No person shall consume any intoxicating liquor or fermented malt beverage while in a vehicle parked on a public highway or in any public parking lot. Section 2. rr.�•t. No; erson' shall possessoror Permit to be possessed in any moving or parked vehicle under his control any open container of intoxicating liquor or fermented malt beverage. Section 3. � - Definitions. a. "fermented malt beverage" is any liquid capable of being used for beverage purposes made by the alcoholic fermentation of an infusion in potable water of barley malt and hops, with or without unmalted grains or degerminated grains or sugar containing one-half of one per cent of alcohol or more by volume. b. "intoxicating liquor" is all distilled or vinous liquors containing one-half of one per of alcohol or more by volume. C. "open container" is any device capable of holding or storing a liquid which does not possess an unbroken seal or permanently af- fixed cover. d. "public highway" has the meaning designated in Section N 340.01(22) of the Wisconsin Statutes. Section 4. Any person who shall violate any provision of this ordinance shall, upon conviction thereof, forfeit not more than $100 together with costs ofprosecution; and in default of payment of that sum, �! shall be imprisoned in the County Jail until said forfeiture and costs are paid, but not to exceed 30 days.
