Raymond explained the hearing process. Fisher read the notice into the record. Zoning Business 1) Richard Stout to rezone approximately 2+/- acres of land from Commercial to Ag/Residential. Location: A parcel of land located in the S 1/2 of the SW 1/4 , Section 5, T30N-R19W, Town of Somerset, St. Croix County, Wisconsin. 2) Gregory Boardman to rezone approximately 70+/- acres of land from Agriculture to Ag/Residential. Location: A parcel of land located in the NW 1/4 of the NW 1/4 and the SW %t of the NW 1/4, Section 13,T30N-R19W, Town of Somerset, St. Croix County, Wisconsin. Gregory Boardman Boardman told the Committee that he does not plan to have any extensive development on this property. He intends to develop a few building sites. The land is not good for farming. Fisher said that the Town of Somerset has approved this request. He went over the staff report and the planning report showing that the request complies with the County Plan. A discussion was held on the rugged land on the property. The Committee discussed the Town Plan. Raymond called for questions by Committee and the audience. Hearing none,the hearing was closed. A motion was made by Malick and seconded by Jensen to recommend to the County Board that the rezoning request be approved with the following recommendation: As the owners consider design elements,they should provide a permanently vegetated open space buffer with a minimum width of 75 feet around the wetlands and shorelands;protect the closed depressions; use best management practices, erosion and sediment control and stormwater management for the 12 to 20 percent slopes; protect the woodland habitat; and prevent development on the 20 percent or greater slopes. Also, in the event of further development,the owner will be required to provide further information and mapping regarding the environmental features at the site. Staff should meet with the owner to review information regarding development design options, which would not negatively impact the environmental features. Conservation site design should be encouraged. Based on the following findings: 1) The Town of Somerset supports the rezoning. 2) Rezoning of the parcel would have no adverse effect on surrounding landowners. 3) The land is in the rural planning area and is an appropriate use. 4) This parcel is not suitable land for Agricultural production. 5) The Town and County confirmed that the request is compliant with §91.77. The motion carried unanimously. Richard Stout Fisher went over the staff report and explained that this request is basically to correct an error on the zoning maps. The property in question is a small commercial parcel located in the Chabre subdivision that was not noticed until after the final plat was recorded. The Town of Somerset believes this needs to be corrected. The county has agreed to hold this hearing to make this an ag/residential piece of property. A motion was made by Jensen and seconded by Raymond to recommend to the County Board that the rezoning request be approved,based on the following findings: 1) The Town of Somerset supports the rezoning. 2) Rezoning of the parcel would have no adverse effect on surrounding lands. 3) The land is in the rural planning area and is an appropriate use. 4) This commercial parcel is within the Chabre subdivision and surrounded by ag/residential property that is used for residential purposes.
