1) Arlen E. and Judith Luehmann to rezone approximately 20 acres of land
from Agriculture to Ag/Residential. Location: A 5 +/- acre parcel of land
located in part of the SE '/4 of the NE '/a of Section 2, T31 N-R18W, a 10
+/- acre parcel of land located in part of the NW '/4 of the NW '/ of
Section 1, T31 N-R18W, and a 5 +/- acre parcel of land located in part of
Government Lot 1 of Section 2, T31 N-R18W, all on the Town of Star
Prairie, St. Croix County, Wisconsin.
2) Elaine G. Boardman to rezone approximately 120 acres of land from
Agriculture to Ag/Residential. Location: A 40 +/- acre parcel of land
located in the NE '/4 of the SE '/, Section 11, T30N-R19W, a 40 +/- acre
parcel of land located in the NW '/4 of the SW '/4,Section 12,T30N-
R19W,and a 40 +/- acre parcel of land located in the SW '/4 of the SW '/4

St. Croix County Planning,Zoning and Parks Committee
October 25, 2000
St. Croix County Government Center,Hudson,Wisconsin
Committee members present: Supervisors Ron Raymond, Linda Luckey, Art Jensen, Gerald
Larson and Buck Malick. Staff present: Steve Fisher,Debbie Zimmermann
Chairman Raymond called the meeting to order at 7:00 p.m. A motion was made by Malick,
seconded by Jensen and passed, to adopt the agenda. A motion was made by Malick, seconded
by Larson and passed, to approve the minutes from the August 21 and September 12 meetings.
Raymond explained the hearing process. He stated that the Committee will hear testimony now
and make decisions at future meetings. Fisher read this notice of proposed rezonings into the
record:
1) Arlen E. and Judith Luehmann to rezone approximately 20 acres of land from
Agriculture to Ag/Residential. Location: A 5 +/-acre parcel of land located in part of the
SE 1/4 of the NE 1/4 of Section 2, T31N-Rl8W, a 10+/-acre parcel of land located in part of
the NW 1/4 of the NW 1/4 of Section 1,T31N-R18W, and a 5 +/- acre parcel of land located
in part of Government Lot 1 of Section 2,T31N-R18W, all in the Town of Star Prairie, St.
Croix County,Wisconsin.
2) Elaine G.Boardman to rezone approximately 120 acres of land from Agriculture to
Ag/Residential. Location: A 40+/-acre parcel of land located in the NE 1/4 of the SE 1/4,
Section 11, T30N-R19W, a 40+/-acre parcel of land located in the NW 1/4 of the SW
1/4,Section 12,T30N-R19W,and a 40+/- acre parcel of land located in the SW 1/4 of the SW
1/4 of Section 12,T30N-Rl9w, all in the Town of Somerset, St. Croix County,Wisconsin.
3) Continuation of William and Ann Findlay rezoning hearing of October 18, 2000.
Arlen and Judith Luehman. Ed Flanum,Northland Surveying, represented the Luehmans. He
explained the request, stating that the applicant would like to rezone 3 separated parcels of land,
for a total of 20 acres, creating 3 new lots. Flanum handed out a map showing the location of the
parcels. The Committee reviewed the map. It had previously viewed the sites.
Walt Schommer, who lives south of the south parcel on Huntington Drive, asked how many
residences would be on each parcel. Flanum stated there would be one. Schommer had no
objections when he heard that the net buildable area of that parcel was about 1.5 acres,
considering road setbacks.
Fisher stated that the Town of Star Prairie recommended approval of the request, as has the
Village of Star Prairie extraterritorial zoning committee. The staff memo comparing the request
with the County Development Management Plan indicates that they are consistent for the
northeast and south parcel because of their proximity to roads and other homes,but inconsistent
for the northwest parcel,which is more in the nature of a farm field. The Town of Star Prairie
does not have a land use plan. The Town's letter of 9/19 indicated that 91.77, Wis. Stats. had
been considered.
A motion was made by Malick, seconded by Luckey and passed, to table the request.
Elaine Boardman. Elaine Boardman is the owner of the property on 160th Avenue in New
Richmond. She will be selling 10 acres to her granddaughter. Due to the topography of the land,
there is very little area for developing. The land includes lakes,wetlands, floodplains, shoreland
and slopes of 12 to over 20 percent.
Fisher summarized the request, stating that the property is surrounded by Ag/Residential land.
The Town of Somerset approved the request. The request meets the Town of Somerset Plan. The
soils are predominantly III and IV. The Committee advised Mrs. Boardman and her
granddaughter that the natural features and the proximity to a wildlife area will cause limitations
for development and make ecological protections important.
A motion was made by Malick, seconded by Luckey and passed, to table.
William and Ann Findlay. Since the last meeting on the request, Mr. Findlay met with the staff
to discuss his request to rezone approximately 32.3 acres of land from Ag to Ag/Residential.
The staff's view has not changed, and they still have the same recommendation to the
Committee, which is to deny or modify the request. The staff believes that this would be an
incompatible land use, due to its close proximity and obvious visibility of the adjoining large
Doornick dairy farm buildings and fields. Other detailed information is found in the"staff
analysis and recommendation"report.
Mr. and Mrs. Findlay addressed the Committee, stating that there are other new homes close to
this dairy. They claimed to be over %2 mile from the buildings on the farm. A discussion was
held on the previous zoning history of the property and the attitudes of the Rush River officials
and neighbors.
The Committee expressed concern that this plan might not fit the County Development
Management Plan. The Town of Rush River does not have a Plan yet. The Committee asked the
Findlays to consider rezoning to Ag-II. Findlay responded that they do not see significant
benefit in rezoning to Ag-II. They have considered cluster development. They want to proceed
with rezoning to Ag/Residential, and they would like to develop some of the property within a
year. Their computations indicate that more than four lots,but less than 18 are economically
feasible.
There was extended,heated discussion. A motion was made by Raymond, seconded by Luckey
and passed, to close the hearing. The Committee asked the staff to research and analyze the
numerous claims in the long letters from Mr. Findlay. Malick moved to table without date.
There was no second.
A motion was made at 9:05 p.m. by Larsen, seconded by Malick and passed, to adjourn.
