Present: Ron Raymond, Gerald Larson, Art Jensen, Linda Luckey, C. W. Malick
Staff present: Joe Grant, Mary Jenkins
The meeting was called to order at 7:00 P.M. by Raymond. Agenda items were discussed,
with Raymond noting that items 4, 5, and 6 will be first on the agenda,with the rezoning
requests to follow. A motion was made by Malick, and seconded by Luckey to approve
the agenda. Motion carried.
Raymond noted that the next committee meeting is scheduled for May 9 at the
Government Center. The tour of properties will not take place that day, and it was
suggested that the committee may possibly view the rezoning request site in Rush River
one-half hour prior to the hearing.
Election of Officers
Raymond turned the meeting over to Larson, who opened nominations for Chair. Luckey
nominated Raymond for Chairman. Malick made a motion to close nominations and cast
a unanimous ballot for Raymond for Chairman. The motion was seconded by Jensen and
Raymond was unanimously elected Chairman.
Raymond opened the nominations for Vice Chairman. Raymond nominated Jensen, and
Larson nominated Malick for Vice Chairman. Malick declined the nomination and made
a motion to close the nominations and cast a unanimous ballot for Jensen for Vice
Chairman. The motion was seconded by Luckey and Jensen was unanimously elected
Vice Chairman.
Nominations were opened for Secretary. Luckey nominated Malick. Malick nominated
Luckey. Luckey withdrew. Raymond made a motion to close the nominations and cast a
unanimous ballot for Malick. The motion was seconded by Larson. Malick was
unanimously elected Secretary.
Floodplain Ordinance
Raymond informed members that the Floodplain Ordinance is not completed at this time
and will be placed on the May 9 meeting agenda. Malick commented on some editing
suggestions he has, and will work directly with Rod Eslinger of the Zoning Office.
Glen Hills Golf Course
A plan to expand the Golf Course from 9 to 18 holes proposes to use parkland for the
expansion. The item will be on the May 9 meeting agenda.
Utility Easements for Perch Lake Park
Grant explained that St. Croix Electric, Ameritech, and Midwest Natural Gas require
easements to allow buried utilities on the property. The easements must be signed by the
County Board Chairman, County Clerk, and Mrs. Donna Seim; they must be notarized
and recorded with the Register of Deeds. Grant has been working with Corporation
Counsel Timmerman, who has reviewed the easements. Timmerman has advised that
since this is a real estate transaction, approval of the easements must be received from the
Planning, Zoning &Parks Committee, the Finance Committee and the County Board.
Grant would like to see approval of the easements within a time frame that would allow
the utilities to be installed in late May or early June. A motion was made by Malick and
seconded by Jensen to approve the concept with the condition that Malick contact
Timmerman regarding changes in the easement language. Motion carried.
Zoning Business
Raymond called the hearing to order at 7:30 PM and explained the procedure and rules of
the hearing. The hearing notice was read into the record.
1. Marvin and Sharon Utecht to rezone approximately 80 +/- acres of land from
Agriculture to Ag Residential. Location: an 80 acre parcel of land located in the SW
1/4 of the NW '/a and the SE 1/4 of the NW 1/4, all in Section 11, T28N-R17W, Town of
Baldwin, St. Croix County Wisconsin.
Jenkins briefed the committee, saying that a decision was postponed on September 22,
1999 in order to address several committee concerns.
Joe Granberg of Granberg Surveying, 1239 CTH"E",New Richmond, Wisconsin, spoke
on behalf of the applicant. He said that the request has been amended to 80 acres in place
of the 120 originally requested, and that the creek crossing is not an issue at this time as
the amended request excludes land on the opposite side of the creek. Granberg referred to
the proposed lot layout submitted, stating that soil suitability for septic systems
determined the placement of the lots. Granberg addressed the proximity of the parcel to
other Ag Residential and Ag II parcels within the township.
Discussion took place regarding options for the remainder of the 80 acres not being
proposed to be subdivided, as well as assuring that the portion remaining in Ag Zoning
not become land locked. Chairman Raymond called for comments from anyone wishing
to speak. No one came forward. Road standards were questioned and clarified by Town
of Baldwin Chairman Joe Hurtgen and Chairman Raymond. Hurtgen stated that the
Town has given permission for the applicant to construct one home providing the road is
constructed to town standards on the second 40-acre parcel. He further stated that the
Town subdivision ordinance allows two lots to be created within five years.
