CROIX COUNTY GOVERNMENT CENTER,HUDSON,WI September 26,2000 Present: Supervisors: Ron Raymond, Art Jensen, Gerald Larson,Linda Luckey and Buck Malick. Staff: Steve Fisher,Mary Jenkins,Debbie Zimmermann,Jon Sonnentag and Rod Eslinger. Others: Ron Johnson,Harvey Johnson,Ron Bonte,Dick Pearson and Stan Hensley. Chair Raymond called the meeting to order at 9:00 a.m. A motion to adopt the agenda was made by Luckey, seconded by Larson and carried. Minutes/Meeting Dates: Raymond said there is a meeting on budgets tomorrow. Anyone from the Committee interested in attending is welcome. The next meeting for this Committee is October 10. Minor Subdivisions: See Attachment A Major Subdivisions: See Attachment B The Committee recessed from 10:20 a.m. to 10:35 a.m. Bills,Invoices and Revenue Report: A motion to approve Zoning bills in the amount of $11,985.75 and revenue of$44,543.30 for August was made by Larson, seconded by Malick and carried. Rezoning Schedules: The following applications were scheduled for rezoning hearings: October 18: Findlay(Rush River) and Meyer(Baldwin) at the Ag Center in Baldwin at 7:00p.m. October 25: Luehmann(Star Prairie) and Boardman(Somerset)to be held at the Gov Center in Hudson at 7:00 p.m. A possible third rezoning, for Lentz (St. Joseph)will be held at the same meeting. Fisher will know for sure next week if the Town hears the request and provides a recommendation. Municipal Plats: The Committee reviewed: Townhomes of Bieneman Farm 2nd Addition in the SE 1/4 S31 T29N R19W, City of Hudson. A motion to certify no objection was made by Malick, seconded by Larson and carried. Pine Curtain in the SW 1/4 S35 T31N R18W, City of New Richmond. A motion to certify no objection was made by Raymond, seconded by Malick and carried. Violations/Citations: Fisher reviewed code enforcement status. He said the County won all three cases this past month. These goals were set: Jordan, driveway installed by 11/ 1; Smeester,hearing set for 10/ 11; Dacunha, warrant issued; Magsam, letter by 9/29; Fast, notice sent 9/26,response due in 2 weeks; Hauser, letter by 9/29, response due in 2 weeks; Cussons; inspection by 10/6; Schwan, inspection by 10/6; Block, fine paid; Olsen, contact by 10/13; and Orf, hearing 10/11. 1 Ordinance Discussion: Direct Farm Marketing: A revised draft was handed out. The Committee feels it is beneficial to have ordinance provisions enabling farmers to sell their products to consumers passing by their property, even though it is a type of commercial/retail activity, which some homeowners resent and which, if not managed well creates traffic hazards and other conflicts. Good Direct Farm Marketing provisions will help maintain the rural character of the area, and protect the income of farmers that participate, as the county makes the transition to an exurban flavor. The Committee made some suggestions. Stan Hensley suggested more communication with people interested in Direct Farm Marketing. A motion was made by Malick, seconded by Raymond and passed, to put on the October 24 agenda. The staff is to send information to Town Clerks inviting anyone wishing to discuss the subject. The staff will revise the draft again and bring it back to the meeting in October. Comm-83: Eslinger went over twoordinance amendment motions prepared by Malick and Larson. One was to regulate certain newer technologies and the other to delay the implementation of those technologies on certain soils. The Committee has concerns over having community sanitary systems served by unqualified persons. They would like to see performance bonds and licensing for community systems. Eslinger said county authority to modify the state rule is limited. Eslinger said Comm-83 does not mention performance bonds. Fisher stated that the current ordinance does not allow more than one home per sanitary system,needed to allow cluster developments to share a sanitary system. Staff will continue investigating possibilities. A motion to adjourn was made by Larson, seconded by Raymond and carried at 1:45 p.m. f Debra Zimme ,Recording Secretary C. W. Staff Recommendation: Approval Committee Action: Motion by Jensen, seconded by Raymond and carried, to approve. 3. Wohler's Estates -Final Owner: Ron Wohlers Location: Section 23, Town of Star Prairie, 23 lots totaling 49.20acres Staff Recommendation: Approval Committee Action: Motion by Malick, seconded by Larson and carried, to approve. 