning Map which is filed, with
the St. Croix County Zoning Administrator , with a copy :being ''retained
by the; St. Croix County Clerk.
2; Parcels may be rezoned from the Township ofrq,j agri-
cultural district to any of the other zoning districts as more
particularly set forth in the St.' Croix County Zoning Ordinance if
the parcels meet any ayj allofthe criteria set forth in Attachment
A to this Ordinance, which is hereby incorporatedby reference.
This Ordinance shall take effect upon proper passage and
publication according to Wisconsin law.

TOWN OF TROY
Policies
1. The uses of land permitted in the agriculture preservation district
will be primarily limited toagriculturalproduction and dwelling
units which serve as places of residence for the owners and
employees of the farm. No land division of less than 35 acres
will be permitted unless it conforms to the following policies
for rezoning.
2. No non-farm residential development on soils classified as prime
farmland* or farmland of statewide importance.
^3. Non-farm residential development is restricted to one lot per
35 acres within a farm unit, with a minimum lot size of two acres.
Land must be rezoned from agriculture.
4. Allows for the separation and retention of one lot for anew
residence for the farm operator when he or she sells the whole
farm.
5. Mineralextraction operation requires a :conditional use :permit
and may be permitted provided that they meet all the policies.
and standards of the Town with regard to road usage, are: com-
patible with surrounding land uses, and .meet county reclamation
requirements.
6. Existing parcels of less than 35 acres within, the agricultural
preservation district shall be treated as non--conforming, properties
and may be "developed consistent with zoning prior to adoption '
of this plan:
7. Agencies and bodies responsible for the preparation of plans for
roadway corridors, powerlines,
public improvements, such as
pipelines, and sanitary landfills ;shall be requested to recognize
the agricultural land preservation goals of the Town.
$. Town ordinances that restrict noise, odors, keeping of animals,
or in any way limit normal farm operations shall riot apply in
the agricultural preservation district except the following:
New livestock operations involving more than 250 animal units
at one location must be reviewed and approved by the Town Board. ,
9. No special assessments for costs of public utilities can be
charged' against land owners in the agricultural preservation
district until property is rezoned for non-farm development.
*Prime farmland is soil identified as Class I, II, or III, as per:
USDA soil survey of St. Croix County, 1978 edition.

PROPOSED REZONING STANDARDS
Any land considered for rezoning shall meet the following criteria:
1 Land that has not had a history of economically viable farming
activity.
2. Land which is too small to be economically used for agricultural'
purposes or which is inaccessible to farm machinery needed to
produce agricultural products.
3. Land :with soils ,not classified as prune farmland** or farmland
of statewide importance (as shown on soil maps) .,
4. -Land=which, does'not disturb or =destroy any important natural
features, such as significant wood land areas, wet lands,
steep slopes, settling basins, etc .
5. And in addition to the above, land located such that conflict
with surrounding agricultural uses is minimal.
6. "' No roads or driveways shall be permitted to cross prime agricul
tural land to reach proposed non-farm development,
