HomeMy WebLinkAboutOrdinance 1978 (08) ORDINANCE AMENDMENT 41 1* WHEREAS petition number 77-15 was received by the St. Croix County Clerk on December 22, 1977, and was referred by the Clerk to the St. Croix County Comprehensive Planning, Zoning and Parks Committee which Committee held a public hearing on the matter January 16, 1978, preceeded by proper notice pursuant to Wisconsin Statutes; and WHEREAS the St. Croix County Comprehensive Planning, Zoning and Parks Committee recomended adoption of the Ordinance setforth below to carry out the intent of this petition. ORDAINED NOW, THEREFORE, BE IT AMMM by the St. Croix County Board of Supervisors that the following Ordinance be adopted: Amend Section 9.2.9 and 9.3.2(2) (b) of the St. Croix County Zoning Ordinance to provide that no building or sanitary permit may be issued unless the parcel has been legally created: 1. Amend Section 9.2.9 as follows: 9.2.9 Deputy Zoning Administrator There is hereby created the office of deputy zoning administrator. There shall be one.deputy zoning administrator for each town in St. Croix County. The Town Board of each town shall designate one town resident for this assignment. The county zoning administrator shall keep a current roster of deputies and shall generally oversee the activities of such deputies. Building permits for buildings and non-structural land uses which are not connected to a private sewerage disposal system may be issued by the deputy zoning administrator without referral to the county zoning administrator. The county zoning administrator shall however, be sent a copy of the application immediately a ter its receipt b the deputy. Permit applications or ui ings which require a private sewerage disposal system shall be sent by the deputy zoning administrator to the county zoning administrator. The county zoning administrator shall determine whether the application involves a parcel that was created in compliance with county ordinances and shall review the application against all applicable setback and sanitary regulations and shall make an inspection. Following such review and inspection, if the parcel is found to have been legally created and if all applicabie setbackand sanitary requirements are deemed to be satisfied, the county z9ning administrator shall issue a septic tank permit and shall give written approval to issuance of a building permit. Upon transmittal of such septic tank permit and the approved application back to the deputy zoning administrator, the deputy shall issue a building permit. Building permits issued without tompliance to this section shall have no legal effect. 2. Amend Section 9.3.2(2) (b) as follows: (b) Legal description of the property, volume and page of the records of the St. Croix County Register of Deeds at which is located the recorded e al description ot the parcel in the form of a plat or survey map, deed or similar instrument, and type o proposed use. �4 3. Section 9.3.2(3) (f) is renumbered to become Section 9.3.2(4) . 4. A new Section 9.3.2(5) is created to read: (5) Applications which are found by the county zoning administrator, on the basis of slope indications on the application sketch or on s the basis of observations made in the course of field inspection, , to involve slopes in excess of 12% shall be approved only if the proposed construction is in compliance with erosion control conditions set in the course of subdivision review under Section 5.7.8 and 5.7.9 of this ordinance or, in the case of properties not subject to such conditions, if the project is deemed not to threaten serious erosion or sedimentation problems. The administrator may attach reasonable erosion prevention conditions to a permit approved for issuance. 5. Section 9.3.2(3) (g) is renumbered to become section 9.3.2(2) (6) .
