RESCLV21ON AIDING COUN'il ZONING ORDINANCE -
-
HIGHWAY 'SETBACK
WHEREAS, Sections 8.4.2(a)(2) and 8.4.2(e) provide restrictions
upon access to property in St. Croix County, which restrictions are not
a part of St. Cro x County Planned Development for Land abutting Wisconsin

State Highway 35, and

WHEREAS said restrictions create a burden in excess of that which
St. Cro:i.x iounty requires to regulate said land usage; q
THEREFORE BE IT RESOLVED by the St. Croix County Board of
Supervisors in regular session that Sections 8.4.2(.)(2) and 8.4.2(.)
bp amer3ed to read as follows:
8.4.2(a)(2). Class A. Highways
The setback from Expressways shall be 190 feet frog the
CEN:'ERLINE OF A TWO LANE FACILITY OR 190 feet from the
cent.ea' of the median of a divided facility or 50 feet from
the:' right-of-*,day I !ie, whichever is greater. The setback for
existing Freeways shall be 50 feet from the righ',-of-way line.
These setbacks are also applicable to all officially mapped right;
of-T.aay for highway locations or where right-of-way nas been
purchase(3 for future highway locations.
This includes Interstate Highway 94 and Wisconsin State Highway
35 from 19"� to the junc-�;ion of Wisconsin State Highway 65,
except that Wisconsin State Highway 35 from I 94 to the Junction
of Wisconsin State Highway 65 shall be treated as a Class B Highway
for de rrr_ining permissible access driveways pursuant to Sec. 8.4.6.
8.4,2(e) Highways Generally
The setback distance from the centerline, at any point, for
the respective classes of `,ighways shall be as follows:
D Highways, setback distance 133 or 100 feet from the

-Class: C H ghways, setback distance 135 feet or 100 feet

-Class B H-giiways, setback distance 150 feet from center-
