Chairman Ron Raymond was excused. Staff present: Steve Fisher,Debbie Zimmermann, Corporation Counsel Greg Timmerman, and Jon Sonnentag. Others: Doug Zahler and Ron Johnson. Vice Chairman Jensen called the meeting to order at 9:00 a.m. A motion to adopt the agenda was made by Larson, seconded by Malick and carried. Minutes/Meeting Dates: Motion by Larson, second by Malick to approve the minutes from the July 25 and 26, 2000 meetings, carried. Motion by Jensen, second by Larson to approve minutes from meetings on July 18 and July 27,2000. Minor Subdivisions: See Attachment A Major Subdivisions: See Attachment B The Committee recessed from 9:40 a.m. to 9:50 a.m. Bills,Invoices and Revenue Report: A motion to approve bills in the amount of$169,241.86 and revenue of$31,257.10 for July was made by Larson, seconded by Jensen and carried. Violations/Citations: Fisher reviewed the status of violation enforcement actions. Hearings: Jensen opened the hearings at 10:00 a.m. Fisher read the notice for both hearings. 1) An Ordinance Amending the St. Croix County Zoning Ordinance Subchapter VII, Section 17.70 Administration(3)(c)3. Temporary Occupancy Permits, to change the issuance of a temporary occupancy permit,while constructing a permanent residence, to allow this permit to be issued through the Zoning Office as a Land Use Permit instead of through the Board of Adjustment. Staff and the Board of Adjustments recommend amending Section 17.70. Jensen asked if there was any opposition to this change. Hearing none,motion by Jensen, second by Larson to close the hearing,passed. Motion by Larson, second by Malick to recommend to the County Board to approve, carried. 2) Kent and Ardis Kramer to rezone approximately 5.4+/- acres of land from Ag/Residential to Commercial, correcting a map error. Location: NE 1/4 of the NW 1/4, of Section 4, T30N-R19W, Town of Somerset. Jensen opened the second hearing. Fisher said the request is to rezone Kramer's Kustom Cars and Antiques from Ag/Residential to Commercial. Use of this property has been commercial since the early 1960's,but on the county map it shows ag/residential. Fisher believes this should go through rezoning to correct the map. Kent Kramer, 1899 County Road C, Somerset, is the owner. He said he believed this was zoned commercial, as he had a letter,which Fisher has seen, from former zoning administrator Nelson stating that. Kramer claimed the business began there in the early 1960's. Motion by Larson, second by Luckey to close the hearing,passed. Malick moved, seconded by Luckey and carried to table the request for: 1. Staff to document the size of the existing business, including number of vehicles, number of employees, current use, dimensions, etc. and bring back at the next possible meeting. 2. The Town to concur with the documentation. Rezoning Hearings Scheduled: September 13th: Bonte(Hammond) and Danielson(Rush River) at the Ag Center at 7:00 p.m. September 20th: Stout and Boardman(both Somerset) at the Gov Center at 7:00 p.m. Municipal Plats: Pinehurst Estates—Village of Hammond. A motion to certify no objection was made by Jensen, seconded by Larson and carried. Town of Glenwood Request: The town requested$1000 in park escrow funds for a volleyball court in a park in Emerald. Fisher said this meets the requirements. Motion by Malick, second by Larson to approve, carried. Truck Purchase for 2000 Budget: Fisher discussed the purchase of a new vehicle. He will get three bids for the next meeting in September. Ordinance Discussion: Town control over commercial and industrial uses. Timmerman said he does not approve of the part of ordinance 17.18(1)(a)requiring town approval for special exceptions for commercial or industrial uses. He said 59.69 Wis. Stats. gives authority to counties, not towns. He went over a memorandum,which included a court decision supporting his opinion. Towns may veto rezoning,but that is where their authority ends. Once property is rezoned to commercial or industrial, it is up to the Board of Adjustments to issue special exception permits. The Town may recommend to the Board,but not veto or otherwise overrule. The committee directed the staff to write to the towns, giving notice that the county will be changing this part of the ordinance. If the towns want this authority,they should ask legislators to change