WHEREAS, within the Agricultural District of the ST. CROIX COUNTY
ZONING ORDINANCE there are listed (at sec. 2.4.6(b)) several utility
and communications facilities which are potentially allowable in the
District as special exception uses; and
WHEREAS, the list in sec. 2.4.6(b) presently does not include
electrical power generating facilities, although transmission towers,
poles, lines, transformers, substations, relay stations and similar
equipment and facilities are listed; and
WHEREAS, the list also does not mention gas transmission
facilities, although gas substations are mentioned; and
WHEREAS, the terms of the Wisconsin Farmland Preservation Law
(specifically, sec. 91.75(4) as created by ch. 29, Laws of 1977 and as
amended by ch. 418, Laws of 1977) require that the category, of utility ---
special exception uses within the Agricultural district include electric
generating facilities designed for nominal operation at a capacity of less
than 12,000 kilowatts (kangen 4ac.iti.t.iez being state ,tegutated and exempt

Statuteb; and
WHEREAS, the samelaw requires that gas utility uses be more fully
covered by the ordinance; and
WHEREAS, compliance of the County's ordinance with the state law is
necessary in order that the ordinance be capable of certification for tax
credit purposes by the Wisconsin Agricultural Lands Preservation Board.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF ST.
CROIX COUNTY, WISCONSIN, that sec. 2.4.6(b) of the ST. CROIX COUNTY ZONING
ORDINANCE is .amended as follows:
2.4.6(b)
Electric generating facilities designed for nominal operation at °
a capacity of less than 12,000 kilowatts, telephone, telegraph and
power transmission towers, poles and lines, including transformers,
substations, relay stations, equipment housing, and other similar
necessary appurtenant facilities; natural gas transmission facilities
substations; radio and television stations and transmission towers
and microwave radio relay towers, provided that such facilities are
found to be necessary and to be located so as to avoid unreasonable
interference with agricultural operations.
This ordinance shall take effect upon publication of the same by the County
Clerk pursuant to Wisconsin Statutes 59.09(1) .
