CROIX COUNTY GOVERNMENT CENTER,HUDSON,WI November 28,2000 Present: Supervisors Ron Raymond, Gerald Larson,Linda Luckey,Art Jensen and Buck Malick. Staff Steve Fisher,Mary Jenkins,Debbie Zimmermann,Rod Eslinger,Fran Bleskacek,Dave Fodroczi, and Ellen Denzer. Others: Ron Johnson,Joe Granberg,Doug Zahler,Ed Flanum, Sean Bohan, William and Ann Findlay. Chair Raymond called the meeting to order at 9:06 a.m. Jensen moved, seconded by Luckey and carried, to adopt the agenda. The Wildwood Trail agenda item will be heard at approximately 11:00 a.m. The closed session will be at the end of the meeting. Minutes/Meeting Dates: Raymond said the next meeting is tomorrow evening for a rezoning hearing. A motion was made by Malick, second by Jensen and carried to approve the minutes from the September 26"', October 18'and October 25`'meetings. Malick moved, second by Larson and carried to approve the October 24'minutes with the elimination of the wording "from the home" on Certified Survey Map#13. Minor Subdivisions: See Attachment A Major Subdivisions: See Attachment B The Committee recessed from 10:10 a.m. to 10:25 a.m. Rezonings: Fisher reminded the committee that these two rezoning requests were heard on November 15th at the Ag Center in Baldwin and are before the committee today for a decision. Donald Keilen: Fisher updated the committee and went over original staff report. The committee tabled a decision until today. A motion was made by Larson, second by Jensen and carried to approve the request based on the following findings: 1. The Town of Stanton recommends approval of the request. 2. The Town and County confirmed that the request is compliant with 3. The request meets the guidance and intent of the County Plan. 4. The proposed parcel is non-tillable as it is heavily wooded. 5. There was no opposition to this request. Jon C. Trinko: Fisher updated the committee and went over the original staff report. The staff s opinion is that this request complies with the County Plan. Motion by Jensen, second by Raymond and carried to approve the request based on the following findings: 1. The Town of Eau Galle recommends approval of the request. 2. The Town and County confirmed that the request is compliant with §91.77. 3. The request meets the guidance and intent of the County Plan. 4. The proposed parcel contains an existing residential home within a woodland setting. 5. There was no opposition to this request. The rezoning requests will be forwarded to County Board with the recommendation to approve. William and Ann Findlay: Raymond gave an update on this request. At the last meeting, this 1 request was denied because a motion to approve failed on a 2-3 vote. The committee needs to make a motion to deny.Mr. Findlay went over new information, showing the committee maps of how they plan to develop the property. After discussion, a motion was made by Malick, seconded by Raymond and carried to table to the December 19'meeting. Staff is to report if there is a way to achieve this rezoning a few lots at a time. Rezonings Scheduled: These were scheduled: December 20th , 7:00 p.m.: Lentz(St. Joseph), J.T.B. Properties and Bjerstedt(both Troy) at the Government Center in Hudson. January 10"', 7:00 p.m.: Cook(Somerset) at the Ag Center in Baldwin. Bills,Invoices and Revenue Report: A motion to approve zoning bills of$10,777.26 and revenue of$67,390.50 for October was made by Larson, seconded by Raymond and carried. Violations/Citations: Fisher reviewed current enforcement status, of which the oldest were Gary Sukowatey, Loren Smeester, Robert Chamberlain and Clayton Juelffs. Ordinance Discussions: Road Setbacks: Fisher informed the Board that the St. Croix County unit of the Wisconsin Towns Association passed a resolution that the road setbacks in the ordinance are too restrictive, and want this looked into immediately. Fisher explained that this is being addressed in the new ordinance. Staff thinks setbacks should be based on the type of road the structure is on, e.g., a highway would be more restrictive than a town road. Fisher added that the Board of Adjustments is also in favor of these setbacks being reduced. Denzer agrees,but needs to focus on getting the main ordinance done. The Planning Department is trying for October, 2001 for the ordinance to be ready for review. Malick moved to send a letter to the Wisconsin Towns Association with the following points: 1. Acknowledge request and point out overall ordinance revision is in the works; 2. The WTA to let zoning and planning know what the proposed change is; 3. Give the WTA a definite month when the ordinance will be ready to review. The motion failed due to lack of a second. Raymond moved, seconded by Luckey and carried to send a letter to the WTA, copying all of the towns, that we recognize the request, and would like from the towns as to what they Y would like to see for setbacks. Floodplain ordinance: Eslinger handed out a proposed timeline for this ordinance. Corporation Counsel has reviewed the draft, and it is now with Gary LePak of the DNR. Eslinger will send a copy to Luckey and Malick for their review. The committee reviewed the timeline. The ordinance will be reviewed by the entire committee on December 19", and they will plan to hold a hearing on this ordinance on January 10"' at the Ag Center in Baldwin. The committee does not want to extend the moratorium. * Ordinance Timeline: Eslinger distributed a timeline put together by Zoning and Planning, as directed by the committee, on revising the zoning,nonconforming structures, direct farm marketing,tower, sanitary, conservation design, shoreland, floodplain and nonmetallic mining ordinances. The committee asked the staff to insert