PLANNING,ZONING AND PARKS COMMITTEE

March 28,2000
PRESENT: Chairman Ron Raymond, Supervisors Art Jensen, Gerald Larson, Dave Hense and
Linda Luckey were present. Staff present: Steve Fisher, Mary Jenkins, Rod
Eslinger,Debbie Zimmermann, Greg Timmerman,Fran Bleskacek,Dave Fodroczi,
Ellen Denzer, Joe Grant, Dave Larson Guests: Supervisor Art Jacobson, Interim
Administrative Coordinator Don Brown, Joe Granberg, Barb Bursch, Ron Johnson,
Doug Zahler, Troy Nemmgrs, William Peavey, Pat Collins, Dan Gavin, Mike
Lenzen
Chairman Raymond called the meeting to order at 9:00 a.m. It was also noted that there are some
items under Park Business today on the agenda. There are no hearings scheduled. Fisher
explained that item g will be removed from the agenda today, as there is nothing new to report on
this. Motion by Hense, second by Larson to adopt agenda. Motion carried.
Minutes/Meeting Dates
The following dates are scheduled meeting dates for this Committee:
March 29th: Rezoning hearing in Deer Park
April 11th: Planning and Parks Meeting at Government Center in Hudson
April 12th: Rezoning hearing and public hearing on Outdoor Recreation Plan at
Government Center in Hudson
April 18th: County Board Meeting
Motion by Jensen, second by Hense to approve minutes from meeting held on March 8, 2000
with changes. Motion carried. Discussion held on March 14th minutes. Motion by Hense,
second by Luckey to approve with minor changes. Motion carried, with Supervisor Jensen
abstaining, as he was not present at the meeting.

Bills, Invoices and Revenue Report
Committee members reviewed the Zoning Department Revenue Report for February. Motion by
Hense, second by Larson to approve bills in the amount of$4,286.99 for the month of February.
Motion carried.
A letter was sent to the Zoning Office and the Committee members from the Town of Cylon with
regard to our fee schedule. Fisher told the Committee that a lot of research went into creating

this fee schedule, they were approved by the County Board, and he believes that the amounts are
justified.
Violations and Citations
The Committee reviewed the violation/citation list with Fisher. Fisher informed the Committee
that the lawsuit that was filed against Wastebusters has been dismissed, and the owner is
cooperating with our office to remedy the violations by his business.
Rezonements
The Committee scheduled rezonement hearings for new applicants as follows:
May Yd: Chamberlain (Baldwin), Reil (Pleasant Valley) and Utecht (Baldwin) to be
held at the Ag Center in Baldwin, starting time 7:00 p.m.
Don Rodel—Request for residential driveway across Wildwood Trail
Greg Timmerman, Corporation Counsel, informed the Committee that he has had some
communication with Don Rodel's attorney. Mr. Rodel believes that he owns the property, and
that the County does not. Therefore, he will not be obtaining an easement from the County, and
has stated that he may go ahead and start construction of the crossing.
Timmerman has done some research on the title for the purchase of the property from the
railroad company. He believes that the adverse possession laws may come into play on this. The
deed purports that the County owns the land. Rodel would agree to resolve the issue if he would
be allowed to have one crossing, but not be limited to how may lots the road would access.
Timmerman does not agree with this request, as he believes there are other options to be looked
at for access to this property. There are other property owners along this trail that could also ask
for access across this trail, if this request is approved. Supervisor Art Jacobson agrees that there
are several property owners that may want access across this trail, as well. Discussion held on
ownership of the trail.
Joe Grant, Parks Director, gave the background and the process that has brought us to this point.
Grant stated that the State policy on new driveways across trails, such as this, is for the State to
deny them. There have been court cases on this policy that have been upheld. After researching
this request further, Grant still believes that the best decision is to deny this request. He agrees
with Timmerman that there are other options for access to the property.
Bill Peavey stated that he is a landowner about % mile from the Rodel property. He does not
agree that the County owns the property and believes the County should compensate the
landowners along the trail for the use of the trail. He stated that he believes this is a bigger issue
than just one crossing.
Supervisor Jacobson informed the Committee that they have not moved forward on the TEA-21
Grant for the trail, as they need the cooperation of all of the people and Towns involved. He
stated that they would not be able to get the grant with all of the problems that have recently
surfaced.
Timmerman told the Committee that they need to make a decision on this matter. He believes
that we own the property and further stated that if this goes to court, we would have a very strong
case. The Parks Department is in agreement with the opinion of Corporation Counsel.
Motion by Hense, to deny access to construct a driveway across the Wildwood Trail, second by

