Chairman Raymond called the meeting to order at 9:00 a.m.A motion to adopt the agenda was made by Malick, seconded by Luckey and carried. Minutes/Meeting Dates: The next meeting for this Committee is for July 26`b at the Government Center in Hudson. The hearing for the Glen Hills Moratorium/floodplain ordinance revision will be held on August 2nd. The minutes that are ready for approval will be reviewed at the meeting tomorrow. Minor Subdivisions: See Attachment A The Committee recessed from 9:55 until 10:10. Hearings: An Ordinance to delay the use of certain technologies listed in Comm-83.04-2 for one year for any site with less than 24 inches of suitable soil depth,while the systems are studied for effectiveness and safety. Raymond opened the hearing at 10:10 a.m. Fisher read the hearing notice.The zoning office is working with the state to answer questions about the new technologies. Bill Berndt,representing the St. Croix Valley Home Builders Association and Western Wisconsin Realtors, said they oppose delay and believe the state has thoroughly studied these systems. They further believe that these systems will allow for good land use planning,including cluster development,and that some of these systems are better than some systems now being used. Scott Counter,representing Hometec in New Richmond, said electric companies are working with the Homeowners Associations and would be willing to run performance tests on these systems. He suggested allowing these systems under a special exception use permit. Bob Rolle,Troy, said he thinks delay sends a wrong message . These systems have been tested.He advocated central systems in large subdivisions and more restrictive rules. He said user fees were appropriate.He indicated that individual lots under one acre in size should not be allowed use of these systems. Fisher said these systems are allowed for replacements. Dean Albert,Troy,agreed that these systems should be allowed. He asked the county to consider a case- by-case basis. These systems would go along with the cluster development that Troy implemented. Einar Horne,Hudson,agreed and asked why the delay. Horne felt that if additional staff and fee increases are needed for the new rules,they should be added. Raymond said that the plumbers and staff need to be certified and prepared for this implementation. He further stated that the state statutes allow for delay. The Committee agrees that this delay is important to minimize problems.Fisher added that it takes a tremendous amount of staff time to review applications for the new systems Staff is asking the state"first time"questions about these systems,and in some cases,the state has not answered. St. Croix County is testing the new rule due to the tremendous growth of the county. Dozens of septic permits are reviewed, scrutinized and approved weekly. Due to the large volume of systems that we 1 do every year,600 to 700,it requires a lot of staff time,and will require additional inspections on some of the systems. Staff will be looking into user fees.Performance bonds,operator licenses and public utility operations were all suggested by the audience. A motion to close the public hearing was made by Larson, seconded by Malick and carried.The Committee recessed from 11:10 until 11:23 a.m. The Committee discussed issues just raised at the hearing.It was suggested by Malick that wording be added: "...24 inches of suitable soil and if the lot is larger than 2 acres." Malick and Larson will draft revisions consistent with the public comments,review them with staff and bring to the meeting on the 9 . Major Subdivisions: See Attachment B The Committee recessed from 12:15 until 1:30 p.m. Floodplain Ordinance: A hearing will be held on August 2nd to extend the Glen Hills Moratorium for six months to allow more time for the Floodplain Ordinance to be reviewed by Corporation Counsel and the committee. A motion to place this extension on the August 2nd agenda was made by Malick, seconded by Jensen and carried. Bills,Invoices and Revenue Report:_A motion to approve bills in the amount of$15,407.49 and revenue of$67,924.50 for the month of June was made by Larson, seconded by Malick and carried. Staffing 2001: Fisher requested conversion of a part-time secretary/receptionist position to full-time. Revenue has gone from$263,000 in 1998 to an expected$600,000 this year. As of mid-July of this year, it is $431,000. Lots approved for major and minor subdivision so far this year(801), exceeds the total number of lots approved all of 1999 (594). The department has issued almost 400 sanitary permits so far this year. 700 permits are expected this year,compared to 600-some each of the last two years. A motion to approve a full-time secretary/receptionist was made by Larson, seconded by Malick and carried unanimously on a roll call vote. Violations/Citations: Fisher went over on violations. Jon Sonnentag will update the Committee on the Samuel Erickson violation at the next meeting. The Committee reviewed a draft letter to township Deputy Zoning Administrators. The new ordinance stresses the role of Deputy Zoning