4. Pheasant Hills First Addition—Preliminary Owner: Ron and Dine Bonte Location: Section 16, Town of Hammond, 22 lots totaling 68.86 acres Staff Recommendation: Conditional Approval: 1) A"Dedicated Road Easement Agreement"must be completed; 2)Map revisions as requested by the County Surveyor's Department; 3)Financial guarantees equal to 120% of construction bids must be submitted and approved for erosion control and road construction. Written estimates must accompany the guarantees; 4)No construction, including earth moving, is to take place prior to approval of the financial guarantees. Red Pine Corner—Preliminary Owner: Steve Derrick Location: Section 25, Town of Richmond, 67 lots totaling 128 acres Staff Recommendation: Conditional Approval: 1)Final DNR review and approval; 2) Financial guarantees equal to 120% of the construction estimates must be submitted and approved for road construction and erosion control. A written estimate must accompany the financial guarantees. 3)No construction, including earth moving, is to take place prior to approval of financial guarantees. A construction waiver may be given provided guarantees are approved. 4) The County Highway Department and the Land and Water Conservation Department are to be notified three (3) days prior to construction beginning. Committee Action: The map had been revised to eliminate Lot 23. Motion by Malick, seconded by Jensen, and carried, to approve with conditions recommended by staff and 5) The following note is to be placed on the final plat: No owner or resident shall do anything which would interfere with or change the operation of the approved comprehensive water drainage and soil erosion plan for this Plat. This includes, but is not limited to,building upon, obstructing, altering, filling, or excavating or planting in any pond easements,water drainage ditches,water runways,water culverts,berms or grass seedings; 6) The following note is to be placed on deeds for the future lot buyers: Subject to notes,restrictions on any easements, covenants and right-of-ways of record including, 5 but not limited to,those for drainage, water retention, ponding, and or utilities as shown on the plat of Red Pine Corner recorded in Vol. Pg. St. Croix County, Wisconsin; 7) The following note is to be part of the Covenants for the Plat: Declarant was required by St. Croix County to have an approved comprehensive water drainage and soil erosion plan for the subdivision. No owner or resident shall do anything which would interfere with or change the operation of this plan. Information about the approved comprehensive water drainage and soil erosion prevention plan may be obtained from the Declarant. 6. Richmond Hills—Preliminary Owner: John and Roberta Carlson Location: Section 25, Town of Richmond, 44 lots totaling 113.52 acres Staff Recommendation: Conditional Approval: 1) Financial guarantees equal to 120% of the construction bids must be submitted and approved for erosion control and road construction. Written estimates must accompany the guarantees; 2)No construction, including earth moving, is to take place prior to approval of the financial guarantees. A construction waiver may be given provided financial guarantees are approved; 3) The County Highway Department and the Land and Water Conservation Department are to be notified 3 days prior to construction beginning. Committee Action: It appears that Lot 48 will require a special exception permit and public hearing to review proposed construction on this lot. Motion by Malick, seconded by Raymond and carried, to approve with conditions recommended by staff and with following conditions recommended by Committee: 4) Grading of any slopes 20% or greater requires a special exception permit. 7. West Ridge Acres—Preliminary Owner: Paul Sylla Location: Section 21, Town of Troy, 21 lots totaling 66.81 acres Staff Recommendation: Conditional Approval: 1) Financial guarantees equal to 120% of construction bids must be submitted and approved for erosion control and road construction. Written estimates must accompany the guarantees; 2)No construction, including earth moving, is to take place prior to approval of the financial guarantees. A construction waiver may be grated provided financial guarantees are approved; 3) The County Highway Department and the Land and Water Conservation Department must be notified 3 days prior to construction beginning. Committee Action: Motion by Malick, seconded by Larson and carried, to approve with conditions recommended by staff and 4) Submit dedicated road easement agreement; 5) Verify that final approval has been given to road plans. 8. Scenic Hills—Preliminary Committee Action: Motion by Larson, seconded by Raymond and carried, for extension of preliminary approval for one year. Extension will expire on September 26, 2001. 6