Luckey . Motion carried with Hense, Lucky and Raymond voting in favor of denial. Larson and
Jensen voted in opposition. Timmerman informed the Committee that if construction on the
driveway begins, a lawsuit will be filed and we will ask for a restraining order.
The Committee recessed at 11:00 a.m.
The Committee reconvened at 11:10 a.m.
Ellen Denzer handed out a copy of a letter that is being sent to the Town of Eau Galle regarding
the TEA-21 Grant. Joe Grant attended the meeting held by the Town of Eau Galle, where they
stated that they would sponsor the grant with certain conditions. Planning then met with Joe
Grant and Supervisor Jacobson and went over the conditions. They came to the conclusion that
the conditions could not be met, and decided not to move forward on the Grant. Denzer asked
that the Committee review the letter, and if they approve, she requests that Chairman Raymond
and Supervisor Jacobson sign the letter and she will forward to the Town of Eau Galle.
Perch Lake Road Improvements
Patrick Collins, St. Joseph Town Chair, and Dan Gavin, Supervisor for St. Joseph, were present
to discuss the road improvements to Perch Lake Road. They are asking the County to share in a
portion of the cost for the road improvements, as this would benefit the County, as well as the
Town. They have met with Dan Fedderly, County Highway Commissioner, to see if there are
any grants available,but there are not.
Joe Grant has been out to the site and has talked with Fedderly, and they agree that it would be a
benefit to St. Croix County to have the road improved. The park entrance would be tied into the
new road and would be beneficial if improvements are made now. Grant stated that Fedderly
has commented that this is not generally the way the County does things, but this is a unique
circumstance. The park entrance needs to be constructed and this would be the best time to
construct the new road. The County would be involved in the park entrance up through the turn
lanes. The Town would pick up the cost from there. The County would be able to use the fill
that is taken from the hill that is being cut down. The fill would be used for the slope at the turn
lanes. Fedderly estimated that the total project for the entrance and road improvements would be
approximately$68,000.
Don Brown,Administrative Coordinator, addressed the Committee. He stated that he has spoken
with Fedderly on this issue. Brown believes that the entrance to the park is as important as the
rest of the project and should be done properly at the start. This could be a safety issue for
people using the park if not done correctly. He would like to see the County and Town work
together on this to reach a common goal to suit everyone.
Grant spoke to Fedderly on the phone. Fedderly believes that the County should contribute
$20,000 to the project and believes that this is a fair amount. Grant further stated that Fedderly
thinks this could possibly be accomplished within the budget that has been allowed for the first
phase of the park. Grant stated that they want it made clear that if the budget cannot cover the
$20,000, they would be allowed to go to Finance and have a transfer from the contingency fund
to cover the costs. They will do all that they can to keep it within the budget, but there are no
guarantees.
Gavin said that he will take this proposal back to the Town Board meeting tonight. He feels
confident that they will be able to get this project done with the help of the County. At a future
Town Board meeting, they will be discussing making a donation to the Homestead Park. They

plan to contribute $20,000,over the next four years, to Phase II of the park. The Town is very
interested in working with the County on this park project.
Motion by Raymond to instruct the Parks and Highway Department to work with the Town of St.
Joseph to work within the $20,000 amount to improve the road and park entrance. Second by
Hense. All in favor. Motion carried.
Floodplain Ordinance
Eslinger stated that he would like the Committee to set up a time for a public hearing on this
ordinance. The Committee decided to hold the public hearing on May 24t" at the Ag Center in
Baldwin at 7:00 p.m. Eslinger also stated that this ordinance is primarily being done for the Glen
Hills Watershed Project. In order to remove the moratorium this had to be revised.
The Committee reviewed the Floodplain Ordinance and had some changes. Eslinger will make
the changes and give a revised copy to the Committee for the April 25"'Committee meeting.
I,Direct Farm Marketing Ordinance
Fisher informed the Committee that they have been working on this ordinance for about a year
and have gotten a lot of feedback on it. They have worked with Planning as well
There was some discussion on how this ordinance will relate to signs. Denzer stated that the sign
part of this ordinance is in conjunction with the Zoning sign ordinance.
Fisher stated that with this ordinance, the Zoning Office will be able to issue land use permits for
some uses, rather than having to go through a formal procedure. There was a discussion held on
some of the wording in the proposed ordinance. Raymond reminded the Committee that this
ordinance is being written to be able to help the farmers in the area. Fisher will make suggested
changes and have another draft ready for the Committee for the next meeting on April 25th
Motion made by Larson, second by Hense to adjourn. Motion carried. Meeting adjourned at
1:25 p.m.
