Committee Present: Ron Raymond, Gerald Larson,Art Jensen, and Linda Luckey
Committee Excused: Buck Malick
Staff Present: Steve Fisher
Chairman Raymond called the meeting to order at 7:00 p.m.
Motion by Jensen second by Larson to adopt the agenda. Motion passed.
REZONING REQUESTS
Chairman Raymond explained the rezoning process.
Fisher read the notice into the hearing.
REQUEST NO.1
Rodney Rivard to rezone approximately 10+/-acres of land from Agriculture to Ag/Residential.
Location:A parcel of land located in the SW'/4 of the SE'/4 of Section 5,T3lN-R18W,Town of Star
Prairie, St. Croix County,Wisconsin.
Doug Rivard(Rodney Rivard's father),was present and stated that his daughter wants a home on the farm
property.The land is poor;it was mined for gravel and a portion of the land will not perc for a septic
system. They want to build one home on 10 acres.
Rodney Rivard stated that he wanted to sell this land to his sister,as she wanted to raise horses. He stated
this land was less desirable for farming as it sloped toward the road and a portion had been mined for
gravel in the past.
Chairman Raymond asked for comments from anyone supporting the request.
Russel Strohbeen,702 County Road H,New Richmond WI expressed his support for the rezoning request.
He owns the property west of the Rivard's and has no opposition to the request to rezone.
There was no opposition given to the request.
Fisher presented the staff report. The applicant intends to rezone the property to sell off a building site or
sites.The proposed 10-acre rezoning is proposed to be separated from a contiguous 128-acre parcel owned p!
by Rodney Rivard.The site's soil classifications(as noted in the St.Croix County Soil Survey)contains
Class 11(2-6%slope)and Class VI(12-25%slope)soils. Fisher stated that the planning department
reviewed the request against the newly adopted St. Croix County Development Management Plan.The
proposed request does not appear to comply with the plan. The Planning Department recommended that
the applicant either amend his proposal(as suggested in the planning memorandum)or the committee
should deny the request as proposed.

Fisher asked what the daughter of Doug Rivard(who is parceling the land and building the house)would
do on the farm.
Doug Rivard stated that his daughter would work up to three days a week on the family farm and raise
horses on her property.
The committee asked why this land had to be rezoned. It would appear,based on the testimony today,that
this land was for a family member who is engaged in the family farming operation, and this would be the
second residence on the farm parcel,which is allowed in the Agriculture District.
Fisher concurred that based on the testimony the land may not need to be rezoned. The home and parcel is
for a family member working on the farm.This is permitted in the Agricultural District.
Dick King suggested that the committee rezone the property as the land is poor and the applicant has
requested rezoning.
Motion by Larsen second by Jensen to close the hearing.
Motion by Larsen second by Jensen to recommend approval of the 10+/-acre rezoning request based on
the following findings:
1. The Town certified that the provisions of §91.77 have been met with this rezoning request.
2. The applicant stated that the request complies with the Town Plan
3. There were no objections to this request.
4. The land in question is poor per testimony of the landowner.
Fisher clarified that the Town of Star Prairie does not have a Town Plan.
Motion failed with Luckey and Raymond voting"No".
Raymond stated that a number of questions were raised at this meeting:
• Is the applicant required to rezone the land for this proposed use?
• The testimony today(that the land is poor and a portion used to be a gravel pit)appears to conflict with
the maps in the planning office that indicate that this land is potentially productive farmland.
Chair Raymond asked staff to determine whether the proposed use was permitted without rezoning,and if
permitted,to allow the applicant to proceed with his plans without rezoning.
Motion by Raymond, Second by Luckey to adjourn the meeting at 7:45 p.m.
