Dave Hense was excused. Staff present: Steve Fisher, Rod Eslinger, Debbie Zimmermann, Fran Bleskacek, Kevin Grabau, Ellen Denzer. Guests: Glen Wiese, Ron Johnson, Joe Granberg, Price Rivard, Steve Waak, Harvey Johnson, Larry Murphy, Bob Rolle Chairman Raymond called the meeting to order at 9:04 a.m. It was also noted that items d, a and g will be taken off of the agenda for today. There are no hearings scheduled. Motion by Jensen, second by Larson to adopt agenda with changes. Motion carried. Minutes/Meeting Dates The following dates are scheduled meeting dates for this Committee: March 8th: Rezoning hearing in Baldwin March 14'h: Planning and Parks Meeting at Government Center in Hudson March 15`h: Rezoning hearing at Government Center in Hudson March 22nd: Rezoning hearing in Baldwin March 28`h: Zoning meeting at Government Center in Hudson Motion by Raymond, second by Jensen to approve minutes from meeting held on February 8, 2000 with changes. Motion carried. Hearings No hearings today. Minor Subdivisions See Attachment A Major Subdivisions See Attachment B Bills. Invoices and Revenue Report Committee members reviewed the Zoning Department Revenue Report for January. Motion by Raymond, second by Luckey to approve bills in the amount of$8,668.06 for the month of January. Motion carried. Violations and Citations The Committee reviewed the violation/citation list with Fisher. Rezonements The Committee scheduled rezonement hearings for new applicants as follows: March 291h: Strohbeen (Star Prairie) and Gillen (Cyton) to be held at the Community Center in Deer Park, starting time 7:00 p.m.. April 5th: Paul Sylla (Troy) to be held in the community room at the Government Center in Hudson , starting time 7:00 p.m. The Committee will view these sites at the end of the committee meeting on March 141h Town of Hudson Zoning Ordinance Amendment Review/Ratification Fisher explained that the Town of Hudson Board has adopted an ordinance Regulating Adult Establishments as part of the Town of Hudson Zoning Ordinance. The Committee reviewed the ordinance. A motion was made by Raymond, second by Luckey to forward to County Board, contingent on review by our Corporation Counsel. Motion carried. This will be placed on the County Board agenda on March 215f 1 Direct Farm Marketing Ordinance Fisher explained that he has worked with Corporation Counsel and Planning on drafting this ordinance. The Zoning department has had numerous phone calls supporting this new ordinance. The Committee reviewed the handout. There was some discussion held on the difference between Agriculture and Ag/Residential districts. Eslinger pointed out that any direct marketing operation needs to be in tune with the agriculture area. There was a discussion held on the language in the ordinance regarding parking. The committee would like staff to re-look at this, as they do not feel that parking to this extent is needed in all cases. Staff will place on agenda for next month's meeting. Register of Deeds Kay Walsh asked the Committee to approve an increase in hotel room rate for a conference she will be attending. The room rates are $64 per night. Motion by Raymond, second by Larson to approve. Motion carried. Floodplain Ordinance A draft of this ordinance will be presented at the Planning meeting on March 14`h. The Committee would like to see this on the County Board agenda for April. Amending Non-Conforming Language Eslinger went over the draft language with the Committee. Zoning has been working with Corporation Counsel on this language, and Timmerman has added some wording from the State Statutes. They are still working on wording under non-conforming structures b. and c. with regard to the 50% rule. Bob Rolle, Town of Troy, believes that the DNR's reasoning behind the 50% rule is to get rid of non- conforming structures in the Riverway. The Town of Troy has some questions on this, and Rolle will get these questions to Corporation Counsel. Eslinger stated that this language is to be for the whole county, but agrees that there may be specific areas where we may need to look at the Riverway separately. Chairman Raymond asked that information on this be sent to Luckey and Hense for their review, as they have been involved in ongoing Riverway issues.The staff will work on this language and be prepared to discuss again at the March meeting. Staff Recommendation: Conditional Approval : 1)the joint accesses must be constructed to County standards to the point where they divide for the separate lots; verification from Surveyor's Department that all revisions have been made. Staff Recommendation: Denial Committee Action: Motion by Jensen, second by Luckey to deny based on the following findings: 1. Section 18.16 (D), St. Croix County Land Use Ordinance, provides that roads shall be designed to permit the safe, efficient, and orderly movement of traffic; to meet the needs Pi of the present and future population with a simple and logical pattern; to respect natural features and topography; and to present an attractive appearance. 2. Section 18.16 (1-1)(3), St. Croix County Land Use Ordinance, provides that all ways serving two or more lots are considered roads. If no more than two lots are served by a road, the road may remain private. All such private roads serving more than one lot shall be constructed to County road standards. 3. The alternate proposal for access submitted by your surveyor shows an attempt to circumvent the ordinance requirements for construction of the road to county standards. 4. The alternate proposal does not meet the intent of the ordinance to provide a simple and logical pattern nor does it consider the needs of future population or development. 5. The construction of two driveways located side by side to access two lots adjacent to one another is not a logical access design nor it a simple design. 6. The County Zoning Office, in correspondence to you dated February 10, 2000, informed you that the alternate access proposal was unacceptable and outlined the requirements to obtain approval of the minor subdivision. Motion carried. 3. Hammond Oaks—Preliminary Owner: Humbird Land Corporation Location: Section 20, Town of Hammond Staff Recommendation: Conditional Approval: 1)The County requires financial guarantees equal to 120% of the construction estimates for erosion control and road construction. A written estimate must accompany the financial guarantees; 2) No construction, including earth moving, to take place until financial guarantees have been submitted and approved; 3)The County Highway Department and the Land and Water Conservation Department must be notified three (3) days prior to construction beginning; 4)Verification from the Surveyor's Dept. that all minor map revisions have been made; 5)These requirements must be noted on the face of the final plat: The County will require that all septic system perimeters—including downslope areas—be roped/taped and maintained prior to individual lot grading or land disturbance.All mound and downslope areas must be protected from disturbance and compaction at all times. Scenic Hills—Preliminary Committee Action: Postponed 5 Fe,Qr'�rrav,� 2 2, 2000 To: St.Croix County Planning, Zoning and Park Committee From: Glen Wiese Subject: Final Plat Approval of Frontier Subdivision I want to make this written statement, for inclusion in the records of this meeting today, as you consider the final approval of the Frontier Subdivision plat. I am one of the landowners abutting the south side of the Frontier Subdivision. My letter of concern, dated September 10, 1999, was entered into the records of your Committee meeting of September 19 , 1999 . (A copy of that letter is attached without the maps referred to in the text of that letter) . At that meeting you gave preliminary approval to the plat.Thisllpproval was granted in spite of the testimony by Dean Albert, Chairman for the Town of Troy, that the Town would have recommended going Fast with the temporary cul-de-sac if they had it to do over again. Also, one of your members, David Hense, voted against approval of the preliminary plat. He was the only Board member, who�ook the time to visit my property, to see the poor choice by your Planning Staff in the location of the temporary cul-de-sac. See attached letter written by Steve Fisher on June 7, 1999 giving direction as to the location of the cul-de-sac. The grading and preliminary installation of the roadway and the temporary cul-de-sac has now been completed. My concern continues that my spring-fed pond will be contaminated and or filled with silt, debris and chemicals as run-off from the roadway and the cul-de-sac. I receive fine verbal assurances from the engineering groups that my pond will receive no greater contaminated run*off than prior to the development. Common sense does not lead to the same answer. I am again asking for your consideration of a change in the location of the temporary cul-de-sac teentry property.