interim milestones and report. Comm-83 Septic Systems Ordinance: Eslinger said he does not see any of these new technologies being used now. They are expensive and builders have not asked to put them in. Bill Berndt,representing the Builders Association, is not aware of anyone wanting to use these 2 new technologies in the upcoming construction season. He does believe there may be interest in the near future. Malick moved, seconded by Raymond to have the staff draft a limited moratorium on Comm-83 to enact a temporary ordinance that will insure that the septic system technologies listed in section COMM 83.04-2, Wisconsin Administrative Code, are proven by experience under similar conditions to be safe on sites that have less than 24 inches of suitable soil or slopes greater than 12% or serve more than two residential dwelling units. Wildwood Trail: Kent Wynveen asked the committee for help on behalf of the Baldwin- Woodville Snowmobile Club. They have a problem getting access to the Wildwood Trail because Don Rodel has leased properties around the trail to bar access. Discussion followed. Municipal Plats: ShadLane in the SW 1/4 S25 T31N R19W, Village of Somerset. A motion to certify no objection was made by Malick, seconded by Luckey and carried. Third Addition to Hielkema's Dutch Heritage Village in the SE '/4 & SW 1/4 S36 T29N R17W, Village of Baldwin. A motion to certify no objection was made by Larson, seconded by Raymond and carried. Red Cedar Canyon First Addition in the NE 1/4& SE 1/4S32 T29N R19W, City of Hudson. A - motion to certify no objection was made by Larson, seconded by Malick and carried. Town of Hudson Ordinance Amendment: Fisher asked to table this change to the Town of Hudson's sign ordinance since the staff found some inconsistencies to discuss with the town. A motion to table was made by Larson, seconded by Luckey and carried. Other Business: A motion was made by Malick, seconded by Luckey and passed unanimously to close the meeting per Wis. Stats. 19.85(1)(c)Performance Evaluations of Public Employees.. Jensen left at noon. A motion to open the meeting was made by Raymond, seconded by Larson and passed unanimously. Committee Action: Motion by Larson, second by Malick to table. Motion carried. 2. Homestead First Addition—Final Owner: Sam Miller Location: Section 10 & 11, Town of Hudson, 15 lots totaling 43.35 acres. Staff Recommendation: Approval Committee Action: Motion by Larson, second by Malick to approve with condition that more specific language, approved by Staff, be placed on the plat where it now reads "access restriction". Motion carried. 3. Pheasant Hills First Addition—Final Owner: Ron and Dine Bonte Location: Section 16, Town of Hammond, 22 lots totaling 68.86 acres Staff Recommendation: Staff recommends tabling the request until requested revisions have been received Committee Action: Motion by Malick, second by Lucky to table the request and add language regarding drainage ways on the final map. Motion carried. 4. Richmond Hills—Final Owner: John and Roberta Carlson Location: Section 25, Town of Richmond, 44 lots totaling 113.52 acres Staff Recommendation: Conditional Approval: 1) Construction bids and financial guarantees equal to 120% of the construction bids must be submitted and approved for erosion control and road construction. Written estimates must accompany the guarantees; 2)No construction including earth moving is to take place prior to approval of the financial guarantees; 3) The County Highway Department and the Land and Water Conservation Dept. are to be notified 3 days prior to construction beginning. Committee Action: Motion by Larson, second by Malick to approve with conditions recommended by staff and an additional condition that language regarding drainage ways be placed on final map. Location: Section 3, Town of Somerset, 16 lots totaling 87.03 acres Staff Recommendation: Conditional Approval: 1)A Dedicated Road Easement Agreement must be completed; 2) Construction bids and financial guarantees equal to 120% of the construction bids must be submitted and approved for erosion control and road construction. Written estimates must accompany the guarantees; 2)No construction including earth moving is to take place prior to approval of the financial guarantees. A 7 construction waiver may be granted provided financial guarantees are approved; 3) The County Highway Department and the Land and Water Conservation Dept. are to be notified 3 days prior to construction beginning. Committee Action: Motion by Jensen, second by Malick to approve with conditions recommended by staff. 6. St. Croix National Estates North- Preliminary Owner: J.P. Golf Management Location: Section 7, Town of Somerset, 7 lots totaling 23 acres Staff Recommendation: Conditional Approval: 1)Financial guarantees equal to 120% of the construction bids must be submitted and approved for erosion control. Written estimates must accompany the guarantees; 2) The County Highway Department and the Land and Water Conservation Dept. are to be notified 3 days prior to construction beginning; 3)Final DOT approval must be obtained. Committee Action: Motion by Larson, second by Malick to approve with conditions recommended by staff. Motion carried. 7. Torey Pines—Preliminary Owner: Ames Investment,LLC Location: Section 36, Town of Richmond, 29 lots totaling 72.21 acres Staff Recommendation: Conditional Approval: 1) Construction bids and financial guarantees equal to 120% of the construction bids must be submitted and approved for erosion control and road construction. Written estimates must accompany the guarantees; 2)No construction including earth moving is to take place prior to approval of the financial guarantees.
