1) Roger Kukowski/ Kowski Farms, Inc., to rezone approximately 91 +/-
acres of land from Agriculture to Ag/Residential. Location: A 91 acre
parcel of land located partially in the NW 1/ and the NW '/ of the SW '/4,
all in Section 3, T31 N-R19W, Town of Somerset, St. Croix County,
Wisconsin.
2) Peter and Mary Walen/ Fairmont Farms, to rezone approximately 5 +/-
acres of land from Agriculture to Ag/Residential. Location: A parcel of
land located in the NW '/ of the NW '/ of Section 23, T28N-RI7W, Town
of Rush River, St. Croix County, Wisconsin.

March 22, 2000

Committee Present: Ron Raymond,Dave Hense,Gerald Larson,Art Jensen,Linda Luckey
Committee Excused: None
Staff Present: Steve Fisher
Chairman Raymond called the meeting to order at 7:00 p.m.
Motion by Luckey second by Jensen to adopt the agenda.
Hense stated that he will be absent for the March 29th rezoning hearing.
Staff would like to cancel the April 5th rezoning hearing and reschedule it to March 12th at the Government
Center at 7:00. Fisher will coordinate with Ellen and Debbie to make sure it receives the proper newspaper
publication notice.
Chairman Raymond explained the rezonement process. Raymond revised the order of the agenda and read
the notice into the record.
REQUEST NO.1
Roger Kukowski/Kowski Farms,Inc.to rezone approximately 91 +/-acres of land from Agriculture to -
Ag/Residential. Location: A 91 acre parcel of land located partially in the NW'/4 and the NW'/4 of the
SW'/4 all in Section 3,T31N-R19W,Town of Somerset, St. Croix County,Wisconsin.
Roger Kukowski,260th Street,Osceola, stated that there is an existing subdivision which abuts his property
and this would connect the two subdivisions. It is mostly woods and very poor cropland.
Chairman Raymond asked for comments from anyone supporting or opposing the request. None were
heard.
Fisher presented the staff report and recommended that the rezoning request be approved for the following
reasons:
1) Meets the intent of the Somerset Town Land Use Plan
2) The site has poor soil conditions including Class VI soils.
3) The Township approves the request,and concurs that the proposal meets the Town of
Somerset Land Use Plan.
Chairman Raymond recessed the hearing.
Hense questioned what the approximate lot size would be. Kukowski stated that they would be three-acre
lots.
Motion by Jensen second by Larson to recommend approval of the 91-acre+/-rezoning based on the
following findings:

1) The proposal meets Town of Somerset Land Use Plan.
2) The proposal meets all requirements of the St.Croix County Zoning Ordinance.
3) The Town and County confirmed that the request is compliant with §91.77.
4) The Town of Somerset recommends approval of the request.
5) The majority of the parcel is rolling woodland,with poor soils—including class VI soils.
6) The applicant modified his rezoning request from 135 acres to 91 acres(at the Towns
request)to preserve tillable farmland on the parcel.
7) Existing Ag/Residential abuts the property to the northwest,south and southeast;the
applicant intends on developing this parcel and connecting two existing subdivisions with
this rezoning request.
All in favor,motion carried.
REQUEST NO.2
Peter and Mary Walen/Fairmont Farms to rezone approximately 5+/-acres of land from Agriculture to
Ag/Residential. Location: A parcel of land located in the NW'/4 of the NW'/4 of Section 23,T28N-R17W,
Town of Rush River, St. Croix County,Wisconsin.
Mary Walen, 1764 County Road N,Hammond,stated that she would like to rezone and sell five acres for
her son to build a home on. This has always been a sandpit and it is very poor farmland.
Raymond asked for comments from anyone supporting or opposing the request. None were heard.
Fisher presented the staff report and recommended that the rezoning be approved for the following reasons:
1) The site has poor soils—including class VI.
2) Township approves the request.
3) According to testimony from the applicant the land is not suitable for farming.
4) Applicant is rezoning to provide a building site for a family member(son).
Motion to close the public hearing by Hense and seconded by Larson.
Motion by Raymond second by Larson to recommend approval of the 5-acre+/-rezoning request based on
the following findings:
1) Town of Rush River recommends approval of the rezoning request.
2) No public comments opposing the request.
3) Purpose of rezoning is to provide a building site for son/family member
4) The site has poor soils—including class VI,applicant testified that the land is not suitable
for farming.
5) The Town and County confnned that the request is compliant with §91.77.
All in favor. Motion carried.
Motion by Hense Second by Larson to adjourn the meeting.
