Ordinance # '3
WHEREAS, the City;of Hudson presently has an ordinance entitled,
City of Hudson Mooring Ordinance, and
WHEREAS, said ordinance controls the mooring of boats along the
shore of Dike Road in the City of Hudson, and
WHEREAS, the City of Hudson has requested that St. Croix County pass
a similar ordinance so that law enforcement officials of the County could
assist in the enforcement within the boat mooring area,
NOW, THEREFORE, BE IT ORDAINED that the following Ordinance be and
is hereby adopted.
1) The boat mooring area shall be under the joint jurisdiction of the
Public Welfare Committee of the City of Hudson and the Law Enforcement Com-
mittee of the St. Croix County Board of Supervisors.
2) The boat mooring area shall be defined and described as that area
that is officially designated on the Official City of Hudson Park Map as the
boat mooring area, and shall be no more than 300 feet in width and 1300 feet
along the shore of Dike Road.
3) The rules of operation within the boat mooring area are as follows:
a) The annual boat mooring season shall be between the dates of
April 15 to November 15 of each year.
b) Before mooring a boat within the boat mooring area, the owner
of each boat must first have been selected to receive a mooring
permit at the drawing held pursuant to paragraph 3(d), for that
particular boat mooring season.
c) Written,application for a mooring permit shall be made to the
Park Superintendent for the City of Hudson no later than March 1
of each year.
d) Drawings for available permits shall be conducted during the first
week of March of each year at a meeting held by the Park Superin-
tendent under guidelines established by the Public Welfare Committee
of the City of Hudson.
e) All boats must be removed from the water by November 15th of each
year or they shall be towed in and stored at the owner's expense.
f) A boat may not be left tied to the unloading dock longer than a
reasonable time for loading and unloading. I'
g) No liability will be assumed by St. Croix County, or the City of
Hudson for damage to boats or injury to owners,; operators or guests
caused by theft, failure of the mooring device system, vandalism,
accidents; storms, flood, fire or fireworks.
h) There shall be only one boat to a mooring.
i) The maximum number of boats in the boat mooring area shall not
exceed 50 boats.
j) No person holding an annual mooring permit shall profit in any
respect from the mooring permit by renting the boat mooring to any
other person or boat.

4) PENALTIES FOR VIOLATIONS.
a) Any person who shall violate any of the provisions of this
ordinance shall first be ordered to immediately remove his
or her boat from the boat mooring area by the law enforcement
officials from the City of Hudson or the St. Croix County
Sheriff's Office or by park personnel of the City of Hudson.
f b) Any person so ordered who refuses to obey such an order to
remove shall be guilty of a violation of this Ordinance.
c) Any person who persistently disobeys the rules of operation _
in the boat mooring area shall be guilty of a violation of
this Ordinance.
d) Any person who intentionally,-interferes with the activities
of other persons lawfully within the boat mooring area shall
be guilty of a violation of this ordinance.
e) Upon conviction of a violation of this ordinance, the person
so convicted shall be subject to a forfeiture not to exceed
$100 for a first offense. For a second conviction of a violation
of this Ordinance within a period of one year, the person so
convicted :shall be subject to a forfeiture not to exceed $200.
5) EXEMPTION FROM ORDINANCE. Whenever necessary for enforcement of
the provisions of this Ordinance, law enforcement officials or park per-
sonnel are not subject to this Ordinance.
6) This Ordinance shall take effect upon 'proper publication of the
same by the St. Croix County Clerk pursuant to Wisconsin Statutes Section
59.04(1).