Administrators. A motion to approve the letter as modified by the committee was made by Malick, seconded by Raymond and carried. Municipal Plats: The Committee reviewed the following plats: Annie's Acres—Village of Baldwin,A motion to certify no objection was made by Malick, seconded by Raymond and carried. Rolling Meadows—Village of Roberts. A motion to certify no objection if the Trans 233 setback is verified, and the scale is changed to 1"=100' was made by Jensen, seconded by Larson and carried. Ordinance Revisions Direct Farm Marketing Ordinance: Fisher told the Committee that staff has been working on this. -- Town Recommendations on Special Exceptions including Commercial) and Variances: Fisher explained that the ordinance now reads that a commercial special exception may not be approved by the Board of Adjustments unless the Town approves. Corporation Counsel believes that this is not legal. The Committee suggested he request an Opinion of the Attorney General.This will be placed on the 2 u August 22'agenda. The Committee will discuss with Corporation Counsel. The Committee stressed the importance of Town input on special exceptions and variances. It was decided to change the deadline from the 4'Thursday of the month preceding the date of the next hearing, to the 15th of the month(i.e.August 15`h due date for a September 28th meeting date). This would allow the Towns time to make a recommendation. Rezonings would not have a specific cutoff date,but applicants will be advised to seek a Town recommendation. A motion to establish a policy that the deadline date for applications for special exceptions and variances be the 15th day of the month prior to the meeting date,to allow Towns time to give recommendations to the County was made by Luckey. The applicant is to be advised to get Town approval. The Zoning staff is to promptly notify the town by phone or FAX. The town is to make a recommendation and communicate it to the County before the next Board of Adjustment hearing. The motion was seconded by Malick and carried. Tem-or=Occupancy: The Board of Adjustment and staff believe these should be issued as a land use permit tion.It was suggested that wording be added to the proposed ordinance s rather than a special excep gg that a building permit from the Town be issued before the land use permit is issued. Fisher will implement the new language. A motion to approve the modified ordinance for a hearing on August 22°d was made by Malick, seconded by Jensen and carried. Subdivisions in the St Croix Riverway District: Fisher informed the Committee that NR 118 and the ordinance require subdivisions in the Riverway to have Board of Adjustment approval,before final approval of the plat. Fisher said that we have a process in place for all subdivisions involving the Town, County,Land and Water Conservation,DNR,Highway,Army Corps of Engineers and any other government entity with jurisdiction. The Committee agreed that Riverway plats could be consent agenda items for the Board of Adjustment, and the Town sent a copy of the agenda. A motion to recommend that as a matter of policy, any subdivision in the St. Croix Riverway District will be placed on the Board of Adjustment agenda as a consent item was made by Malick, seconded by Luckey and carried. Gravel Minims in the Ag District. Fisher stated that our ordinance currently does not allow gravel mines in the Ag District. The state statutes allow mining in the Ag District if the area is reclaimed back to Ag when the mining is completed. Fisher believes our ordinance should be changed to allow mining in the Ag area if reclaimed to Agriculture. At the present time, landowners are rezoning property out of exclusive Ag to Ag/residential in order to operate a gravel mine. The Committee asked Fisher to draft ordinance language and send to Malick and Luckey for review and a future agenda. a Commercial Business in Somerset: Fisher explained that there is a property in Somerset that has been used as commercial(Kustom Kars,Kent Kramer) for many years,but no maps can be found showing that it is zoned commercial. The Town sent a 1995 letter from the Zoning Office, stating that the property is zoned commercial. Fisher suggested the Committee do a county sponsored rezoning on this property. The Committee directed the staff to place this on the agenda for hearing on August 22°d 2001 Budgets Fisher said that the 2001 budgets are due on August 25`h. The Committee needs to review them before ` that time. It was decided that the budgets for Planning,Zoning,Parks and Register of Deeds would be reviewed on August 215L at 1:00 p.m. Staff is to get a copy of the budgets to the Committee before the meeting. 3 A motion to adjourn was made by Raymond, seconded by Jensen and carried at 3:25. A written estimate must 10 accompany the financial guarantees; 2)No construction, including earth moving is to take place prior to waiver being granted; 3)A construction waiver may be granted provided financial guarantees are approved; 4)Proof must be shown that required DNR permits are issued; 5) Review by the county Surveyor's Office.
