CROIX COUNTY AGRICULTURAL CENTER,BALDWIN,WI June 7,2000 Chairman Ron Raymond, Supervisors Art Jensen, Gerald Larson,Linda Luckey and Buck Malick were present. Staff present were Steve Fisher, Mary Jenkins,Debbie Zimmermann, Dave Fodroczi,Rod Eslinger and Jon Sonnentag Chairman Raymond called the meeting to order at 7:00 .m. Chaff g p ym Motion by Malick, second by Jensen to adopt agenda. Carried. The next meeting is June 13 at the Glen Hills Park at 9:00 a.m. Motion by Malick, second by Jensen to approve May 17 minutes. Carried. At 7:20 Raymond opened the hearing on items 1-4 on the agenda, dealing with the proposed Direct Farm Marketing Ordinance and amending the ordinance to include a 2-acre minimum lot size. Raymond gave a brief background on the 2-acre minimum lot size proposed. He stated that the new Land Use Plan has been approved by the County Board, but it will be quite a while before the new ordinance is finalized. This proposed lot size is consistent with the new Land Use Plan. Raymond further stated that many of the towns already have a 2-acre or greater minimum lot size. The proposed Direct Farm Marketing Ordinance is to help the farming community sell products off their farms without being zoned commercial. This has become a very complex task for the staff and committee. Staff research indicates problems that other counties have had with Direct Farm Marketing operations. David Fodroczi,Planning Director, explained the 2-acre minimum lot size proposal. He stated that significant input has gone into this proposal. He reiterated that many towns already have a 2-acre, or greater, minimum lot size. Fodroczi read over the proposed changes. There will be 3 changes to the Zoning Ordinance, and one change to the Subdivision Ordinance. He referred to the Plan map, showing the urban, transitional and rural planning areas. The lot size in the urban and transitional areas will remain 1-acre. The rural area will be the area with the 2-acre minimum lot size. Chairman Raymond asked for comments from the public. The following people spoke: Rick Derrick, Bill Peavey, Warren Bader, Jim Rusch, Bob Derrick, Dean Albert, Tom Nielsen, Steve Derrick Loren Derrick,Pat Collins. The concerns/comments of the members of the public were: f • A 2-acre lot is too large to keep up for the common homeowner; • Covenants of one subdivision require mowing, 142 would be better; • Landowner will not get as much for their land if fewer lots are allowed, 1-1/2 better; • Non-conformity of existing lots; • Towns should have a say in whether they want to be larger than 1-acre; 1 • Seek a 2-acre density, rather than 2-acre minimum; • Let technology and soils determine the lot size, i.e., Comm 83; • How will this affect cluster development, favors cluster; • Troy seeks 1A and cluster ; • Price of lots will be too high, 1-1/2 better; • Good ordinance, 1-acre lots too small for the rural areas • St. Joseph wants cluster with 1A. Aq uestion was raised on cluster development and who is responsible for the open space easement. Fodroczi stated that this and other questions raised will be addressed over the next month. The hearing was closed on this subject at approximately 7:35 p.m. Raymond opened the public hearing on the proposed Direct Farm Marketing Ordinance. Steve Fisher, Zoning Director, gave a brief overview of this proposed ordinance. He reiterated that this ordinance is to allow the rural community to directly sell farm items from their property. The intent is to help the farmers and ag related businesses, as many of the businesses now being operated are not allowed in our ordinance. Fisher went over the proposed amendment stating that there are three levels of activity with conditions involved in this proposal: 1. Seasonal Roadside Stands 2. Direct Farm Marketing Land Use Permit 3. Direct Farm Marketing Special Exception Permit—Requires a public hearing Raymond asked for comments. The following people spoke: Pat Collins, Jim Lund,Ann DesLauriers, Dan Pearson, Dean Albert,Frank Griffin, Betty Van Someren,Peggy Fickin, Heidi Helgeson, Pam Walton,Keith Relyea, Clayton Juelfs, Sonnie Crockett, Janet Hunteman, Jennifer Smith, Jeff Lueck, Fred Ball. The concerns/comments expressed were: • How will this be regulated in the Ag/Residential areas where there are other homes; • How will grandfathering of a business be addressed; • Allows signs that are too large; • Seasonal stands should be removed when not used • Any charge for permits? • Will permits have an expiration? • Farmers should be more involved in the process of establishing this ordinance; • Special exception language is too restrictive that 90% of product be raised on site, should be able to get products from other farmers, in case a crop fails; • Combined indoor and outdoor display area is too small, should be larger; • Make clear that the 2 employee limit is for retail only, not for production; • Need to look at having another district, such as Ag/Commercial; • Land Use Permit is too restrictive; • Size of building too restrictive,need to be able to allow for growth; • Cost of permits too expensive; • Screening language is too much; 2 j • Needs to be more flexible to help out the farmer; • Farmers need to find a way to make a living and immigrants from the Twin Cities are trying to push their views on people that are living here. This ordinance needs to help farmers, not hinder them, so they can keep their farms/land. • Signs too restrictive; • Hours of operation too restrictive; • Too restrictive for outside greenhouses, is a greenhouse farm or retail; • Parking lot language too restrictive, not necessary for all operations, especially if seasonal. • This ordinance is a good way to strike a balance between farmers and rural landowners. All neighbors need to be considered, not just the farmers. Motion by Jensen, second by Larson to close this part of the public hearing at 8:30 p.m. Carried. Raymond thanked the group for their comments. He further stated that they have gotten input from several areas when putting together this ordinance. The intent of this ordinance is to help out the rural community. There are some businesses at the present time that do not meet the present ordinance and this new ordinance would help to make their business compliant. This proposed language is not intended to address all existing operations,whether currently compliant or non-compliant. The comments that have been brought forth tonight will be considered. Floodplain Ordinance Fisher explained that staff would like to have language ready for the Committee for the June 27 meeting. Corporation Counsel is still reviewing. Staff will get a draft copy to Malick and Luckey in the next two weeks. Raymond stated that they want this to be on the August County Board agenda for action. Comm 83 The Committee would like to have a meeting to discuss what options they have on implementing Comm 83. A meeting was scheduled for June 14 at 7:00 p.m. in Hudson to discuss issues. They would like staff input on this. The Committee would like some answers on applicability to County, staff training, necessity to implement by July 1, 2000 and options we have as a County. Eslinger informed the Committee that several entities have a lawsuit to stop Comm 83 by July 1. Motion by Larson, second by Raymond to adjourn.