Discussion followed on the possibility of rezoning less than 80 acres, only the area of the
proposed lots. Granberg volunteered that the proposal was like a cluster development
where part of the land would be preserved from future development by a perpetual
easement, but after consultation with his client, withdrew the suggestion. He said Utecht
was willing to modify the request to include only land south and west of the creek.
After Jenkins' summary, the hearing was recessed. A motion was made by Jensen and
seconded by Malick to recommend the rezoning of all lands south and west of Carr Creek
based on the following findings:
1. The Town of Baldwin has recommended approval of the rezoning request;
2. The parcel proposed to be rezoned is unsuitable for farming
3. Existing Ag Residential and Ag II land is located adjacent to the parcel.
4. The Town and the County have certified that the provisions of§ 91.77 have been met.
The motion carried unanimously.
The hearing was reopened at 8:10 PM.
2. James and Michelle Reil to rezone approximately 7 +/- acres of land from
Agriculture to Ag Residential. Location: a parcel of land located in the NE 1/4 of the
NW'/4 of Section 20, T28N-R17W, Town of Pleasant Valley, St. Croix County
Wisconsin.
Michelle Reil, 291 162"a Street, Hammond, Wisconsin, said that she and her husband
wish to rezone approximately 7 acres to allow the sale of their house. They plan to
construct a new home on a different portion of their land. A letter from the Town of
Pleasant Valley dated April 12, 2000, supporting the rezoning, was read into the record.
Raymond called for anyone wishing to speak in favor of or opposed to the rezoning. No
one came forward. The hearing was recessed at 8:15 PM. A motion was made by Larson,
seconded by Malick to recommend approval of the rezoning request of James and
Michelle Reil to the County Board based on the following findings:
1. The Town of Pleasant Valley supports the rezoning;
2. Rezoning of the parcel would have no adverse effect on surrounding land;
3. The Town and the County have certified that the provisions of§ 91.77 have been met.
The motion carried unanimously.
The hearing reopened at 8:20 P.M.
3. Robert and Connie Chamberlain to rezone approximately 1.6 acres of land from
Ag Residential to Commercial. Location: a parcel of land located in the East %2 of the
NW '/4 of Section 3, T29N-R16W, Town of Baldwin, St. Croix County, Wisconsin.
Jenkins said the committee first heard the request on January 20, 1999, and tabled a
decision, requiring that the site be cleaned and junk cars removed. Zoning staff worked
with the Chamberlains to bring the site into compliance and at this time recommends the
committee hear the request.
Connie Chamberlain, 2339 Highway"12", Baldwin, Wisconsin, told committee members
that she and her husband wish to rezone 1.6 acres from Ag Residential to Commercial for
their auto repair business. She said they have worked to bring the parcel into compliance
and that they plan to remain in compliance. The Chamberlains were asked if the size of
the operation will increase. They said the area of the business abuts rented farmland,
prohibiting growth of the business.
Joseph Hurtgen, Town of Baldwin Chairman, said the town supports the rezoning and
feels that the area is appropriate for commercial zoning. Committee discussion took
place regarding the need for a Special Exception Use Permit should the rezoning be
approved. It was emphasized to the Chamberlains that conditions of the permit would
include compliance with the State Commercial Uniform Dwelling Code, requiring the
building to meet state commercial building codes,blacktopping, screening, landscaping
commercial access from Highway"12", and any other conditions imposed by the Board
of Adjustment. The Chamberlains said they understand and plan to meet any conditions
the Board may require on the permit.
Jenkins reviewed the request, stated the need for the Special Exception Use Permit should
rezoning be approved, and listed items the committee should consider when deliberating
on the request. Raymond closed the hearing and explained to those present that the
committee could chose to approve the request,postpone action on the request, or reject
the request.
A motion was made by Malick to postpone action on the rezoning request of Robert and
Connie Chamberlain to allow for an opinion from Corporation Counsel to determine if
there are any impediments to approval of the rezoning when an existing,non-permitted
business is in operation on the property. The motion was seconded by Luckey and carried
unanimously. Raymond recessed the hearing. The Chamberlain request will be placed on
the agenda for the committee meeting scheduled for May 9, 2000.
A motion to adjourn by Larson, seconded by Luckey, carried at 9:10 P.M.