the statute, or ask the Attorney General for a supporting opinion. Subdivision Review Fees: Fisher said that Chuck Cook, of Troy Development,has asked that the Committee review the part of the fee schedule that deals with surveyor review fees for final plats that also require state review. Cook feels it is an unnecessary fee, since it is thoroughly reviewed by the state. When Cook developed Troy Village,his surveyor review fees were returned. However,the county surveyor reviews final plats, even though they go to the state. Motion by Malick, seconded by Jensen to keep the fee schedule as is, carried. Direct Farm Marketing Ordinance: Fisher told the Committee that staff has been working on this and has gotten input from others interested. He handed out a memo summarizing questions that were raised. A lengthy discussion was held. Motion by Malick, seconded by Luckey and carried to draft these changes: 1. Seasonal stands to be removed in the off-season. 2. Signs to be unlit. 3. Adjacent highway speeds to 55 mph- 16 sq. ft. sign, 55+mph- 32 sq. ft. 2 2 4. Daylight hours of operation. 5. Employees may include family members and production employees of the farm. 6. Only where zoned exclusive ag, except where farm is permanently protected green space in ag/residential zone. 7. On the same property as home. 8. Farm products grown/produced may be sold with packaging,but nothing else. A motion to adjourn was made by Malick, seconded by Larson and carried at 12:10 p.m.. Owner: Glenn Brenne Location: NW '/4-SW '/4, Section 34, T29N-R16W, Town of Baldwin, 4 lots totaling 49.81 acres, original parcel 49.81 acres. Staff Recommendation: Conditional Approval: An erosion control plan must be submitted and approved prior to construction on the lot . Final survey revisions required, as requested by county surveyor. Committee action: Timmerman joined the discussion. The town ordinance conflicts with what the town approved Motion by Malick, seconded by Larson and carried to table until a revised map is offered,with two lots, consistent with the town ordinance, rather than four. The county will refund fees for two excess lots. 2. Owner: Gertrude Kersten Location: NE 1/4-SE '/4, Section 36, T29N-R18W, Town of Warren, 1 lot totaling 10 acres, original parcel, 120 acres. Staff Recommendation: Conditional Approval: An erosion control plan must be submitted and approved prior to construction on the lot . Committee Action: Motion by Larson, second by Malick and carried to approve with condition recommended by staff. 3. Owner: Kevin Earley Location: NW 1/4-NE 1/4, Section 12, T30N-R18W, Town of Richmond, 1 lot totaling 4.67 acres, original parcel, 40 acres. Staff Recommendation: Conditional Approval: 1) An erosion control plan must be submitted and reviewed prior to construction; 2) The minimum building elevation is to be shown; the floodplain elevation is to be shown. 3)Final survey revisions required, as requested by county surveyor. Committee Action: Motion by Malick, second by Luckey to approve with first two conditions recommended by staff. Motion carried. 4. Owner: Richard Hjelmgren Location: NE 1/4-SE 1/4& SE 1/4- SE 1/4, Section 12, T29N-R19W, Town of Hudson, 4 lots totaling 20.94 acres, original parcel, 20.94 acres Staff Recommendation: Conditional Approval: Final survey revisions required, as requested by county surveyor. Committee Action: Motion by Luckey, second by Larson to approve with condition that note be placed on map stating that Lot 2 has no access to north. Motion carried. 5. Letter to City of Richmond and Town of Richmond to have signed before final plat signed and recorded.. Motion carried. 2. Hammond Oaks First Addition—Final Owner: Humbird Land Corporation Location: Section 21, Town of Hammond, 26 lots totaling 39.82 acres. Staff Recommendation: Conditional Approval: 1) Final DOT approval must be received; 2)Final DOA approval must be received; 3) Financial guarantees must be submitted and approved; 4)No construction, including earth moving is to take place prior to approval of the financial guarantees. A construction waiver may be given provided financial guarantees are approved; 5) The County Highway Dept. and the Land&Water Conservation Dept. must be notified three(3) days prior to construction beginning; 6) Final survey revisions required, as requested by county surveyor.
