Location: A parcel of land located in the NE '/4 of the NE '/4 in Section 32, T29N- R16W, Town of Baldwin, St. Croix County, Wisconsin, 2) Three Putt L.L.C. to rezone approximately 20 +/- acres of land from Ag/Residential to Residential. Location: A parcel of land located in the NW '/4 of the NW '/4, Section 33, T29N-R18W, Town of Warren, St. Croix County, Wisconsin. 3) Three Putt L.L.C. to rezone approximately 73 +/- acres of land from Ag/Residential to Commercial. Location: A parcel of land located in the NE '/4 of the NW '/4, the NW 1/4 of the NE 1/4 and the NE '/4 of the NE '/4, all in Section 33, T29-R18W, Town of Warren, St. Croix County Wisconsin. 4) Ordinance Discussion • Commercial District • Subdivisions in Riverway District • Gravel Mining in Agriculture District ANNOUNCEMENTS AND CORRESPONDENCE: POSSIBLE AGENDA ITEMS FOR NEXT MEETING: ADJOURNMENT (Agenda not necessarily presented in this order) SUBMITTED BY: St. Croix County Zoning Office DATE: June 13, 2000 COPIES TO: County Board Office Committee Members County Clerk News Media/Notice Board MINUTES St. Croix County Planning, Zoning and Parks Committee June 21, 2000 St. Croix County Agriculture Center, Baldwin, Wisconsin Committee present: Linda Luckey, Buck Malick, Art Jensen, Gerald Larson, Ron Raymond Staff present: Steve Fisher Chairman Raymond called the meeting to order at 7:00 p.m. The agenda was adopted on a motion by Jensen, seconded by Luckey. Next meetings will be, June 271'and 28th. Fisher read the notice into the record. Raymond explained the hearing process. Galen Anderson to rezone 20.43 +/- acres of land from Agriculture and Industrial to AOResidential,NE '/a of the NE '/a in Section 32 T29N-R16W Town of Baldwin Fisher updated the committee on this request. Galen Anderson explained his request. An adjacent landowner wants to buy some of this property. Anderson stated that some of the property requested for rezoning is an abandoned sandpit that has been reclaimed. Fisher read a letter from the Town and read excerpts from the Planning Department's Analysis and Recommendations handout recommending approval. Raymond asked for comments in opposition. There were none. He recessed the hearing. A recommendation of approval of the rezoning request to the County Board passed unanimously on a motion by Jensen, seconded by Malick based on the following findings: 1) The request meets all zoning ordinance requirements. 2) The provisions of§ 91.77 have been met. 3) The Town of Baldwin has recommended approval, and also found, among other things, that the request is consistent with § 91.77. 4) The Planning Department recommends approval and the request meets the County Growth Management Plan. Three Putt L.L.C. : Fisher read the notice. He said the request is for two rezonings, one Ag/Residential to Residential and the other Ag/Residential to Commercial, both in Section 33, in the Town of Warren. They should be considered independently. The Town has tabled both. The Town is looking into changing its growth management plan pertaining to commercial and residential properties. The applicant agreed to appear at the Town meeting on July 10th Roger Van Beek, 578 Highway 65, Roberts, presented the plan and the concept. He said that the Town Plan currently has this parcel zoned light industrial. The Town said they don't have a problem with part of this property being zoned commercial, but would like some of it to remain light industrial. He said three Putt are willing. Raymond said the Committee can not make any decision on the light industrial part of the property, as they are bound to deal with what was advertised under the public meeting law. He does not feel that any decision can be made tonight, due to the changes. Van Beek said they plan private sewer and water. Perk tests have been done. 1 Discussion focussed on the applicant addressing inconsistencies with the,County Plan, noted in the Planning Department report, which recommends postponement. Further,the Town needs to update its Growth Management Plan to allow for this rezoning, if they choose to do so. After the hearing was closed, the request was postponed unanimously on a motion by Malick seconded by Jensen. Ordinances Fisher presented three ordinance amendment topics for review. Commercial District: Under the current ordinance, any use in the Commercial District is allowed onlyas a special exception with the r p oval of the Board of Adjustment p pp d�ustment and the town board of the affected town. The Corporation Counsel believes that it is not legal that the town has approval authority or the opportunity for delay. Fisher distributed a memo including an unreported court decision supporting this opinion and interpretiing a statute. Malick suggested the Corporation Counsel could request a formal Opinion neon of the Attorney y General, which would be more persuasive authority, or as an alternative the count could Y u d amen d Y the language in the ordinance substituting: ...after consideration of any recommendation of the town board...", rather than ... "with approval of the town board... ." The Committee asked that this item be on the July 25 'agenda to hear about options suggested by the Corporation Counsel, and perhaps a draft, with a time for notice to towns. Subdivisions in Riverway District: Fisher said the ordinance requires any subdivision that has land in the St. Croix Riverway District go through the Board of Adjustment process for a special exception permit. The staff and Corporation Counsel believe this to be an unnecessary step for the developer, as any proposal has to be approved by Zoning, Highway, Land and Water Conservation, the DNR and the town before the Planning, Zoning and Parks Committee. Fisher asked the Committee to eliminate this. Malick asked Fisher to make sure that this is not part of N.R.118. Fisher stated that if that is the case and it cannot be taken out of our ordinance, staff may look at it as an "action only" item for the Board of Adjustment with no fee. Fisher will look into this for July 25 '. Gravel Mining in the Agriculture District: Fisher said land is being rezoned for the sole purpose of mining gravel. He explained that in the statutes, gravel may be mined in the Ag District, provided that it is reclaimed back to an Ag use. Fisher asked the Committee to authorize a consistent amendment.
